A/B Split Trusts (Marital Trusts) For married couples (especially those with larger estates) an AB trust can be used to reduce estate taxes and preserve wealth for children from prior relationships. How it works: When the first spouse passes away, the trust “splits” into two parts: Trust A (Survivor’s Trust) and Trust B (Bypass or Decedent’s Trust). The B Trust captures the deceased spouse’s federal estate tax exemption. The surviving spouse retains control of their half, while the decedent’s portion is preserved for the next generation. While fewer families owe federal estate tax today due to higher exemption limits, an AB trust may still be an essential planning tool for certain clients who want to maintain control over their half upon their death. Must include a Medi-Cal payback provision. *Please note that Cookman Law does not handle First Party SNTs from settlements, though we are happy to refer you to trusted professionals who do. Third-Party SNTs: Funded by parents, grandparents, or others. Can hold gifts or inheritances and do not require payback to the state. Pooled SNTs: Managed by nonprofit organizations. Why ABLE Accounts Matter Many people with disabilities rely on programs like SSI and Medi-Cal, which have strict asset limits – SSI’s asset limit is $2,000 and Medi-Cal’s asset limit is currently $130,000 in California. ABLE accounts allow individuals to save beyond this limit while maintaining eligibility. Key benefits include: Using funds for a wide range of qualified disability expenses Avoiding ISM reductions (In-Kind Support and Maintenance) when paying for shelter expenses Tax-free growth when used for eligible expenses Easy access via online banking and a debit card Low annual fees and accessible minimum contributions SSI, ISM, and Preserving Benefits One of the most powerful uses of an ABLE account is avoiding reductions in SSI benefits due to In-Kind Support and Maintenance (ISM). Here’s how it works: If a trust or family member pays directly for a person’s food or shelter, the SSI benefit may be reduced by about $350/month . But if that same money is first deposited into an ABLE account , and the account holder then uses the funds to pay for their own shelter expenses, it doesn’t count as ISM and the full SSI benefit is preserved. In short: ABLE accounts can be a strategic tool for maintaining SSI benefits while paying for basic living costs. Real-Life Example “Nina has had an ABLE account for several years now. We’ve used it to receive stimulus funds and larger family gifts. With the balance growing, we’ve split the funds between investments and banking. While we don’t offer free consultations, we do apply a flat fee model for most services. After your initial meeting, we’ll provide a clear, all-inclusive flat fee for your estate plan or trust administration needs. What are your fees and how does payment work? Once we agree on the scope of work, we collect the full flat fee upfront. Payment is held in our IOLTA trust account (monitored by the California State Bar) until your draft documents are ready for review. We accept both checks and credit cards. How long does it take to complete an estate plan or trust administration? – Estate Planning : Typically completed within 2 months , depending on how quickly decisions are made. – Trust Administration : Often takes 4–6 months , depending on complexity. – Conservatorships (when referred out): Time varies depending on the court. Do you serve as Trustee or Executor? No, we do not act as trustee or executor. However, we regularly advise trustees and executors , especially during trust administration after a death. Do you help with applications for public benefits like SSI or Medi-Cal? No, we don’t assist with benefit applications. However, we can refer you to experienced professionals who specialize in this area. A Revocable Living Trust is the cornerstone of most California estate plans. It: Avoids probate Can be changed during your lifetime Lets you manage your own assets while you’re alive and well Allows a successor trustee to step in if you become incapacitated It’s also simple: no separate tax ID is needed, and no additional tax filings are required while you’re living. What is a Special Needs Trust (SNT)? An SNT is an irrevocable trust created for a person with a disability who receives (or may receive) needs-based public benefits like SSI or Medi-Cal. A properly structured SNT: Preserves benefit eligibility Allows funds to be used for quality-of-life expenses Can be created while the parent is alive or at death We also help families set up “seed trusts” (funded with a small amount like $10) so they’re ready to receive funds later. What is a Lifetime or Dynasty Trust? A Dynasty Trust (also known as a Lifetime Trust or Generation-Skipping Trust ) is a protective irrevocable trust created for a loved one, often after your death. It offers: Divorce protection (trust assets aren’t part of the beneficiary’s marital estate) Creditor protection (especially if a third party is trustee) Estate tax protection for future generations Special Needs Planning & Public Benefits Because we’re one of the few firms in California that specialize in special needs planning, we often get questions. Here are the answers you’re looking for! How much of your practice focuses on special needs planning? About half of our estate planning clients are families with a loved one who has special needs. Can a person with disabilities inherit money? Yes, but the inheritance must be carefully structured. Inheriting money outright can disqualify someone from SSI or Medi-Cal. A First-Party SNT can be used to hold the inheritance and preserve benefits. We can help navigate this process. What if a person with disabilities receives a sudden inheritance or settlement? But in California, a will alone is often not enough to avoid probate or protect your loved ones. That’s why many estate plans include a “pour-over” will that works in tandem with a revocable living trust. At Cookman Law, we help clients understand what a will can (and cannot) do as well as how to integrate it effectively into a comprehensive estate plan. A will is a legal document that outlines your wishes for how your assets should be distributed after your death. It also allows you to nominate a guardian for your minor children and appoint someone (an executor) to carry out your