Unfortunately, we’re not working quickly enough. We have emergencies on top of emergencies right now,” said BBID General Manager Ed Pattison. The Wicklund Cut Pump Station, built in 1918, plays a crucial role in pumping water from nearby canals to sustain agricultural operations. However, many of its pumps, aged over 100 years, are no longer repairable because parts are obsolete. The pump failures are exacerbated by the breakdown of the facility’s primary power source, forcing operations to rely on diesel generators. “We’re operating on diesel backup generators. This is not a normal operation,” Pattison said. On Friday, the Court of Appeal for the Sixth Appellate District (Sixth District Court) ruled that a coalition of California irrigation districts and water agencies (Districts) are entitled to recover their attorneys’ fees incurred during the Santa Clara County Superior Court litigation regarding the State Board’s actions in 2015, when it unlawfully issued curtailment notices under Water Code section 1052 to more than a thousand pre-1914 water right holders, including BBID. The Sixth District Court’s ruling reversed an earlier decision by the trial Court, which denied Districts’ motion for recovering of their attorneys’ fees. “It has been a long road,” said interim BBID General Manager Ed Pattison. “The District is grateful the Sixth District Court recognized BBID’s right to recover a substantial portion of the expenses it shouldered defending our pre-1914 water rights, which are both the foundation for the communities we serve and the crops grown in our service areas.” The Sixth District Court’s decision recognizes that the Districts incurred the bulk of their attorneys’ fees after the threat of fines or penalties ceased. The Sixth District Court concluded: “The Districts bore millions of dollars in attorney fees but realized no direct pecuniary gain as a result of their victory on due process and jurisdictional grounds.” The Sixth District Court determined that “the trial court abused its discretion”, directing the trial court “to award the Districts under section 1021.5 the attorney fees that they incurred for the court litigation.” November 23, 2022 in Legislative & Legal Affairs Court of Appeal: State Water Board Exceeded Authority with 2015 Curtailments Santa Clara County (September 13, 2022) – On Monday, in a decision certified for publication, the Court of Appeal for the Sixth Appellate District holds that the State Water Resources Control Board (SWRCB or State Board) exceeded its enforcement authority when issuing curtailment notices in 2015 to certain pre-1914 water right holders, including the Byron-Bethany Irrigation District (BBID). In its ruling, the court finds that Water Code Section 1052(a) does not provide the State Board authority to “curtail an entire class of pre-1914 appropriative water rights solely on the basis that the Board believes that there will be insufficient water to serve all pre-1914 appropriative rights.” The ruling continues, “For these reasons, we agree with the trial court’s conclusion that the Board lacked authority under section 1052(a) to issue the 2015 curtailment notices to respondents.” The case is related to a 2015 enforcement action commenced by the SWRCB against BBID shortly after BBID sued the SWRCB over unlawful curtailment notices issued by the SWRCB to more than a thousand pre-1914 water rights holders, including BBID. Over BBID’s objection, the Santa Clara Court stayed BBID’s lawsuit pending completion of the administrative hearing of the SWRCB’s enforcement action. The SWRCB’s enforcement action sought enforcement of the curtailment notices against BBID for diverting water when allegedly none was available under its priority of right, and the SWRCB sought a $5 million fine. On the third day of the administrative hearing before the SWRCB Hearing Team, BBID’s legal team successfully argued that the evidence submitted by the SWRCB Prosecution Team failed to meet its burden of proof, and the SWRCB Hearing Team granted BBID’s motion for judgment dismissing the enforcement action. After the dismissal of the enforcement action, BBID resumed the related lawsuit, and on April 3, 2018, Santa Clara Superior Court Judge Brian Walsh issued his Statement of Decision holding, among other things, that the SWRCB lacks jurisdiction under Water Code §1052 to take enforcement action against pre-1914 water right holders based on a general lack of available water under their priority of right. Judge Walsh also held that the curtailment notices violated BBID’s due process rights because they commanded immediate curtailment of water rights and threatened large fines without providing water right holders an opportunity to challenge the findings upon prior to enforcement. “This ruling helps safeguard senior water rights in California,” said acting BBID General Manager Kelley Geyer. “It confirms that the authority of the State Water Resources Control Board is limited to that which the Legislature granted it, nothing more. Senior water rights are the foundations of urban and rural communities throughout the state,” Geyer continued. “They are also the backbone of reliable agricultural water deliveries that support cultivating our food supply – in California, the nation, and the world. Byron-Bethany Irrigation District believes protecting its pre-1914 senior water right on behalf of the multi-generational family growers and ranchers we serve is its primary responsibility, as well as providing the community of Mountain House with its principal water supply.” September 14, 2022 in Legislative & Legal Affairs BBID Argues Court of Appeals Should Uphold Landmark Water Rights Decision In the CA 6th District Court of Appeal, the Byron-Bethany Irrigation District (BBID) is urging the court to uphold a landmark decision solidifying the oldest water rights in California. Attorneys on behalf of BBID responded to an appeal filed by the State Water Resources Control Board, saying in part: The Legislature never provided the State Board with the authority it now seeks from this Court. That is, the Legislature did not authorize the State Board to use trespass under Section 1052 as a means to preclude (i.e., curtail) Senior Right holders from diverting water within the scope of their rights, regardless of times of water shortage or surplus. To the contrary, the Legislature has been careful not to extend the right to regulate Senior Rights to the State Board, consistent with the fact that Senior Rights pre- date the State Board’s existence and authority. In addition, no court has interpreted the State Board’s other statutory authority to allow for such curtailment. Through this appeal, though, the State Board