Along with the joys of the season come the stressors. This year you wonder how you will manage to get everything done. Your “to-do” list, as always, seems never ending with shopping, baking and decorating. This year, however, you know at the top of your priority list is providing the best possible care for your elderly loved one who suffers from increased dementia. Dementia Stress This time of year, can likewise create stress for your loved one whose anxiety levels seem to mirror your own. Unlike yourself, however, the dementia affects your loved one’s ability to express himself or herself clearly. Simple changes in routine can cause unexpected anxiety which increases with the inability to verbalize what they are feeling. In addition to the stress on both caregiver and care recipient, out of town guests add a whole new dynamic. Family members may feel shocked by your loved one’s mental and physical changes. This shock can produce feelings of guilt or anger that may be directed at you. Your loved one may also exhibit additional uneasiness — possibly viewing family members as strangers. The Holidays & Dementia Stress So, the question remains, “How do you make it through the holidays and maintain some semblance of peace?” And, equally important, “How do you help your elderly loved one do the same?” First, you may want to do some pre-planning. Waiting until the last minute often leaves a person feeling rushed and harried. To avoid this unnecessary stress, create a list of priorities. If you plan to take your loved one with you holiday shopping, hit stores early in the day and on weekdays. Most malls and department stores are far less crowded at these times. Also, take along a picture of the person you are shopping for. This provides a reminder to your loved one and an opportunity for their input on the gift. Encourage your loved one to take part in wrapping the gifts when at home. (Be mindful, however, of their frustration levels.) How to Reduce Holiday Dementia Stress If you are doing any of the holiday cooking, establish the menu ahead of time. Plan to buy as many of the ingredients as possible a week or two in advance. Also, prepare whatever will keep in the refrigerator or freezer ahead of time so there is less to do on the actual day of your gathering. Most importantly, don’t be afraid to ask others to bring along a dish. Most guests would be happy to help. Prepare your visiting family members for potential changes in your loved one’s status. Imagine how drastic changes and declines would seem if you had not been able to witness them. Sharing can help them prepare family and friends for the emotions they may feel when confronted with these changes. Ward Off Holiday Dementia Stress Ultimately, you cannot eliminate stress from every environment. For this reason, it is essential that you eat well, exercise and get plenty of sleep. With your own stress level in check, you can focus on monitoring the stress levels of your loved one. If the stress gets overwhelming, consider getting help with your caregiving tasks. Home health care agencies can provide help a few hours a day or a few hours a week. Adult Day Care gives your loved one a safe environment in which to interact with others. If your holiday plans include an over-night visit or extended stay, check into Respite Care. Get professional help early. The Veteran Administration can be an excellent potential source of funds for long-term care (either at home or in an assisted living facility). Veteran’s benefits are available for a non- service connected disability. Most VA benefits and pensions are based on a disability which was incurred during a veteran’s wartime service. There is another benefit, however – a pension program – available for individuals who are disabled due to the issues of old age, such as Alzheimer’s, Parkinson’s, multiple sclerosis, and other physical disabilities. For those veterans and widows (ers) who are eligible, these benefits can be a blessing for the disabled individual who is not yet ready for a nursing home. Under this program, a veteran can receive a maximum of $1,801 per month in benefits and a widow or widower can receive up to $976 as a maximum benefit for A and A for the year 2007. The applicant must be determined to be “permanently and totally disabled.” The applicant does not need to be helpless – he/she need only show that he/she is in need of aid and attendance on a regular basis. Young of Walnut Creek Elder Law specializes in estate planning, asset protection and elder law. California Probate Attorney Probate in California involves a somewhat complex legal proceeding wherein the court appoints a representative to finalize the decedent’s estate. Upon court order, the representative makes the final distributions from the decedent’s estate to pay for the last debts of the decedent, including taxes, and makes distributions to the beneficiaries. The procedure can take up to a year or more to finalize, but can take less time if the estate is simple and there are no complications. The probate procedure can occur with or without a will. Revocable Living Trusts The revocable living trust and other estate planning tools are popular because they help to avoid the expense and time involved with a probate. Assets that are transferred to the revocable