instructions. In California, if you only have a will (and no trust) your estate will typically go through probate , a public court process that can take 9 to 18 months or longer and involve significant court and attorney’s fees. The Role of a Pour-Over Will in a Trust-Based Plan Most of our clients in California use what’s called a pour-over will as part of a trust-centered estate plan. Here’s how it works: Your revocable living trust holds most of your assets during your lifetime. Your pour-over will serves as a backup – it “pours” any remaining assets into your trust at death. It also allows you to nominate guardians for your minor children and specify your funeral or burial wishes , if desired. This type of will ensures that any assets not formally transferred into your trust during your lifetime still end up being distributed according to your wishes. What a Will Can Do Appoint a guardian for your minor children Name an executor to manage your estate Direct how assets outside your trust (if any) should be distributed Serve as a legal safety net for any assets not titled in your trust What a Will Cannot Do Avoid Probate: A standalone will must be submitted to the probate court. Control Trust Assets: A will cannot override or manage assets already held in a trust or directed by beneficiary designation. Provide Long-Term Asset Management: Wills don’t include provisions for holding and managing assets over time – for that, you need a trust . Is a Will Enough in California? For most people in California, the answer is no . A will-only estate plan exposes your estate to probate, which is often time-consuming, expensive, and public . That’s why we typically recommend a trust-based plan , with a pour-over will included as a companion document. However, there are some situations where a standalone will may be appropriate, such as: Very small estates below the probate threshold Temporary planning before a trust is created As a legal safety net if a trust isn’t fully funded The estate only contains assets that pass by beneficiary designations, such as retirement accounts and life insurance If you’re not sure what’s right for your situation, we’re here to help you evaluate your options. A Special Needs Trust is a legal tool that holds assets for the benefit of a person with disabilities, without those assets counting against strict income and resource limits for benefits like: Supplemental Security Income (SSI) In-Home Supportive Services (IHSS) Medi-Cal Section 8 Housing The trust is managed by a trustee who uses the funds to support the beneficiary in ways that enhance (but don’t replace) public benefits . This includes things like therapies, housing, personal care, education, recreation, travel, and more. Types of Special Needs Trusts We help families determine the best type of SNT for their situation: 1. First-Party Special Needs Trust Also called a self-settled or (d)(4)(A) trust , this is funded with the beneficiary’s own money , such as: An inheritance received outright Accumulated savings before onset of disability Litigation settlement Key features: Must be funded before the beneficiary turns 65 Must include a Medi-Cal payback clause Keeps the beneficiary eligible for needs-based public programs *Please note that our office does not handle First-Party Special Needs Trusts for settlements, but we are happy to refer you to professionals who do. 2. Third-Party Special Needs Trust This trust is created and funded by someone other than the beneficiary – usually parents, grandparents, or other relatives. Key features: Can be included in a revocable living trust or as a standalone trust No Medi-Cal payback required Ideal for planned inheritances, gifts, or life insurance policies We often integrate third-party SNTs directly into our clients’ overall estate plans, ensuring seamless estate planning and benefits protection. 3. Pooled Special Needs Trust Managed by nonprofit organizations, pooled trusts combine assets from many beneficiaries for investment purposes, while keeping individual accounts. Best for: Families without a suitable trustee Beneficiaries with smaller inheritances or settlements Situations where professional trust management is preferred Although we do not handle Pooled Trusts, we can help you assess your options and refer you to reputable organizations when appropriate. Planning for Mild or Uncertain Disabilities Not all disabilities are clear-cut, and not all children with IEPs or diagnoses will need lifelong benefits or support. That’s why we offer flexible planning strategies for families in this gray area. One approach is using a “toggle clause” in your revocable trust. This allows a family member to direct a child’s share of inheritance into a Special Needs Trust only if they qualify for SSI or Medi-Cal at the time of distribution. If not, the assets pass directly to the child or to a different protective trust such as a dynasty trust. This approach offers: Flexibility as your child’s needs evolve Protection if their condition progresses Preservation of options without unnecessary restrictions Contact our team today Why Wealthy Families May Still Need an SNT You might assume that if your family has substantial assets, a Special Needs Trust isn’t necessary. But even high-net-worth families may benefit from creating one. Why? Because eligibility for key public services such as supported housing, day programs, and other governmental services often requires enrollment in SSI or Medi-Cal , regardless of personal wealth. An SNT allows your loved one to access both private resources and public programs , expanding their opportunities and reducing long-term costs. What Can an Special Needs Trust Pay For? Special needs planning is a specialized area of estate planning designed to ensure that individuals with disabilities are cared for throughout their lives without jeopardizing their access to housing or vital public benefits like Supplemental Security Income (SSI) or Medi-Cal. Ellen Cookman started the firm in 2015, to provide broad estate planning services in the California Bay Area with a subfocus in special needs planning. Many families need “parenting when you’re gone,” and we help them put together a team of professionals and family members to provide additional financial and care management and support. We also offer trust administration services upon a loved one’s death. At