An agreement was reached earlier this month to settle the claims, in which the county admitted no fault or liability for the alleged practice but nonetheless promised a judge that it would institute a lawyer registry to automate the exclusion of attorney-client-privileged communications from jail review. The lawsuit, filed in September on behalf of attorneys Curtis Briggs, Robert Canny and Matthew Murrillo, stated that the county sheriff’s office gave no notice or warning that it had the ability to look through private communications between attorneys and inmates. An initial response from the sheriff’s office contended that the system “clearly and specifically tells all persons in custody who use it that it is not for communicating with attorneys. Further, all others who use it are clearly informed that emails can be monitored and are not private.” While denying any fault, the county has since done an about-face, pledging in the settlement agreement that it “will use its best efforts to implement a professional registration option in SEM to enable county incarcerated persons to communicate confidentially with their counsel of record.” SEM refers to SmartInmate Electronic Messaging, a service by Florida-based Smart Communications Holding, Inc. which is contracted to operate the county jail messaging system through 2024. The agreement also includes a compulsory joint public statement from the plaintiffs and defendants that notes that the plaintiffs will not pursue legal fees so that “this settlement does not cost taxpayers any money,” and that the plaintiffs are “grateful for the county’s recognition of the importance and the integrity of the attorney-client relationship for incarcerated persons and their counsels.” Ara Jabagchourian, an attorney who represented the suing lawyers, said he’s glad the court system compelled a resolution so quickly. “We weren’t there to make money. Our point was to get this change done immediately,” Jabagchourian said. “They did the right thing, but they should have done it before we had to file. But then it became public, it got embarrassing, and they gave us what we needed.” A message left with the sheriff’s office was not immediately returned Friday. Other grievances some of the suing attorneys — as well as civil rights activists — have with the county’s jail mail system remain unresolved. The Smart system was approved and instituted in the county with little public fanfare, which they attribute to the fog of the pandemic. What remains in place is a workflow in which personal mail sent to people held in San Mateo County jails must first go to a P.O. Box for Smart Communication in Seminole, Florida, where letters and other paper correspondence is scanned electronically, reviewed for content, then entered into the system at the jail where it can be viewed with the in-house tablets. The actual paper material is shredded after 30 days, but electronic records are retained for at least seven years, according to the county’s contract with the vendor. Joint Statement: The lawyer plaintiffs are pleased to announce a speedy resolution of their federal lawsuit involving the San Mateo County Sheriff s Office. The County has agreed to use its best efforts to implement a means for incarcerated persons to communicate confidentially with their attorneys using electronic messages. The electronic message means is in addition to the existing methods of attorney client communications within the San Mateo County jails of in person visits, video visits, telephone calls, and legal mail. The lawyer plaintiffs have agreed to waive all fees and costs so this settlement does not cost taxpayers any money. The man, Brendon ‘Bren’ Farrell, met the plaintiff in the case via Match.com in 2016, according to court documents. Beginning in August 2016, Farrell intertwined his romantic relationship with her with financial trust, promising that if entrusted with her money, he would eventually create better returns on it than she or any financial advisor could, court documents said. From 2016 to 2018, she gave Farrell $672,811 — only $85,000 of which was ever paid back. And she wasn’t the only woman, attorneys say, noting five women, including the plaintiff, testified that a similar scheme was employed against them. “It’s really a scheme. That was our whole case,” Steve Leydiker, an attorney on the case, said. “It was a pattern of conduct. That’s where we had to bring up these other women, to show this conduct was so similar in nature.” Going through Farrell’s bank records, Leydiker said he was astonished at the amount of women it seemed Farrell had defrauded, many of whom were Chinese and had come to the country for work, with little family in the area. “This is how he does business. He goes on these dating websites, targets a specific demographic of women,” Leydiker said. “All they know is work. They don’t understand the dating world, they don’t have any family here … and then they meet this guy, a sophisticated savant type, who shows off all his entrepreneurship abilities and wealth and basically woos these women with all these success stories.” If plaintiff suggested that she would go to the authorities, he would also allegedly threaten to expose sexually explicit material of her, Ara Jabagchourian, another one of the plaintiff’s trial attorneys, said. “If anyone wants to make a move, guess what he has?” Jabagchourian said. Farrell’s attorney’s office could not be reached for comment, but he filed a cross-complaint in 2021 alleging that when their relationship ended in 2018, the woman suing him “hatched a plan for control” to extort him for the $85,000 and punish him if he did not comply. All of those allegations except one — charging more than the legal rate of interest of 10% when she demanded he repay her money and the two entered into an agreement — were dismissed by the jury, Jabagchourian said. He said he expects that, too, will be dismissed by the judge in the coming months. A companion case, filed by one of Farrell’s other alleged victims, will be going to court next year, Jabagchourian said. She lost less money, around $30,000, but it followed the same dynamic. “It’s either a, ‘What do you got? You got 401(k)s? I could do better than Wall Street. Look at me, I can do better and trust me with your money, and if we’re going to be in a long-term relationship, you’ve got to trust me anyways,’” he said. “Or, ‘my startup is running into a cash crunch right now. I’m going to be running into some big money soon. I need some money.’” Farrell has filed lawsuits against two of the women that testified during the first plaintiff’s trial, a move her lawyers say was designed to intimidate them. Though Farrell could still appeal the jury’s Nov. 7 verdict, Jabagchourian said he was pleased with the results of the case and felt they sent a firm message. Makiko Fukaya said in her Northern District of California suit on Monday that she had a violent allergic reaction to a Tiramisu Twist Cookie bought from a Daiso store last summer in Daly City. After beginning to eat the product in her car, Fukaya started to react before realizing the cookies contained nut products. She dashed to Target for an EpiPen and was rushed to the emergency room, the suit says. Fukaya says she discovered that, while the Japanese version of the ingredients list identified nut products, the English version did not. Counsel for Fukaya alerted defendants Daiso California Holdings LLC and Daiso California LLC in October, and a worldwide recall was issued the following day, the suit says. In December, Fukaya went back to the Daly City Daiso store for more items, including caramel corn made by Tohato, the suit says. Like the cookies she previously purchased there, the caramel corn also had differing English and Japanese ingredients labels, with no mention of tree nuts on the English label, according to the lawsuit. “The concern here is that, whatever process is being used to translate the original Japanese ingredient label to the English language sticker label placed on the original packaging is woefully inadequate and is endangering the lives of consumers based on these mislabeled ingredient lists,” the suit says. “Defendants have been placed on notice that their English-translated food labels on packaged goods are inadequate, with the risk of endangering lives, yet have failed to systemically review the process of how these labels are translated,” the suit adds. The suit seeks damages and proposes a California class, multistate class and nationwide class for consumers who purchased certain products for personal use. Each class is estimated to number in the thousands, according to the suit, which alleges violations of the Consumers Legal Remedies Act, the False Advertising Law, and the Unfair Competition Law, plus breach of express warranty on behalf of the multistate class. A spokesperson for Daiso told Law360 that “since this is a pending litigation matter, Daiso California LLC has no comment at this time.” Fukaya is represented by Ara Jabagchourian of Law Offices of Ara Jabagchourian P.C.
