The EB-1 visa is for workers who are considered “First Preference” workers. This type of visa is reserved only for elite immigrants who can prove their excellence, extraordinary ability, or outstanding achievements in their fields.\r\n\r\nForeign nationals pursuing the EB-1 visa should be aware that the U.S. Citizenship and Immigration Services (USCIS) applies rigorous review standards to all petitions. Applicants who wish to qualify under the EB-1 criteria must demonstrate extraordinary ability through verifiable evidence of sustained national or international recognition.\r\n\r\nWhile these requirements are demanding, they allow successful applicants to enjoy several benefits, including faster processing and exemption from the labor certification process.\r\n\r\nOther employment-based immigrant visas require a National Interest Waiver (NIW) to circumvent the labor certification process. But the extraordinary requirements for the EB-1 visa means that there is no EB-1 NIW. Applicants are exempt from labor certification.\r\n\r\nYou may be eligible for an EB-1 visa if you can prove that you fit into one of these three EB-1 occupational subcategories:\r\n\r\n \tA noncitizen of extraordinary ability\r\n \tAn outstanding professor or researcher\r\n \tA multinational executive or manager\r\n\r\nThis guide will explain the differences between the occupational subcategories of EB-1 visas, discuss the steps for applying for an EB-1 visa, and tackle some of the frequently asked questions about EB-1 visas.\r\nTable of Contents\r\nRequest A Consultation\r\n\n \n \n \n \n First Name(Required)First & Last Name(Required)PhoneEmail(Required)\n \n How Can We Help?(Required)\n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n \n\r\nMeet The Attorney\r\n\r\n\r\nLearn More\r\n\r\nAngela D. Each occupational subcategory has certain eligibility requirements that must be met and certain evidence that must be submitted with the petition. No labor certificate is needed to petition for an EB-1 visa in any of these subcategories.\r\n\r\n\r\nEB-1A Criteria: Immigrant Visa for Extraordinary Ability\r\nThe EB-1A criteria for qualification including being aa foreign national who can show that you have extraordinary ability in either the sciences, the arts, education, business, or athletics. You will need to show proof that you have sustained national or international recognition for your extraordinary ability.\r\n\r\nTo prove this, you will either have to show USCIS proof of either one major internationally recognized award (like a Pulitzer Prize or an Oscar), or you will have to show proof of three less renowned major awards or accomplishments.\r\n\r\nSome examples provided by USCIS as acceptable evidence of extraordinary ability and achievement include:\r\n\r\n \tWinning a national or international award for excellence\r\n \tBeing featured in a major trade publication or a major media outlet\r\n \tBeing asked to judge the work of others in your field\r\n \tOriginal scientific, scholarly, artistic, or business–related contributions of major significance\r\n \tDocumentation that you are paid significantly higher than others in your field because of your extraordinary talent\r\n \tCommercial success in the performing arts\r\n \tHaving an important position in a distinguished organization\r\n\r\nThis is an elite immigrant visa reserved for very distinguished immigrants with extraordinary talent. If you are an EB-1A visa applicant, you don’t need to have an offer of employment from anyone, nor do you need a sponsor at all. If you are an EB-1A visa applicant, you can file a Form I-140, Petition for an Alien Worker, on your own behalf.\r\n\r\nWhen preparing an EB-1A petition, precision in documentation is essential. USCIS officers evaluate not just the quality but also the relevance of evidence. Applicants should provide comprehensive explanations that connect each exhibit, such as publications, awards, or media coverage, to their extraordinary ability that meets the EB-1A criteria.\r\n\r\nDemonstrating the lasting impact of one’s contributions, rather than simply listing accomplishments, often strengthens the petition.\r\nGet The Immigration Help You Deserve\r\n\r\nRequest A Consultation\r\n\r\nEB-1B Immigrant Visa for Outstanding Professors and Researchers\r\nTo qualify for an EB-1B visa, you must be able to show that you are an outstanding professor or researcher. To prove this, you must show USCIS that you have been internationally recognized in your academic field. You must have at least three years of teaching experience in your field or three years of research experience in your field.