While many people associate trusts with the very wealthy, the truth is that trusts are a core part of most California estate plans , especially for those who want to avoid probate, maintain privacy, and provide clarity for their loved ones. At Cookman Law, we help individuals and families throughout California establish customized trusts that reflect their goals – whether that’s a simple revocable living trust or a more advanced structure like an A/B split trust or dynasty trust. Our approach ensures your assets are handled exactly how you intend, while minimizing legal, tax, and administrative complications. Talk with our team What Is a Trust? A trust is a legal arrangement that allows one party (the trustee) to hold and manage assets on behalf of another (the beneficiary). The person who creates the trust (the settlor or grantor) outlines how assets should be managed during their lifetime and distributed after death. Trusts are used for a variety of purposes, including: Avoiding probate Reducing estate taxes Protecting beneficiaries Managing complex family dynamics Preserving family wealth for future generations Common Types of Trusts We Use Revocable Living Trusts This is the foundation of most estate plans in California. A revocable living trust allows you to retain control over your assets while you’re alive, and seamlessly transfer them to your chosen beneficiaries after your death without going through probate . Key benefits: Avoids the public and costly probate process Maintains privacy over your estate Allows for smooth management if you become incapacitated Easy to update or revoke during your lifetime We help clients fund their trust correctly – making sure real estate, bank accounts, and other assets are titled appropriately so the plan works as intended. A/B Split Trusts (Marital Trusts) For married couples (especially those with larger estates) an AB trust can be used to reduce estate taxes and preserve wealth for children from prior relationships. How it works: When the first spouse passes away, the trust “splits” into two parts: Trust A (Survivor’s Trust) and Trust B (Bypass or Decedent’s Trust). The B Trust captures the deceased spouse’s federal estate tax exemption. The surviving spouse retains control of their half, while the decedent’s portion is preserved for the next generation. Is it still useful in 2026? While fewer families owe federal estate tax today due to higher exemption limits, an AB trust may still be an essential planning tool for certain clients who want to maintain control over their half upon their death. We can help you assess whether it’s right for your situation. contact us to get started Dynasty Trusts (Legacy Planning) A dynasty trust is a long-term trust designed to pass wealth across multiple generations while avoiding estate taxes at each level. It’s ideal for families who wish to: Protect family assets over time Shield inheritances from divorce, creditors, and lawsuits Create a lasting financial legacy In California, dynasty trusts can last up to 90 years (or longer, depending on structure). Our firm structures these trusts to balance flexibility and asset protection , while staying compliant with both state and federal law. What They’re Saying… It was a great experience updating our trusts/wills with Ellen, Aimee and the Cookman staff. We feel totally confident that they helped us create the trusts/wills that fit our needs. Their guidance and advice were invaluable. Everyone on the team was personable, readily accessible, and well informed – about both best practices and our particular needs. Sandra W. Prior to discovering Cookman Law, we attempted to research estate planning and special needs trust independently. Soon, we reached out to Ellen Cookman. Throughout the entire process, Ellen and her team attentively listened to our needs, patiently addressed our numerous questions, and expertly assisted us in establishing our trusts and wills. Without hesitation, we highly recommend Ellen Cookman for your estate planning and special needs trust needs. Yu H. The wonderful folks at Cookman Law recently set up an estate plan for our family. We were especially impressed with the detail that went into the various estate plan documents: this clearly is a team that is constantly honing their craft to provide the best possible support for their clients. They were also very easy to work with when it came to adjustments that we wanted to explore. We couldn’t have chosen a better firm to handle our estate planning needs! Ellen M. What Can You Put in a Trust? Almost any asset can be transferred into a trust, including: Real estate Life insurance (via an ILIT, or Irrevocable Life Insurance Trust) Bank and brokerage accounts Intellectual property Business interests Collectibles and family heirlooms We’ll guide you through “funding the trust” to ensure all assets are properly titled – without this step, the trust may not serve its purpose. And we don’t stop there: when you join our Trust Maintenance Program , you get ongoing support as your life, family, and needs change. schedule your consult with our team Why Trust-Based Planning Matters in California California’s probate process can be lengthy, expensive, and public . A revocable living trust allows your estate to bypass probate entirely, saving time, money, and stress for your loved ones. In most cases, a trust-based plan is more cost-effective in the long run than relying on a simple will alone. Trusts also give you control – whether you’re planning for young children, second marriages, blended families, or complex assets, a well-drafted trust offers flexibility, protection, and peace of mind. Let’s Build the Right Trust for Your Family Every family is different. That’s why we don’t believe in one-size-fits-all plans. Whether you need a basic revocable trust or a more advanced strategy like an AB or dynasty trust, we’ll help you design a plan that reflects your goals and values. Ready to take the next step? Let’s talk about how we can create a trust-based estate plan that protects your legacy and makes life easier for those you love. The goal of special needs planning is to ensure that your loved one has the resources, structure, and support they need without losing access to critical public benefits like SSI and Medi-Cal. At Cookman Law, we specialize in guiding families through the often complex process of