What does innocent spouse relief mean? Both spouses are generally held responsible for all the tax due even if one spouse earned all the income or claimed improper deductions or credits. With an “Innocent Spouse Relief,” a spouse can get relief from additional tax you owe if your spouse or former spouse failed to report income, reported income improperly or claimed improper deductions or credits. Many married taxpayers choose to file a joint tax return because of certain benefits this filing status allows them. When filing jointly, both taxpayers are jointly and severally liable for the tax and any additions to tax, interest, or penalties that arise from the joint return even if they later divorce. Joint and several liability means that each taxpayer is legally responsible for the entire liability. Thus, both spouses on a married filing jointly return are generally held responsible for all the tax due even if one spouse earned all the income or claimed improper deductions or credits. This is also true even if a divorce decree states that a former spouse will be responsible for any amounts due on previously filed joint returns. In some cases, however, a spouse can get relief from being jointly and severally liable. INNOCENT SPOUSE RELIEF You must meet all requirements in order to qualify for Innocent Spouse. What are the types of relief available? You must request innocent spouse relief or separation of liability relief no later than 2 years after the date the IRS first attempted to collect the tax from you. We can help obtain an “Innocent Spouse Relief” and we will determine if you qualify for the relief. There are three types of relief from the joint and several liability of a joint return: Innocent Spouse Relief provides you relief from additional tax you owe if your spouse or former spouse failed to report income, reported income improperly or claimed improper deductions or credits. Separation of Liability Relief provides for the separate allocation of additional tax owed between you and your former spouse or your current spouse you’re legally separated from or not living with, when an item wasn’t reported properly on a joint return. You’re then responsible for the amount of tax allocated to you. Equitable Relief may apply when you don’t qualify for innocent spouse relief or separation of liability relief for something not reported properly on a joint return and generally attributable to your spouse. You may also qualify for equitable relief if the amount of tax reported is correct on your joint return but the tax wasn’t paid with the return. What are the requirements? Innocent Spouse Relief You must meet all of the following conditions to qualify for innocent spouse relief: You filed a joint return that has an understatement of tax (deficiency) that’s solely attributable to your spouse’s erroneous item. An erroneous item includes income received by your spouse but omitted from the joint return. Deductions, credits, and property basis are also erroneous items if they’re incorrectly reported on the joint return. You establish that at the time you signed the joint return you didn’t know, and had no reason to know, that there was an understatement of tax. Taking into account all the facts and circumstances, it would be unfair to hold you liable for the understatement of tax. Separation of Liability Relief To qualify for separation of liability relief, you must have filed a joint return and must meet one of the following requirements at the time you request relief: You’re divorced or legally separated from the spouse with whom you filed the joint return. You’re widowed. You haven’t been a member of the same household as the spouse with whom you filed the joint return at any time during the 12-month period ending on the date you request relief. Equitable Relief If you don’t qualify for innocent spouse relief or separation of liability relief, you may still qualify for equitable relief. To qualify for equitable relief, you must establish that under all the facts and circumstances, it would be unfair to hold you liable for the understatement or underpayment of tax. What is an Offer in Compromise? An offer in compromise is an agreement between a taxpayer and the IRS that settles the taxpayer’s tax liabilities for less than the full amount owed. Absent special circumstances, an offer will not be accepted if the IRS believes that the liability can be paid in full as a lump sum or through a payment agreement. In most cases, the IRS will not accept an OIC unless the amount offered by the taxpayer is equal to or greater than the Reasonable Collection Potential (RCP). The RCP is how the IRS measures the taxpayer’s ability to pay and includes the value that can be realized from the taxpayer’s assets, such as real property, automobiles, bank accounts, and other property. The RCP also includes anticipated future income, less certain amounts allowed for basic living expenses. We will work with you to present your financial information in the best possible light, and to thus increase the chance of successfully compromising your tax owed. OIC PROGRAM Let us settle your tax owed for a lesser amount. What should you do to qualify for an Offer in Compromise? It is very important for you to hire ethical tax professional to assist you with your tax matters. Not