\r\n\r\n\r\n\r\nYou will need at least two pieces of evidence documenting your outstanding work. Some examples of proof you can submit that USCIS will consider include:\r\n\r\n \tReceiving a major prize or award for outstanding achievement\r\n \tMembership in an elite association related to your field\r\n \tHaving a professional publication in your field, write about your work\r\n \tOriginal scientific or scholarly contributions in your field\r\n \tHaving written a scholarly book or articles in scholarly journals with international circulation pertaining to your field\r\n\r\nIf you are applying for an EB-1B visa, you also need to show USCIS that you have a job offer from a U.S. employer. Plus, your future employer must prove that they have documented accomplishments themselves and that they employ at least three full-time researchers. This subcategory of EB-1 visas requires an employer to act as a sponsor and submit a petition on the employee’s behalf. The form the employer must file is Form I-140, Petition for Alien Worker.\r\nEB-1C Visa Requirements for Multinational Managers or Executives\r\nMultinational managers or executives can qualify for an EB-1C visa if they meet some requirements. For applicants pursuing an EB-1C visa, establishing a clear connection between the overseas employer and the U.S. entity is crucial. USCIS requires proof of a qualifying corporate relationship, such as a parent, subsidiary, or affiliate structure.\r\n\r\nApplicants should also provide organizational charts, payroll records, and detailed job descriptions that highlight managerial authority and decision-making power. Understanding these EB-1C visa requirements from the outset can prevent delays and reduce the risk of a Request for Evidence (RFE).\r\n\r\nFor this visa, you must,\r\n\r\n \tProve that you were employed as a manager or executive for at least one full year during the preceding three-year period by an overseas company affiliated with the U.S. employer.\r\n \tShow that your job offer in the United States is to be a manager or executive.\r\n\r\nThis subcategory of EB-1 visas requires the employer to act as a petitioning sponsor and must file the Form I-140, Petition for Alien Worker.\r\nApplying for an EB-1 Visa\r\nTo apply for an EB-1 visa, a Form I-140, Petition for Alien Worker, must be submitted to the U.S. Citizenship and Immigration Services. Typically, Form I-140 is filed by the employer, but as noted above, a foreign national of extraordinary accomplishment can file their own Form I-140. That may seem simple enough. After all, Form I-140 is only nine pages long. However, it’s always best to seek guidance from an experienced immigration lawyer before petitioning for any visa, even an EB-1 visa.\r\n\r\nThere are several reasons to have an attorney help you prepare and file Form I-140, including the following:\r\n\r\n \tAlong with the petition, the petitioner must submit an enormous amount of evidence to support the petition. Besides just initial evidence and evidence of achievements, supplemental forms may need to be filed.\r\n \tDenials of EB-1 visas can occur over inconsistent, incorrect, or missing information. Simple mistakes on a petition are grounds for denial.\r\n \tEven an EB-1A visa can get denied over a decades-old criminal conviction. Sometimes, even a lack of vaccination records can throw a wrench in the EB-1 visa approval process. A skilled attorney will know how and when to apply for a Waiver of Inadmissibility for most Grounds of Inadmissibility that might be lurking in the immigrant’s past.\r\n \tForms are constantly changing, and so are fees. Filing a petition with an outdated form or the wrong filing fee can mess up the petition process. Experienced immigration attorneys are used to the unexpected and will greatly increase the chance of your EB-1 visa approval.\r\n\r\nGet The Immigration Help You Deserve\r\n\r\nRequest A Consultation\r\n\r\nEB-1 Visas: Frequently Asked Questions\r\nDoes an EB-1 visa grant you a green card?\r\nNo, but an EB-1 visa is an immigrant visa, which means that once the immigrant is in the United States, provided they meet other requirements, they can immediately apply for a green card. You could be eligible to stay in the United States through other employment-based visas such as the H-1B, L-1, or O-1. You may also be eligible for a green card through investment, marriage to a U.S. citizen or permanent resident, or asylum. The H-1B VisaThe H-1B visa is a nonimmigrant visa that allows U.S. employers to temporarily employ foreign workers in specialty occupations. A specialty occupation is one that requires the theoretical and practical application of a body of highly specialized knowledge in a field of human endeavor including, but not limited to, architecture, engineering, mathematics, physical sciences, social sciences, medicine and health, education, business specialties, accounting, law, theology, and the arts. It can be an alternative to a J-1 visa, and make a J-1 