special needs planning. Whether you’re planning for a child with a physical or developmental disability, a sibling with a chronic condition, or a spouse facing progressive illness, we’re here to help you create a plan that offers protection, peace of mind, and a meaningful quality of life. schedule a call with our team What Is Special Needs Planning? Special needs planning involves creating legal and financial strategies to: Protect eligibility for public benefits Provide supplemental support beyond government programs Ensure your loved one is cared for during their lifetime Communicate your wishes to future caregivers or trustees Protect your loved one from financial predators Provide your loved ones the most fulfilling and independent life possible It often includes tools like Special Needs Trusts , Letters of Intent , Advance Directives , and coordinated estate planning for parents, guardians, and other family members. Why Traditional Estate Planning Isn’t Enough If a person with a disability receives an inheritance or financial gift outright, even from a loving parent or family member, it can jeopardize their eligibility for needs-based programs like: Supplemental Security Income (SSI) Medi-Cal In-Home Supportive Services (IHSS) Section 8 Housing In addition, people with disabilities may need specialized care, housing, or other necessities throughout their lives. A proper special needs plan preserves benefits eligibility while still allowing the individual to enjoy financial resources for enhanced care, experiences, and independence. Key Tools in Special Needs Planning 1. Special Needs Trusts (SNTs) A Special Needs Trust allows assets to be held for the benefit of a person with disabilities without being counted against asset limits for SSI, Medi-Cal, and other benefits. There are several types: First-Party SNTs: Funded with the beneficiary’s own assets (often from an inheritance). Must include a Medi-Cal payback provision. *Please note that Cookman Law does not handle First Party SNTs from settlements, though we are happy to refer you to trusted professionals who do. Third-Party SNTs: Funded by parents, grandparents, or others. Can hold gifts or inheritances and do not require payback to the state. Pooled SNTs: Managed by nonprofit organizations. Useful for smaller estates or when a professional trustee is needed. * Our office does not handle Pooled Trusts, but we can refer you to organizations who do. We help families choose and establish the right type of trust, draft custom provisions, and ensure it integrates with the rest of the estate plan. 2. Letter of Intent A Letter of Intent is not a legal document, but it’s one of the most important pieces of the plan. It provides future caregivers, trustees, and loved ones with: Daily routines, preferences, and communication styles3 Medical history and care needs Hopes and goals for the future Contact information for doctors, specialists, and providers We provide templates and guidance so your Letter of Intent becomes a living document that truly reflects your loved one’s life and needs. 3. Coordinated Planning for the Whole Family Special needs planning isn’t done in a vacuum. It often includes: Updating your own estate plan to ensure assets are directed to a Special Needs Trust – not directly to your child or loved one Reviewing beneficiary designations on retirement accounts and life insurance Coordinating with siblings, future trustees, or care teams Exploring CalABLE accounts for increased financial flexibility Evaluating whether tools like conservatorship or supported decision-making are appropriate *Although Cookman Law does not currently handle limited conservatorships, we can refer you to trusted professionals who do if the necessity arises. We help you build a plan that works now and continues to work after you’re gone. cookman law guided us through the whole process. Sometimes it’s hard to know if you will need a special needs trust when your child is not done with their developmental journey. Ellen helped us set up an estate plan that was flexible, in case our son proved himself capable of navigating life on his own at any point. She also connected us with several fiduciaries, in case we wanted to appoint a successor trustee after we’ve both passed. She guided us through the whole process, so we could get through it without more overwhelm, which has been a frequent state of mine while raising a neurodiverse child. Wendy C. We highly and enthusiastically recommend Cookman Law! We received excellent professional estate planning service from Ellen Cookman and her legal team. We were referred to Cookman Law because of the firm’s expertise in developing customized special needs trusts. From the beginning, Ellen listened carefully to our specific intentions and provided estate planning options that would fully address our family’s concerns. We feel more secure now because of the comprehensive trust plan and estate documentation we have in place for our family’s future. We highly and enthusiastically recommend Ellen Cookman and Cookman Law for meeting your family’s trust and estate planning needs. Kathy K. Make Sure You Have the Right Team In Place At Cookman Law, we’re happy to work with the professionals you already have in place to ensure that your estate plan works the way you need it to. And if you need recommendations for any professionals you might need to add to your team, we’re here to help! We are happy to refer you to the experts you need. When Should You Start Planning? It’s never too early to start – however, it can be too late*. Common times to begin or revisit a special needs plan include: When a child receives a diagnosis When your child turns 18 and becomes a legal adult When you or a co-parent are updating your estate plan When your loved one receives an inheritance or legal settlement When you’re planning for retirement or considering long-term care Special needs planning is not a one-time event – it’s a process that evolves as your family’s circumstances change. *If mental capacity of the estate plan holder is in question, the process of estate planning becomes more complicated and may require court involvement. We’re Here to Help, Every Step of the Way At Cookman Law, we’ve helped hundreds of California families protect their loved ones with disabilities through thoughtful, comprehensive special needs planning. We