everyone qualifies for an Offer in Compromise, as each person’s financial situation is different. Pre-qualifying for an Offer in Compromise is an important step to take prior to attempting an Offer in Compromise with the IRS. The Internal Revenue Service issued a consumer alert advising taxpayers to beware of promoters’ claims that tax owed can be settled for “pennies on the dollar” through the Offer in Compromise Program. What does Currently Not Collectible mean? Currently not collectible is the status which the IRS places on people who are unable to pay their tax owed. Currently not collectible (CNC) status means that your tax payments are postponed for a later time otherwise known as a deferred payment. Each year, taxpayers are required to file a return and some may owe taxes. If you are unable to pay your taxes owed, you may set up a payment plan with the IRS, also known as an “ Installment Agreement ” or you may qualify for an “ Offer in Compromise .” What about those who can’t afford to pay? If you are unable to pay your taxes, you may apply for the CNC status. With a CNC status, your tax payments are deferred until your situation improves. UNABLE TO PAY? Qualifying for CNC status means proving your financial status. How to qualify for Currently Not Collectible status? Talk to a tax professional to properly prepare your financial statement. The IRS may require you to file a financial statement (called a Form 433) and may also require you prove your monthly income with paystubs, bank deposits, and monthly living expenses (with receipts). In order to qualify for a CNC status, you must prove that you are unable to pay. That means you will need to document your financial situation. The IRS will look into your bank accounts to see if you have the means to pay the tax. If you do not have any assets, the IRS will require that you document your average monthly income and necessary living expenses. Their objective is to see if you are able to pay with an “ Installment Agreement .” Currently Not Collectible status protects a taxpayer from the enforced collection efforts of the IRS, by removing the taxpayer’s back tax account from active collection status. The IRS has requirements that an account must meet before it can be placed in a Currently Not Collectible status. Once the account is placed in a Currently Not Collectible status, the IRS does not pursue collection activity against the taxpayer and the statute of limitations on the tax liabilities will continue to run. Unless the taxpayer’s financial situation changes, the account will remain in a Currently Not Collectible status until the tax liabilities expire. What is a bank levy? If you have failed to pay your taxes with the IRS, they can seize your finances and assets. The process of releasing your frozen bank accounts from the IRS is a “bank levy release.” A bank levy is issued by the IRS when your taxes remain unpaid and a resolution has not be reached. The IRS will freeze your bank accounts and seize any money in your bank account up to the amount that is owed including penalties and interest. The IRS can issue a bank levy as many times as needed until the tax owed is paid. The IRS is very determined in collecting your tax owed and will come after your wages and property as well. During an IRS bank levy, once the bank freezes your account, you have to make arrangements within 21 days. If you have failed to comply, the bank will send the funds to the IRS the day after. FROZEN BANK ACCOUNTS Obtain a California bank levy release to resolve the liability. How to release a bank levy? Talk to a tax professional and get help immediately. Do not wait until the last day to seek out a bank levy release as the process can take a few days. If your bank accounts has been frozen by the IRS, it is recommended to seek advice from a tax professional who can provide the available options for your situation. Here are some methods to resolving your IRS bank levy: Request a CDP hearing Pay in Full Enter an “ Installment Agreement “ Prove financial hardship Dealing with the IRS can be an overwhelming task and convincing them to release a bank levy is difficult and is dependent upon the facts and your circumstances. If you continue to wait, the IRS may consider placing a “ Wage Garnishment ” on your pay until the tax owed is completed. What is an IRS Installment Agreement? To help people pay off any tax owed, the IRS offers various payment arrangements or payment plans that are subject to certain rules. An “Installment Agreement” are one of the various payment plans available from the IRS. An Installment Agreement with the IRS allows taxpayers to pay their back taxes to the IRS through monthly payments. This is a viable option for taxpayers who cannot afford to immediately pay their tax liability in full. It’s important that you understand all your options, and you might need help negotiating the best possible monthly payment with the IRS. What is a wage garnishment? The IRS is permitted to garnish your wages and bank accounts until the amount you owe has been fully paid. Losing your wages, or having your bank account cleared out, presents a hardship to you that requires immediate resolution. If you owe the IRS for back taxes, the agency has the authority to levy or seize your property. A specific type of levy is