Cookman Law, a typical estate plan takes about 2 months from start to finish. We generally charge a flat fee for all practice areas. We’ve found that our clients prefer the certainty of knowing up-front what they’ll be paying, and this also encourages clients to contact us with questions without worrying about being “on the clock.” Ellen Cookman Owner/Principal Attorney Ellen Cookman started Cookman Law in 2015 to help families of all shapes and sizes plan for the future and utilize available resources. Ellen is a Certified Specialist in Estate Planning, Trust & Probate Law from the California State Bar Board of Legal Specialization. She received her J.D. from UC Berkeley School of Law and her LL.M. in Estate Planning, Trust and Probate from Golden Gate University. Ellen lives in East Palo Alto with her husband, two middle school boys (her older son has high-functioning autism), a husky mix named Rosie, and a kitty named Skittles. Diana Quigley, Senior Attorney Diana is an estate planning attorney who provides compassionate guidance to help families with diverse needs plan for a secure future. She combines legal expertise with clear advice to create thoughtful plans that reflect her clients’ values and provide peace of mind. Diana earned her J.D. from the University of Southern California School of Law, her LL.M. in Estate Planning, Trust and Probate from Golden Gate University and her B.A. in Communications and Accounting from UCLA. Megan Orsini, Lead Paralegal Megan comes to Cookman Law with nearly fifteen years of experience as a legal assistant, including ten years in Trusts and Estates. Trust administration is the legal and financial process of managing and distributing the assets of a revocable living trust after the death of the person who created it (also called the grantor or settlor ). A properly funded trust allows you to avoid probate, but it doesn’t operate automatically . After the settlor’s death, the named successor trustee is legally responsible for taking a series of steps under California law to: Notify beneficiaries and government agencies Manage, value, and protect trust assets Pay outstanding debts and taxes Distribute assets to beneficiaries This is known as post-death trust administration – and doing it correctly is essential to avoid legal, tax, and family complications. What Does a Trustee Need to Do? The duties of a successor trustee may include: Legal Notices & Compliance – Notify beneficiaries and heirs under California Probate Code §16061.7 – Notify the California Department of Health Care Services (Medi-Cal) – File notices with the county assessor’s office for real estate Obtain a Tax ID Number – Apply for a new EIN (Employer Identification Number) if the trust has become irrevocable Marshal and Value Assets – Identify and gather trust assets (“marshal the estate”) – Obtain date-of-death values for bank accounts, investments, and real property – Order professional appraisals if necessary Pay Debts and Expenses – Locate and pay valid creditor claims – Pay funeral costs and final expenses – Maintain property and manage insurance during administration Tax Filings – File final personal income tax returns – File trust fiduciary income tax returns – File estate tax return (Form 706), if required Transfer and Distribute Assets – Retitle assets in the name of the successor trustee – Distribute assets to beneficiaries according to the trust – Provide an accounting to beneficiaries, if required Why Trustees Work with Us Even if a trust seems “simple,” trustees carry significant legal and financial responsibilities . One of the options often discussed is a limited conservatorship – but it’s not the only one. At Cookman Law, we do not currently handle conservatorships , but we’re happy to refer you to attorneys who do. In our practice, we focus on tools that help individuals retain as much autonomy as possible, such as supported decision-making , powers of attorney , and advance directives . Our goal is to guide families toward planning approaches that are respectful, protective, and empowering. schedule a call with our team What Is a Limited Conservatorship? A limited conservatorship is a court process where a judge appoints a conservator (usually a parent or family member) to assist an adult with a developmental disability in making certain life decisions. It’s called “limited” because the court only grants authority in specific areas where the person needs support, such as: Medical decisions Education Marriage Living arrangements Access to confidential records Contracts and legal decisions Social and sexual relationships Conservatorships are designed to protect vulnerable individuals, but they also involve court oversight , loss of civil rights , and public proceedings . For that reason, courts and disability advocates increasingly encourage less restrictive alternatives , when possible. When a Limited Conservatorship Might Be Appropriate A limited conservatorship may be necessary when: – A person with developmental disabilities is unable to understand or communicate decisions – There are no trusted individuals available to act under less restrictive tools – There is a clear risk of exploitation, medical harm, or neglect – The Regional Center recommends conservatorship after a formal assessment We understand that pursuing a conservatorship is a deeply emotional decision. If you feel this may be the right path, we’re happy to refer you to attorneys who specialize in conservatorship law in California. Alternatives to Conservatorship Supported Decision-Making In many cases, individuals with disabilities can manage their affairs with the help of supportive structures without needing a conservatorship. This is called supported decision-making (SDM). It’s a person-centered approach where the individual remains the primary decision-maker but receives help from trusted family, friends, or professionals. Other Alternatives May Include: Durable Power of Attorney for financial decisions Advance Health Care Directive for medical decisions HIPAA authorization for sharing medical information Educational rights planning through an IEP or post-secondary transition plan Representative payee arrangements for Social Security At Cookman Law, we help families prepare these documents and create a legal framework that empowers their loved one while protecting their well-being .