understand the law and we understand the emotional weight of these decisions. We’ll guide you with clarity, experience, and compassion, whether you need to: Set up a new Special Needs Trust Rewrite an outdated or incorrect estate plan Navigate benefits like Medi-Cal or SSI Plan for the next generation of caregivers Let’s make sure your loved one is supported, protected, and empowered for life. Fortunately, ABLE accounts have changed that. Thanks to the Achieving a Better Life Experience (ABLE) Act , eligible individuals can now save money in a tax-advantaged account without risking their needs-based benefits . At Cookman Law, we’re big fans of ABLE accounts and we regularly recommend our clients integrate them into their broader special needs plans. Please note that Cookman Law does not handle the paperwork involved in opening an ABLE account, but we have resources to guide you through the process and are happy to answer questions. contact our team today What Is an ABLE Account? An ABLE account is a special savings account available to individuals with disabilities who developed their disability before age 46. The account allows for tax-free growth and protected savings that can be used for a wide range of qualified expenses without affecting public benefits eligibility. In California, ABLE accounts are managed through the CalABLE program , and accounts can be opened online at www.calable.ca.gov . Why ABLE Accounts Matter Many people with disabilities rely on programs like SSI and Medi-Cal, which have strict asset limits – SSI’s asset limit is $2,000 and Medi-Cal’s asset limit is currently $130,000 in California. ABLE accounts allow individuals to save beyond this limit while maintaining eligibility. Key benefits include: Using funds for a wide range of qualified disability expenses Avoiding ISM reductions (In-Kind Support and Maintenance) when paying for shelter expenses Tax-free growth when used for eligible expenses Easy access via online banking and a debit card Low annual fees and accessible minimum contributions SSI, ISM, and Preserving Benefits One of the most powerful uses of an ABLE account is avoiding reductions in SSI benefits due to In-Kind Support and Maintenance (ISM). Here’s how it works: If a trust or family member pays directly for a person’s food or shelter, the SSI benefit may be reduced by about $350/month . But if that same money is first deposited into an ABLE account , and the account holder then uses the funds to pay for their own shelter expenses, it doesn’t count as ISM and the full SSI benefit is preserved. In short: ABLE accounts can be a strategic tool for maintaining SSI benefits while paying for basic living costs. Real-Life Example “Nina has had an ABLE account for several years now. We’ve used it to receive stimulus funds and larger family gifts. With the balance growing, we’ve split the funds between investments and banking. Our next step is setting up a recurring rent payment, which will help her qualify for a larger SSI payment. It’s a step toward independence.” – Connie, parent “We set up an ABLE account for our son Robbie when he turned 18. His grandparents wanted to contribute gifts like they do for their other grandkids’ 529 plans. With the account, we’ve covered respite camps, travel, and mobility devices. It’s been a total win.” – Beth Goddard ABLE Account vs. Third-Party Special Needs Trust Both ABLE accounts and Third-Party Special Needs Trusts (SNTs) offer financial tools for individuals with disabilities, but they serve different purposes. Here’s how they compare: Expenses You Can Use an ABLE Account For Funds must be used for qualified disability expenses , a broad category that includes: Rent and housing costs Food and groceries Medical and dental care Education and training Transportation Assistive technology Legal fees Employment support Recreation and travel In practice, ABLE accounts give individuals more financial flexibility and autonomy , especially when used alongside a Special Needs Trust. Getting Started with CalABLE To open an ABLE account in California: 1. Visit www.calable.ca.gov 2. Set up your account with a $25 minimum contribution 3. Choose from investment or FDIC-insured savings options 4. Link a bank account and receive a Visa debit card 5. Begin using the account for qualified disability expenses Annual account fees currently start at $37/year , with optional investment options available. ABLE Accounts + Estate Planning At Cookman Law, we often recommend using ABLE accounts in tandem with Special Needs Trusts , especially for individuals with capacity who want more financial independence. Contact Our team About Cookman Law & Our Team Discover who we are and how to work with us. Who will I work with on your team? While Ellen oversees every estate plan and signs off on every document, we work as a team to support you every step of the way. You’ll be working with: One of our attorneys , Hannah MacLeod or Amiee Lee , who are available for consultations, follow-up questions, and ongoing communication. One of our drafting paralegals , Megan Orsini, Catarine Datora , or Roby Anne Albarracin, who help prepare and review your documents. And, of course, Ellen Cookman , who provides legal oversight and helps guide key decisions. We believe in teamwork, and at least three sets of eyes review every document before it goes out the door. meet our team Do you charge for consultations? Yes. While we don’t offer free consultations, we do apply a flat fee model for most services. After your initial meeting, we’ll provide a clear, all-inclusive flat fee for your estate plan or trust administration needs. What are your fees and how does payment work? Once we agree on the scope of work, we collect the full flat fee upfront. Payment is held in our IOLTA trust account (monitored by the California State Bar) until your draft documents are ready for review. We accept both checks and credit cards. How long does it take to complete an estate plan or trust administration? – Estate Planning : Typically completed within 2 months , depending on how quickly decisions are made. – Trust Administration : Often takes 4–6 months , depending on complexity. – Conservatorships (when referred out): Time varies depending on the court. Do you serve as Trustee or Executor? No, we do not act as trustee or executor. However, we regularly advise trustees and executors , especially during trust administration after a death. If needed, we can introduce you to banks or private professional fiduciaries who can serve in these roles. Will you work with my financial advisor, CPA, or other professionals? Absolutely. We welcome collaboration with your existing team and are happy to include your professionals in meetings or decision-making as you prefer. Do you help with applications for public benefits like SSI or Medi-Cal? No, we don’t assist with benefit applications. However, we can refer you to experienced professionals who specialize in this area. Trust Types and Planning Tools Find answers to your questions about the different types of trusts that may be right for you. What is a Revocable Living Trust (RLT)? A Revocable Living Trust is the cornerstone of most California estate plans. It: Avoids probate Can be changed during your lifetime Lets you manage your own assets while you’re alive and well Allows a successor trustee to step in if you become incapacitated It’s also simple: no separate tax ID is needed, and no additional tax filings are required while you’re living. What is a Special Needs Trust (SNT)? An SNT is an irrevocable trust created for a person with a disability who receives (or may receive) needs-based public benefits like SSI or Medi-Cal. A properly structured SNT: Preserves benefit eligibility Allows funds to be used for quality-of-life expenses Can be created while the parent is alive or at death We also help families set up “seed trusts” (funded with a small amount like $10) so they’re ready to receive funds later. How do I know if a Special Needs Trust is right for my child? An SNT is likely appropriate if your child: Receives needs-based benefits (SSI, Medi-Cal) May need help managing money in the future Could inherit from you or another loved one We’ll talk through your child’s specific needs during our planning process and advise you as to your options. What is a Lifetime or Dynasty Trust? A Dynasty Trust (also known as a Lifetime Trust or Generation-Skipping Trust ) is a protective irrevocable trust created for a loved one, often after your death. It offers: Divorce protection (trust assets aren’t part of the beneficiary’s marital estate) Creditor protection (especially if a third party is trustee) Estate tax protection for future generations Special Needs Planning & Public Benefits Because we’re one of the few firms in California that specialize in special needs planning, we often get questions. Here are the answers you’re looking for! How much of your practice focuses on special needs planning? About half of our estate planning clients are families with a loved one who has special needs. Can a person with disabilities inherit money? Yes, but the inheritance must be carefully structured. Inheriting money outright can disqualify someone from SSI or Medi-Cal. A First-Party SNT can be used to hold the inheritance and preserve benefits. We can help navigate this process. What if a person with disabilities receives a sudden inheritance or settlement? Contact us immediately , before spending or transferring funds. We may be able to: Set up a First-Party SNT Avoid disqualification from benefits We also offer resources for families navigating this situation. Process & Planning Timeline You may be wondering: once you start the process, what will it involve? What does your estate planning process look like? 1. You will talk with a member of our Intake Team to gather information and determine if we’re a good fit for your situation (if not, we are happy to refer you to someone who can help you) . 2. Initial Consult with Ellen, Amiee, or Hannah to better understand your goals and quote a flat fee. 3. Sign the engagement letter and submit the fee. 4. Document Drafting is done by our team 5. Review Materials sent to you (including flowcharts and walkthrough videos) 6. Follow-Up Meeting to clarify decisions 7. Final Signing via Remote Online Notarization or in-person Do you handle Limited Conservatorships? Not directly. We no longer file conservatorship petitions, but we’re happy to refer you to trusted attorneys who specialize in this area. schedule your consultation Free Download Wondering how to talk with your family about your estate plan? But in California, a will alone is often not enough to avoid probate or protect your loved ones. That’s why many estate plans include a “pour-over” will that works in tandem with a revocable living trust. At Cookman Law, we help clients understand what a will can (and cannot) do as well as how to integrate it effectively into a comprehensive estate plan. We can help ensure that your will is clear, legally sound, and aligned with your family’s needs. contact our team today What Is a Will? A will is a legal document that outlines your wishes for how your assets should be distributed after your death. It also allows you to nominate a guardian for your minor children and appoint someone (an executor) to carry out your instructions. In California, if you only have a will (and no trust) your estate will typically go through probate , a public court process that can take 9 to 18 months or longer and involve significant court and attorney’s fees. The Role of a Pour-Over Will in a Trust-Based Plan Most of our clients in California use what’s called a pour-over will as part of a trust-centered estate plan. Here’s how it works: Your revocable living trust holds most of your assets during your lifetime. Your pour-over will serves as a backup – it “pours” any remaining assets into your trust at death. It also allows you to nominate guardians for your minor children and specify your funeral or burial wishes , if desired. This type of will ensures that any assets not formally transferred into your trust during your lifetime still end up being distributed according to your wishes. What a Will Can Do Appoint a guardian for your minor children Name an executor to manage your estate Direct how assets outside your trust (if any) should be distributed Serve as a legal safety net for any assets not titled in your trust What a Will Cannot Do Avoid Probate: A standalone will must be submitted to the probate court. Control Trust Assets: A will cannot override or manage assets already held in a trust or directed by beneficiary designation. Provide Long-Term Asset Management: Wills don’t include provisions for holding and managing assets over