the garnishment of your employment wages each week. However, before the IRS starts to take a portion of your salary, there are specific guidelines it must follow. Understanding the IRS garnishment rules may help you prepare for the garnishment or even allow you to challenge and stop it. Once the IRS assesses your tax, you will generally receive notice and a Demand for Payment of the amount due. If you fail to pay this invoice, at some point after you will receive a Final Notice of Intent to Levy and a Notice of Your Right to a Hearing. These last two documents must be sent at least 30 days before the IRS begins to garnish your wages. Before it reaches this point, you should contact the IRS and attempt to resolve the issue, possibly by submitting a request to get on a payment plan. PREVENT FINANCIAL HARDSHIP Don’t lose your wage or have your bank account cleared. How much can the IRS garnish? Talk to a tax professional to release your wage garnishment immediately. We conduct negotiations to release wage garnishments for our clients. In most cases, we can successfully get a wage garnishment released before your next paycheck is issued. When the IRS moves forward with your wage garnishment, your employer has no choice but to comply with the IRS and remit a portion of your wages to the agency to pay your tax bill. The IRS has more garnishment power than ordinary creditors insofar as it is not subject to the state and federal garnishment limitations, which means it can leave you with very little money each week to live on. During 2018 for example, a single parent with two children who files as head of household can be left with as little as $425.96 per week. This means that if you earn $1,000 per week, the IRS takes $574.04 of it, and if you earn $2,000 per week, it can take $1,574.04. However, the amount of your garnishment will depend on how much tax you owe. Understanding the IRS Payroll Tax Collections Failing to timely pay over payroll taxes can result in significant penalties and interest, sometimes in excess of the initial tax that wasn’t paid. The government may be able to pursue the business owner personally for the business’s unpaid payroll tax liabilities. The Internal Revenue Code gives the IRS broad powers with regard to unpaid payroll tax liabilities. As a result, the IRS is particularly aggressive in pursuing businesses for unpaid payroll taxes. The government may be able to pursue the business owner personally for the business’s unpaid payroll tax liabilities. This is done by assessing the “trust fund recovery penalty” against a “responsible party”. Trust fund taxes are the income and social security taxes an employer withholds from the wages of employees. Although corporate officers, directors, stockholders and employees are normally protected from personal liability for the tax owed of their corporations, the IRS can assess personal liability against the so-called “responsible persons”. PAYROLL TAX COLLECTIONS IRS Payroll taxes often create the biggest problems for small business owners. What are payroll taxes for employers? Payroll taxes are defined as the income taxes, Social Security, and Medicare taxes that are withheld from the wages of its employees. These are also commonly referred to as “Trust Fund” taxes because the employer is supposed to hold these funds in trust before turning them over to the IRS. Employers face stringent obligations when it comes to their employees and their payroll tax obligations. Employers must make quarterly tax deposits to the IRS and complete a series of quarterly and annual filings to account for all payroll taxes withheld and deposited from the employers trust. Understanding Payroll Tax Liabilities Failure to properly account for a company’s payroll tax obligations or failure to properly deposit them with the IRS is considered a serious violation by the Service. IRS enforcement efforts have steadily increased over the past several years with respect to those who violate the payroll tax laws. In some cases, the IRS has even started prosecuting people through its Criminal Investigations Division for failure to meet their payroll tax requirements (payroll tax evasion). Too often we have seen business owners having cash flow issues fail to meet their payroll tax obligations, which can lead to disastrous consequences for the business.Utilizing IRS payroll tax deposits for other business expenses often creates a snowball effect and causes serious problems for the client business. The IRS is much less lenient with paying back payroll tax obligations than with other types of liabilities. In addition, because businesses are usually fruitful sources of assets that the Service can go after (and going businesses are usually generating positive cash flow), IRS revenue officers have been known to be particularly aggressive when it comes to dealing with outstanding payroll tax liabilities. What is a tax lien? If you owe back taxes, the IRS gains a tax lien on all your assets. The tax lien attaches to all property and rights to property (real or personal, tangible or intangible), title and interest of the taxpayer. Once the IRS has a tax lien on all of a taxpayer’s assets, they may enforce that tax lien by administratively levying your assets. A tax lien is filed by the IRS to protect government’s interests.