visa waiver unnecessary. The L-1 VisaThe L-1 visa is a nonimmigrant visa that allows foreign workers who have worked for a related company abroad for at least one year to transfer to a related company in the United States. The L-1 visa can also serve as an alternative to a J-1 visa waiver, but only in specific circumstances. The O-1 VisaThe O-1 visa is a nonimmigrant visa that allows foreign workers with extraordinary ability or achievement in their field to live and work in the United States. To qualify for an O-1 visa, you must have a record of extraordinary achievement in your field. This can be shown through awards, scholarships, fellowships, publications, judging the work of others, or original scientific or scholarly research. The O-1 visa can be an alternative to a J-1 visa waiver in specific cases.AsylumIf you are in the United States and fear returning to your home country due to persecution, you may be eligible for asylum. To qualify for asylum, you must show that you have been persecuted or fear persecution in your home country due to your race, religion, nationality, political opinion, or membership in a particular social group. If you are granted asylum, you will be allowed to live and work in the United States indefinitely. You won't need a J-1 visa waiver.Green Cards Through Investment, Marriage or Other RelationshipsYou may also be eligible for a green card through investment, marriage to a U.S. citizen or permanent resident, or other relationships. If any of these apply to you, you won't need a J-1 visa waiver to remain in the United States. Your attorney can help you determine whether you qualify for a green card (or any other program). Why It's Important to Talk to a San Francisco Immigration Attorney Before Applying for a J-1 Visa WaiverBecause you may not need a J-1 visa waiver, such as when you qualify for another type of immigration benefit that allows you to remain in the United States, it makes sense to talk to a San Francisco immigration attorney before you apply. If you’re a citizen of one of these countries, and you meet the eligibility requirements, you can apply for an E visa.\r\n\r\nThere are three different types of E visas: E-1, E-2 and E-3.\r\nE-1 Visas\r\nE-1 visas are for foreign nationals who are coming to the United States to engage in international trade. In order to qualify for an E-1 visa, you must be coming to the United States to engage in substantial trade, which is defined as trade that is international in scope, and that involves frequent transactions, involving continuous flow of goods or services.\r\n\r\n\r\n\r\nAn E-1 visa is available to qualify for Treaty Trader status – they undertake a significant amount of international trade with the United States and constitute over 50% of the trader’s trade. Although there is no minimum amount of trade, the higher the volume of trade the more likely to qualify for an E-1 visa.\r\n\r\nThis nonimmigrant classification allows a national of a treaty country to be admitted to the U.S. solely to engage in international trade on his or her own behalf. Certain employees of such a person or of a qualifying organization may also be eligible for the E-1 classification.\r\n\r\nTo qualify for a professional E-1 Visa, these requirements must be met:\r\n\r\n \tYou must be a national of a country with which the United States maintains a treaty of commerce and navigation.\r\n \tYou must carry on substantial trade.\r\n \tYou must carry on principal trade between the U.S. and the treaty country that qualified the treaty trader for E-1 classification.\r\n \tYour items of trade include but are not limited to:\r\n\r\n \tGoods\r\n \tTransportation\r\n \tServices\r\n \tTourism\r\n \tInternational banking\r\n \tTechnology and its transfer\r\n \tInsurance\r\n \tSome news-gathering activities\r\n\r\n\r\n\r\nTo apply for an E-1 Visa, the Treaty Trader may file Form I-129 to request a change of status to E-1 classification. If the employee is not a Treaty Trader, the employer who is a qualifying Treaty Trader, can file the I-129 on behalf of the employee. Read more.\r\nE-2 Visas\r\nE-2 visas are for foreign nationals who are coming to the United States to invest a substantial amount of money in a U.S. business. In order to qualify for an E-2 visa, you must be coming to the United States to invest a substantial amount of money in a U.S. business – which is defined as an active business, in which you have invested, or are in the process of investing a substantial amount of money.