time – for that, you need a trust . Is a Will Enough in California? For most people in California, the answer is no . A will-only estate plan exposes your estate to probate, which is often time-consuming, expensive, and public . That’s why we typically recommend a trust-based plan , with a pour-over will included as a companion document. However, there are some situations where a standalone will may be appropriate, such as: Very small estates below the probate threshold Temporary planning before a trust is created As a legal safety net if a trust isn’t fully funded The estate only contains assets that pass by beneficiary designations, such as retirement accounts and life insurance If you’re not sure what’s right for your situation, we’re here to help you evaluate your options. Schedule your consult today Other Considerations: Handwritten and Online Wills While California does recognize holographic (handwritten) wills , they must meet strict legal requirements to be valid and they often lead to confusion, disputes, or probate delays. Similarly, online or DIY wills may seem convenient, but they often leave out key protections or fail to comply with California law. We frequently see these documents cause problems for families, leading to avoidable court battles or unintended consequences. Estate planning is too important to leave to chance. Our team ensures that your will is properly drafted, signed, and integrated into your overall plan. working with ellen and her team has been a great experience. That’s where Special Needs Trusts (SNTs) come in. These trusts allow you to set aside funds for your loved one’s care without disrupting their eligibility for public benefits like SSI or Medi-Cal. They also provide a framework for long-term support, caregiving, and financial oversight, or what we might call “parenting when you’re gone.” At Cookman Law, we help families across California create customized Special Needs Trusts that offer protection, flexibility, and peace of mind. Whether you’re planning for a child, sibling, or other family member, we’ll walk with you every step of the way. schedule a call today learn more about special needs trusts What Is a Special Needs Trust? A Special Needs Trust is a legal tool that holds assets for the benefit of a person with disabilities, without those assets counting against strict income and resource limits for benefits like: Supplemental Security Income (SSI) In-Home Supportive Services (IHSS) Medi-Cal Section 8 Housing The trust is managed by a trustee who uses the funds to support the beneficiary in ways that enhance (but don’t replace) public benefits . This includes things like therapies, housing, personal care, education, recreation, travel, and more. Types of Special Needs Trusts We help families determine the best type of SNT for their situation: 1. First-Party Special Needs Trust Also called a self-settled or (d)(4)(A) trust , this is funded with the beneficiary’s own money , such as: An inheritance received outright Accumulated savings before onset of disability Litigation settlement Key features: Must be funded before the beneficiary turns 65 Must include a Medi-Cal payback clause Keeps the beneficiary eligible for needs-based public programs *Please note that our office does not handle First-Party Special Needs Trusts for settlements, but we are happy to refer you to professionals who do. 2. Third-Party Special Needs Trust This trust is created and funded by someone other than the beneficiary – usually parents, grandparents, or other relatives. Key features: Can be included in a revocable living trust or as a standalone trust No Medi-Cal payback required Ideal for planned inheritances, gifts, or life insurance policies We often integrate third-party SNTs directly into our clients’ overall estate plans, ensuring seamless estate planning and benefits protection. 3. Pooled Special Needs Trust Managed by nonprofit organizations, pooled trusts combine assets from many beneficiaries for investment purposes, while keeping individual accounts. Best for: Families without a suitable trustee Beneficiaries with smaller inheritances or settlements Situations where professional trust management is preferred Although we do not handle Pooled Trusts, we can help you assess your options and refer you to reputable organizations when appropriate. Planning for Mild or Uncertain Disabilities Not all disabilities are clear-cut, and not all children with IEPs or diagnoses will need lifelong benefits or support. That’s why we offer flexible planning strategies for families in this gray area. One approach is using a “toggle clause” in your revocable trust. This allows a family member to direct a child’s share of inheritance into a Special Needs Trust only if they qualify for SSI or Medi-Cal at the time of distribution. If not, the assets pass directly to the child or to a different protective trust such as a dynasty trust. This approach offers: Flexibility as your child’s needs evolve Protection if their condition progresses Preservation of options without unnecessary restrictions Contact our team today Why Wealthy Families May Still Need an SNT You might assume that if your family has substantial assets, a Special Needs Trust isn’t necessary. But even high-net-worth families may benefit from creating one. Why? Because eligibility for key public services such as supported housing, day programs, and other governmental services often requires enrollment in SSI or Medi-Cal , regardless of personal wealth. An SNT allows your loved one to access both private resources and public programs , expanding their opportunities and reducing long-term costs. What Can an Special Needs Trust Pay For? Funds in a Special Needs Trust can be used for: Personal care attendants Therapies and specialists Assistive technology Home modifications Travel, hobbies, and education Transportation and adaptive equipment Supplemental medical costs The trustee can enhance quality of life without interfering with government benefits. Who Should Be the Trustee? The trustee plays a central role in managing the trust, disbursing funds, and ensuring compliance with program rules. Your options include: A trusted family member or friend A professional fiduciary A nonprofit trustee (for pooled trusts) We help you choose the right trustee (or team of trustees) and ensure they understand their responsibilities. How