living trust are not subject to probate. Diagram of Estate Planning Probate Potential Assets that are subject to probate, for instance, would be those that are in the decedent’s name alone. Assets that are held with another person as tenants in common, as opposed to joint tenancy, would be subject to probate. If the total amount of assets to be probated are under $100,000, a formal probate may not be necessary to transfer the assets to the intended beneficiaries, and a simplified procedure may be utilized. Assets Assets that are not subject to probate would be those held in joint tenancy with another person and assets held in a revocable living trust. Also, assets that are held in accounts which have “pay on death” provisions are not subject to probate. Also, life insurance and IRA accounts with a named “pay on death” beneficiary are not subject to probate. Fees The fees paid to the attorney and the executor or administrator are the same. If the executor or administrator are also beneficiaries, they may waive their fee. The amount of the fees are set by the California Probate Code according to a formula, based on the value of the assets. Additional or “extraordinary fees” may be allowed by the court if litigation is required, for instance.   Five Frequently Asked Probate Questions By Michael J. Young, Your Probate Attorney in Walnut Creek, CA. Five frequently asked probate questions, updated in July 2020 Will I, as your client, need to appear in court if I am appointed as executor? The answer is generally NO. Probate court proceedings are conducted mostly through documents, forms and written declarations. Testimony in probate court is rare, except in the case of a will contest. If I am appointed by the court to be the executor, do I have to serve? No. If you decide that you do not want to serve as the executor, the court will usually appoint the alternate executor named in the will. If there is no alternate executor, or no will, the court will usually appoint a capable family member to serve. How do the client and the attorney get paid for their services? If you, the client, is appointed by the court to administer the estate, the Probate Code allows for a payment of a fee to you. The amount of the fee is set by the Probate Code, and is determined by the gross value of the estate assets. You, as the client, can either accept the fee or waive the fee. The fee the attorney receives is usually in the same amount. How long does an average probate take? A probate can be completed in 8 to 12 months, provided that there are no unusual problems. There is a four-month creditor’s claims period. The court calendars are crowded, so hearings are set several weeks out. Do living trusts go through probate? No, and that is one of the advantages of having a revocable living trust. When an asset, such as your home, is properly titled into your trust, there will be no probate. Thieves often target seniors because they perceive older adults as being more vulnerable. Here are some tips for how older people can reduce their risk of facing stolen mail. Stolen Mail Have your mail delivered to a secure location. If possible, have your mail delivered to a post office box or a secure mailbox. This will make it more difficult for thieves to steal your mail. Check your mail regularly. Don’t let your mail pile up. Check your mailbox every day, or have a trusted neighbor or friend check it for you. Don’t open mail from unfamiliar senders. If you don’t recognize the sender, don’t open the mail. Shred it or take it to the post office. Be careful about what information you give out over the phone. Don’t give out your personal information, such as your Social Security number or bank account number, to anyone who calls you unsolicited. Consider getting a mail theft detector. Several devices detect when someone opens your mailbox. Report mail theft to the police. If you suspect mail theft, report it to the police immediately. Here are some additional stolen mail tips that are specific to older adults: Let your neighbors know that you are elderly and that you live alone. This will help them to be more vigilant and to report any suspicious activity to you or the police. Don’t leave your mail in your mailbox overnight. If you can’t get to your mailbox during the day, take your mail with you. Don’t open mail in public. This could make you a target for thieves. Be aware of scams that target older adults. There are many scams that target older adults, such as the “grandparent scam” and the “IRS scam.” Be aware of these scams and don’t give out any personal information to anyone who calls you unsolicited. By following these tips, you can help to protect your mail from being stolen. In addition to the tips above, here are some other things you can do to protect your mail: Keep your mailbox clean and free of clutter. This will make it more difficult for thieves to hide their activities. Install a bright light near your mailbox. This will deter thieves and make it easier for you to see if someone has tampered with your mailbox. Consider getting a security camera that can monitor your mailbox. This will give you peace of mind knowing that you are being watched. By taking these steps, you can help to protect your mail from being stolen and keep your personal information safe.