\r\n\r\nThe E-2 visa is similar to an EB-5 visa except the E-2:\r\n\r\n \tIs temporary and needs to be renewed every two to five years, on average\r\n \tMay only require an investment as low as $75,000 depending on the type of business for investment\r\n \tDoes not need to create or save a specific number of jobs\r\n \tInvestor must be actively involved in the invested business\r\n\r\nThis nonimmigrant classification allows a national of a treaty country to be admitted to the U.S. when investing a substantial amount of capital in a U.S. business. Certain employees of such a person or of a qualifying organization may also be eligible for this classification. To qualify for a professional E-2 visa, these requirements must be met:\r\n\r\n \tYou must be a national of a country with which the U.S. maintains a treaty of commerce and navigation.\r\n \tYou must have invested, or be actively in the process of investing, a substantial amount of capital in a bona fide enterprise in the U.S.\r\n \tYou must be seeking to enter the U.S. solely to develop and direct the investment enterprise. This is established by showing at least 50% ownership of the enterprise or possession of operational control through a managerial position or other corporate device.\r\n\r\nA request for an E-2 Visa may not be made on Form I-129 if the person being filed for is physically outside the U.S. Upon issuance of a visa, the person may then apply to a DHS immigration officer at a U.S. port of entry for admission as an E-2 nonimmigrant. Read more.\r\nGet The Immigration Help You Deserve\r\n\r\nRequest A Consultation\r\n\r\nE-3 Visas\r\nE-3 visas are for Australian Citizens who are coming to the United States to work in a specialty occupation. In order to qualify for an E-3 visa, you must be an Australian citizen, have a job offer from a U.S. employer, and you must be coming to the United States to work in a specialty occupation – which is defined as a profession that requires at least a bachelor’s degree (or its equivalent) for entry into the occupation.\r\n\r\n\r\nWhat About Employees of Treaty Traders and Treaty Investors on E-1 and E-2 Visas?\r\nYou may qualify for E-1 or E-2 visa classification if you’re the same nationality of your main alien employer, you meet the definition of an employee, and your duties are executive or supervisory. If you’re not an executive or supervisor, you must have special qualifications. Your immigration attorney can give you further guidance.\r\nWhat Are the Benefits of an E Visa?\r\nThere are many benefits of having an E visa. Some of these benefits include:\r\n\r\n \tThe ability to live and work in the United States on a temporary basis\r\n \tThe ability to bring your spouse and children to the United States with you\r\n \tThe ability to travel in and out of the United States freely\r\n\r\nWho’s Eligible for an E Visa?\r\nTo be eligible for an E visa, you must be a citizen of a country with which the United States has a trade agreement. Several countries currently have trade treaties with the U.S., and you can see the full list here or consult with your attorney about the most current agreements.\r\n\r\nIn order to qualify for an E visa, you must also be coming to the United States to engage in a qualifying activity – which is defined as trade (E-1 visa), investment (E-2 visa), or work in a specialty occupation (E-3 visa).\r\nGet The Immigration Help You Deserve\r\n\r\nRequest A Consultation\r\n\r\nHow Do You Get an E Visa?\r\nIf you meet the eligibility requirements, you or your employer can apply for an E visa by filing a petition with U.S. Citizenship and Immigration Services.\r\nDocumentation Requirements for an E Visa\r\nWhen you file your petition with USCIS, you must include the following documentation:\r\n\r\n \tA completed application form: Form I-129, Petition for a Nonimmigrant Worker\r\n \tA passport photo\r\n \tProof of citizenship, such as a copy of your passport\r\n \tProof of your qualifying activity, such as evidence of your employment contract or offer letter, or evidence of your investment\r\n \tAn application fee\r\n\r\nCan You Family Come With You on an E Visa?\r\nIf you have an E-1, E-2, or E-3 visa, your spouse and unmarried children under the age of 21 can come with you to the United States on derivative visas (E-1D, E-2D, and E-3D visas). Your family members will be allowed to stay in the United States as long as you maintain your status, and as long as they meet all relevant requirements.\r\nHow Long Does an E Visa Last?\r\nAn E visa is valid for up to two years, and it can be renewed indefinitely as long as you maintain your status and meet all eligibility requirements.\r\nWhat Happens When Your E Visa Expires?\r\nIf your E visa expires, you will have to leave the United States. If you want to stay in the United States longer than your E visa allows, you will need to apply for a different type of visa.\r\nWhat Other Visas Are Available to Temporary Workers?\r\nThere are several other types of visas that may be available to temporary workers, depending on their qualifications and the nature of their work.