Does an SNT Fit Into Your Broader Plan? A Special Needs Trust is most effective when integrated into a full estate plan. We ensure: security Your living trust and will leave assets to the SNT, not directly to your loved one memo of intent You’ve completed a Letter of Intent to guide future caregivers beneficiaries Life insurance and retirement account beneficiary designations are updated family is included Siblings or other family members involved in the planning understand how the plan works Without coordination, even well-meaning gifts or inheritances can cause unintended harm. We help you avoid those pitfalls. Let’s Secure Your Loved One’s Future A Special Needs Trust is more than a legal document – it’s a lifelong commitment to your loved one’s care, independence, and dignity. At Cookman Law, we treat it that way. We bring deep experience, technical knowledge, and heartfelt understanding to every family we serve. Estate planning is the process of creating a comprehensive legal strategy to manage your assets, medical care, and personal wishes, both during your life and after your death. It’s more than just drafting a will; it’s about ensuring your loved ones are provided for, your final wishes are respected, and your legacy is preserved. Whether you’re starting with a basic plan or need to build a more detailed structure involving trusts and other legal tools, the goal is the same: to offer clarity, reduce stress for your loved ones, and protect your family’s future. connect with our team At Cookman Law, we guide individuals and families throughout California through every step of the estate planning process, from straightforward trusts to more advanced plans designed for complex family dynamics and long-term care needs. Why Estate Planning Matters Avoiding Probate: A well-structured plan can help your estate bypass the lengthy and public court process of probate . Appointing Guardians: If you have minor children, you can designate who will care for them. Designating Decision-Makers: You’ll be able to name someone to make medical or financial decisions on your behalf if you become incapacitated. Protecting Beneficiaries: You control how and when your assets are distributed to your heirs, including minor children or loved ones who may not be ready to manage a large inheritance. Common Estate Planning Tools Revocable Living Trusts Central to many California estate plans, RLTs help you avoid probate and maintain privacy. Wills Although a will alone is not sufficient to protect against probate in California, it is often used in tandem with a trust to nominate guardians for minor children and direct remaining assets. Powers of Attorney These documents allow someone you trust to manage your financial affairs if you are unable to. Advance Health Care Directives Ensure your medical wishes are known and empower someone to make decisions on your behalf. Beneficiary Designations Ensure your retirement accounts, life insurance, and other assets align with your broader plan What Is Special Needs Planning? Special needs planning is a specialized area of estate planning designed to ensure that individuals with disabilities are cared for throughout their lives without jeopardizing their access to housing or vital public benefits like Supplemental Security Income (SSI) or Medi-Cal. At Cookman Law, we understand the deep importance of long-term planning for a child, sibling, or family member with special needs. Our role is to help families create customized legal solutions that provide stability, structure, and peace of mind today and well into the future. What Makes Special Needs Planning Different? A standard estate plan isn’t enough for individuals with disabilities who rely on means-tested public benefits. Leaving assets to them outright – or through a revocable living trust or even a dynasty trust – can unintentionally disqualify them from essential programs. That’s why we work closely with families to design plans that offer financial protection and lifelong support without compromising eligibility for programs like SSI, or Medi-Cal, or IHSS. schedule a call with our team Key Tools in Special Needs Planning Special Needs Trusts (SNTs) These specialized trusts allow assets to be held for the benefit of a person with disabilities without being counted as a resource for public benefits. > First-Party SNTs are funded with the beneficiary’s own assets (often from an inheritance). *Please note that we do not handle First-Party SNTs for settlements, but we are happy to refer you to firms that do. > Third-Party SNTs are funded by parents or other family members and offer more flexible distribution options. > Pooled Trusts are managed by nonprofit organizations and can be an option for beneficiaries with smaller amounts to set aside. *Note: While Cookman Law does not handle Pooled Trusts, we are happy to refer you to trusted professionals who do. Conservatorships and Alternatives We help families evaluate when legal authority over medical or financial decisions is needed and explore less restrictive alternatives, such as Supported Decision Making, when appropriate. *Please note that while we do not currently handle Limited Conservatorships, we can refer you to trusted professionals who do. Coordination with Public Benefits We ensure the plan is fully integrated with the family member’s current and potential public benefits, including Section 8 housing vouchersIn-Home Supportive Services (IHSS), and regional center services. Letters of Intent Non-binding documents that provide guidance about the person’s routines, care preferences, history, and future goals – essential information for future caregivers or trustees. Coordination with CalABLE Accounts Use this section to help them realize that their situation doesn’t have to be like this, in fact… there’s another way! Pastry sweet roll brownie gummi bears toffee. If you would like more information about how Special Needs Planning can help to preserve benefits, please check out our Public Benefits playlist on our YouTube channel. We believe that each family has unique needs, and their estate plan should be customized to meet those needs. Ellen Cookman started the firm in 2015, to provide broad estate planning services in the California Bay Area with a subfocus in special needs planning. Many families need “parenting when you’re gone,” and we help them put together