asks this Court to legislate from the bench, expanding its authority to curtail Senior Right holders in a manner that the Legislature has repeatedly not granted through the various amendments to Section 1052. The trial court accurately concluded that the State Board did not have authority to curtail Respondents’ diversions of water under their valid Senior Rights, and this Court should affirm the trial court’s judgments regarding the State Board’s jurisdiction under Section 1052. SGMA, which became state law in 2014, directs local agencies to work together to develop local Groundwater Sustainability Plans (GSP) in basins and sub-basins classified by the state as medium or high priority. BBID Becomes a Groundwater Sustainability Agency (GSA) Following a public hearing in March 2017, Byron-Bethany Irrigation District’s Board of Directors voted unanimously to become a groundwater sustainability agency (GSA) for a portion of the Tracy Subbasin, which underlies the District’s service area in portions of Contra Costa, San Joaquin and Alameda Counties. The Tracy Subbasin had been classified as medium priority by the California Department of Water Resources (DWR). The Tracy Subbasin was divided into the East Contra Costa Subbasin, and the Tracy Subbasin. BBID is a GSA in both subbasins. The Sustainable Groundwater Management Act (SGMA) , signed into law by Governor Jerry Brown, is a combination of three legislative bills, Senate Bill SB 1168 (Pavley) , Assembly Bill AB 1739 (Dickinson) , and Senate Bill SB 1319 (Pavley) . It provides a framework for the sustainable management of California’s groundwater. Key SGMA Milestones Under SGMA regulations, GSA formation was required no later than June 30 th , 2017. Groundwater sustainability plans for the Tracy Subbasin must be completed by January of 2022. GSAs will have until 2040 to achieve groundwater sustainability. What goes into a Groundwater Sustainability Plan (GSP)? Development and implementation of a GSP falls into four main phases: Phase 1: GSA Formation Phase 2: GSP Preparation and Submission Phase 3: GSP Review and Evaluation Phase 4: Implementation and Reporting What Groundwater Sustainability Agencies Have Been Established? What’s Next for BBID As part of the resolution approved by the BBID Board, the District intends to develop groundwater sustainability plans for portions of the Tracy Subbasin and East Contra Costa Subbasin within District boundaries in San Joaquin and Contra Costa Counties, and both within and outside BBID’s boundaries in Alameda County. The Board voted to enter a memorandum of understanding (MOU) to work with multiple agencies within Contra Costa County. In San Joaquin County, the District expects to collaborate with the City of Tracy to resolve overlaps in proposed GSA service areas. In Alameda County, the District plans to pursue an agreement with Zone 7 Water Agency, in which Zone 7 would formally delegate to BBID its authority to manage groundwater within Zone 7’s service area. Update: As of April 2020, BBID joined neighboring agencies in signing a Memorandum of Understanding (MOU) to develop a Groundwater Sustainability Plan for the East Contra Costa Subbasin. Read it here. Tracy Subbasin Boundary Modification BBID is part of a coalition of eight local water agencies that worked together to modify the boundary of the Tracy Subbasin along county lines. This will ensure that water users in Tracy and San Joaquin counties won’t exercise undue influence on how groundwater is managed in East Contra Costa County. Thanks to the support of at least 75% of the local agencies and water systems in Contra Costa and San Joaquin Counties, the request to subdivide the Tracy Subbasin along the Contra Costa and San Joaquin County line was approved by the California Department of Water Resources. Your Water Service & Water Rates BBID charges a uniform rate per acre-foot for agricultural water delivery. This rate structure is compliant with the Water Conservation Act of 2009, SBX 7-7. The previous rate, $20 per acre foot, had been in place for more than two decades. However, due to a sudden and significant drop in property tax revenues and unforeseen increases in expenditures – driven by the cost associated with protecting your water rights, and the need to secure additional water supplies – the District hired an independent rate consultant to conduct a comprehensive cost of service study. The result of that independent analysis suggests BBID must increase its uniform, per acre-foot rate to continue providing reliable water deliveries and maintain financial stability. Why Were Rate Increases Needed? A Drop In Property Tax Revenue While the District’s expenditures rose, its non-rate revenue dropped considerably after Contra Costa County’s move to detach portions of the town of Discovery Bay from the BBID service area. That area has generated about $685,000 annually in property tax revenue for the District. The District lost half the revenue in 2016, and the full amount in 2017. A Legal Fight For Your Water Rights The ongoing battle with the State Water Resources Control Board to protect the District’s pre-1914 water right — the very foundation for your water deliveries — has substantial ongoing expenses. The litigation with the SWRCB is a critically necessary expense to ensure water reliability for our customers, now and in the future. The Five-Year Rate Plan Our independent rate analysis indicated the largest rate increase was necessary in year one, to cover water right expenditures and the cost of securing additional water supplies. Proposed rates drop from 2016 to 2017, with marginal increases phased in from 2017 through 2020. How Are My Rates Calculated? To calculate the new rates, the independent rate consultant added operating expenses, debt service and pay-as-you-go capital to be financed by rates, and then subtracted non-rate revenue. The District’s non-rate revenue typically more than covers its fixed costs like Capital Improvement Projects, debt service, and general and administrative costs. Non-rate revenue includes water transfers, property taxes and other miscellaneous revenues. The remaining revenue is recovered with a volumetric charge on a per acre-foot basis. Did You Know? As a public agency, BBID cannot earn a profit from the services it provides, and must charge no more than the actual costs associated with providing services to its customers. Proposition 218 Presentation As part of the Proposition 218 process, CH2M Hill, BBID’s engineering firm, delivered a presentation to the BBID Board and general public, outlining the District’s revenues and expenditures. Cost of Service Study CH2M Hill also completed a comprehensive Cost of Service study.