a team of professionals and family members to provide additional financial and care management and support. We also offer trust administration services upon a loved one’s death. At Cookman Law, a typical estate plan takes about 2 months from start to finish. We generally charge a flat fee for all practice areas. We’ve found that our clients prefer the certainty of knowing up-front what they’ll be paying, and this also encourages clients to contact us with questions without worrying about being “on the clock.” Ellen Cookman Owner/Principal Attorney Ellen Cookman started Cookman Law in 2015 to help families of all shapes and sizes plan for the future and utilize available resources. At Cookman Law, we guide successor trustees through the entire trust administration process , ensuring that everything is done legally, efficiently, and with care. Whether we drafted the original trust or not, we’re here to help you carry out your responsibilities and honor your loved one’s wishes. We work with individual trustees, families, private fiduciaries, and banks to provide skilled, compassionate legal support during a difficult time. contact the cookman law team today What Is Trust Administration? Trust administration is the legal and financial process of managing and distributing the assets of a revocable living trust after the death of the person who created it (also called the grantor or settlor ). A properly funded trust allows you to avoid probate, but it doesn’t operate automatically . After the settlor’s death, the named successor trustee is legally responsible for taking a series of steps under California law to: Notify beneficiaries and government agencies Manage, value, and protect trust assets Pay outstanding debts and taxes Distribute assets to beneficiaries This is known as post-death trust administration – and doing it correctly is essential to avoid legal, tax, and family complications. What Does a Trustee Need to Do? The duties of a successor trustee may include: Legal Notices & Compliance – Notify beneficiaries and heirs under California Probate Code §16061.7 – Notify the California Department of Health Care Services (Medi-Cal) – File notices with the county assessor’s office for real estate Obtain a Tax ID Number – Apply for a new EIN (Employer Identification Number) if the trust has become irrevocable Marshal and Value Assets – Identify and gather trust assets (“marshal the estate”) – Obtain date-of-death values for bank accounts, investments, and real property – Order professional appraisals if necessary Pay Debts and Expenses – Locate and pay valid creditor claims – Pay funeral costs and final expenses – Maintain property and manage insurance during administration Tax Filings – File final personal income tax returns – File trust fiduciary income tax returns – File estate tax return (Form 706), if required Transfer and Distribute Assets – Retitle assets in the name of the successor trustee – Distribute assets to beneficiaries according to the trust – Provide an accounting to beneficiaries, if required Why Trustees Work with Us Even if a trust seems “simple,” trustees carry significant legal and financial responsibilities . Mistakes, however unintentional, can lead to lawsuits, penalties, or tax issues . At Cookman Law, we: Provide step-by-step guidance through the administration process Help you understand your fiduciary duties Prepare and file required legal documents Coordinate with CPAs and financial advisors Ensure all assets are properly transferred or distributed Minimize risk and keep everything compliant with California law Whether you’re the named trustee , a co-trustee , or the beneficiary of a trust, we can help. let us help you We Assist With: Trusts we prepared, as well as those we didn’t Family situations involving multiple beneficiaries Special Needs Trust administration AB trust administration (at the first death for a married couple) Real property held in trust, including California Prop 19 considerations Representing private fiduciaries, banks and trust companies Client Story: Calm in the Storm “I had to handle my mom’s estate after she passed away. I knew I needed a specialist to handle the trust administration, especially with a lot of family involved. Ellen calmed us down, handled the documents, signed the papers, and made the process so much easier. We gave her a big hug and walked out the door.” – Alice and Bill Whitley Trust Administration vs. Probate: What’s the Difference? Trust Administration – Avoids court involvement – Private and confidential – Faster (often 4-6 months) – Lower cost – Guided by trust terms Probate – Supervised by the probate court – Public court process – Longer (9-18 months or more) – Statutory attorney and executor fees – Guided by a will or California law If your loved one had a properly funded revocable trust, you can typically avoid probate entirely , but administration of the trust is still required. Let Us Lighten the Load Losing a loved one is difficult enough. You don’t have to navigate trust administration alone. At Cookman Law, we offer Protective Planning services that go beyond the basics to shield your beneficiaries, preserve public benefits, and create lasting security for future generations. Whether you’re caring for a loved one with a disability, concerned about divorce or creditors, or want to leave a thoughtful legacy that extends beyond your lifetime, we’re here to help you build a plan that protects. talk with a member of our team What Is Protective Planning? Protective Planning is a proactive approach to estate planning that focuses on: Preserving public benefits for loved ones with disabilities Shielding inheritances from divorce, lawsuits, or poor financial decisions Providing long-term support through trusts that last for decades Ensuring privacy and flexibility without court involvement This kind of planning often includes the use of specialized trusts , careful beneficiary designations, and thoughtful distribution strategies, all customized to your family’s needs and values. Who Can Benefit from Protective Planning? Protective Planning is ideal for families who want more than simple documents. It’s a great fit if you: Have a child or family member with a disability or who receives public benefits Want to protect your child’s inheritance from a future divorce Have concerns about creditors, addiction, or poor money management Are in a blended family and want to make sure your children are protected Want to leave assets in trust for future generations Are thinking about long-term legacy or philanthropic planning Our Protective Planning Tools Special Needs Trusts (SNTs) We create both Third-Party and First-Party Special Needs Trusts to protect eligibility for SSI, Medi-Cal, and other needs-based benefits. These trusts allow funds to be used for a beneficiary’s supplemental needs without jeopardizing critical services. Staggered and Discretionary Distributions Not every beneficiary is ready to receive a lump sum at age 18 (or even at 35). We can design your trust to distribute assets over time , under specific conditions , or with oversight by a trusted person or professional . Lifetime/Dynasty Trusts Also called Generation-Skipping Trusts , these trusts can stretch across multiple generations while protecting against divorce, lawsuits, and estate taxes. We often recommend these trusts for adult children or grandchildren who may need long-term support and structure. Creditor and Divorce Protection With careful drafting, we can create trusts that keep assets out of reach from a beneficiary’s spouse or creditors, while still allowing them to benefit from the trust over time. What Makes Our Approach Different We don’t believe in one-size-fits-all plans. Protective Planning is personal, and we take the time to: Understand your goals, your family dynamics, and your concerns Educate you about your options in plain English Design a plan that’s legally sound and emotionally smart Coordinate with your financial advisor or CPA if needed Our goal is to create a plan that provides peace of mind – not just now, but for decades to come. Start Planning Before There’s a Problem Protective planning isn’t just for the wealthy or the worried; it’s for families who want to take care of each other, thoughtfully and intentionally. If you’re ready to protect what matters most – your loved ones, your legacy, and the future – we’re here to help. schedule a consult with cookman law today Free Download Wondering how to talk with your family about your estate plan? One of the options often discussed is a limited conservatorship – but it’s not the only one. At Cookman Law, we do not currently handle conservatorships , but we’re happy to refer you to attorneys who do. In our practice, we focus on tools that help individuals retain as much autonomy as possible, such as supported decision-making , powers of attorney , and advance directives . Our goal is to guide families toward planning approaches that are respectful, protective, and empowering. schedule a call with our team What Is a Limited Conservatorship? A limited conservatorship is a court process where a judge appoints a conservator (usually a parent or family member) to assist an adult with a developmental disability in making certain life decisions. It’s called “limited” because the court only grants authority in specific areas where the person needs support, such as: Medical decisions Education Marriage Living arrangements Access to confidential records Contracts and legal decisions Social and sexual relationships Conservatorships are designed to protect vulnerable individuals, but they also involve court oversight , loss of civil rights , and public proceedings . For that reason, courts and disability advocates increasingly encourage less restrictive alternatives , when possible. When a Limited Conservatorship Might Be Appropriate A limited conservatorship may be necessary when: – A person with developmental disabilities is unable to understand or communicate decisions – There are no trusted individuals available to act under less restrictive tools – There is a clear risk of exploitation, medical harm, or neglect – The Regional Center recommends conservatorship after a formal assessment We understand that pursuing a conservatorship is a deeply emotional decision. If you feel this may be the right path, we’re happy to refer you to attorneys who specialize in conservatorship law in California. Alternatives to Conservatorship Supported Decision-Making In many cases, individuals with disabilities can manage their affairs with the help of supportive structures without needing a conservatorship. This is called supported decision-making (SDM). It’s a person-centered approach where the individual remains the primary decision-maker but receives help from trusted family, friends, or professionals. Other Alternatives May Include: Durable Power of Attorney for financial decisions Advance Health Care Directive for medical decisions HIPAA authorization for sharing medical information Educational rights planning through an IEP or post-secondary transition plan Representative payee arrangements for Social Security At Cookman Law, we help families prepare these documents and create a legal framework that empowers their loved one while protecting their well-being . How We Help While we don’t currently handle the court process for conservatorships, we do offer: Estate planning for adults with disabilities Special Needs Trusts to protect public benefits Powers of attorney and health care directives to support autonomy Letters of Intent to guide future supporters or caregivers Referrals to conservatorship attorneys, if needed We take the time to understand your family’s specific situation and recommend a path that balances independence and protection. Case Study: Choosing Empowerment First Case: Emily’s son Max, who has level 1 autism, was approaching age 18. Emily worried about how he’d manage doctor appointments, benefits paperwork, and financial decisions. After a consultation, we helped Max sign: A Durable Power of Attorney for finances An Advance Health Care Directive A HIPAA release to keep mom in the loop on his care Max now has the legal support he needs without giving up his rights . Emily has peace of mind, and Max has room to grow and practice his decision-making skills. Let’s Plan with Dignity and Clarity Every family is different. Some people may need the protection of a limited conservatorship. Others may thrive with a well-crafted plan that keeps them in control of their own lives. At Cookman Law, we’re here to help you understand your options and to build a plan that honors your loved one’s strengths, protects their future, and preserves access to essential public benefits.
