Should the alleged victim--who is on my side--contact the district attorney to explain that it didn't really happen the way he or she originally said it did? I was arrested for a felony, but I have not yet been to court. Does this mean that I will have to face felony charges when I go to court? What happens to me if I am convicted of domestic violence? I am not a citizen of the United States. What effect will a conviction have on me? Is there anything special that I should do for my first court appearance? What are the exact charges I could be facing for domestic violence in California? How long will the court process take? If I actually did commit the offense with which I'm charged, do I need a lawyer? 1. Do I have to be married to be convicted of domestic violence? No. California Penal Code Sections 243(e) and 273.5 (the most commonly used prosecution sections for domestic violence), provide that any one who is cohabiting, has had a dating relationship with, is a former spouse of, or who is the parent of a child in common with the other person is subject to these charges Back to top 2. What if I never hit anyone—all I did was push, shove, or just slightly touch the other person? You can still be found guilty. The most minor conduct is now subject to a domestic violence prosecution. As a demonstration of what can be sufficient to allow a conviction for a misdemeanor, this is what the jury is told at the conclusion of the trial: CALJIC 141 (in part): "As used in the foregoing instruction, the words ‘force’ and ‘violence’ are synonymous and mean any [unlawful] application of force against the person of another, even though it causes no pain or bodily harm or leaves no mark and even though only the feelings of such person are injured by the act. The slightest unlawful touching, if done in an insolent rude or angry manner, is sufficient..." Back to top 3. Would the case against me (or my spouse/friend) automatically go away if the alleged victim refused to press charges? No. In California and most other states, there is no such thing as having a victim press charges. The alleged victim has no power over the prosecution of these cases. The prosecution of these cases is performed by the district attorney's office, whether or not the victim wants the matter to be prosecuted. In fact, the district attorney expects that in over 80 percent of cases, the alleged victim will not only want the prosecution to stop, but will recant or change his or her testimony. In spite of that, all district attorney's offices now continue the prosecution until they are faced with serious difficulties of proof or are convinced that an alternative to prosecution may be preferable. Back to top 4. Should I talk with the police to tell them "what really happened"? Generally, no. There are a number of reasons for that answer, some of which are technical or legal and must be discussed in the office, but the general reasons that apply are as follows: The authorities either have enough evidence to charge you, without your statement, or they do not have enough evidence and the district attorney will not charge you. Your statement will usually not stop this prosecution, no matter what you say. You merely give the district attorney an additional bit of evidence that can be used against you. Among the charges I defend clients against are: Rape and sexual assault — California sexual assault and battery laws cover nonconsensual touching of another person’s “intimate parts,” which include the buttocks, genital area and breasts. Rape is a specific charge for nonconsensual intercourse and can come with a state prison sentence of three to eight years. Battery can be charged as a misdemeanor or felony, based on the severity of the act. Statutory rape — The legal age of consent in California is 18. Because minors cannot give consent, sex with a minor is a crime even when both parties agreed to the act. Punishments depend in part on the age difference between the offender and the victim. Child molestation — The felony offense of  child molestation  result in a prison term of one to 10 years for each offense. Longer prison sentences are given when force is involved, the child is under the age of 14, the adult was the child’s caretaker, or there is a large age difference between the adult and the child. Indecent exposure — An indecent exposure charge can be filed against a person who willfully and lewdly exposes their private parts publicly or who “procures, counsels, or assists” another person to do so. Indecent exposure is a misdemeanor offense. Possession of child pornography — Possessing or sharing a sexual image of a minor is a felony in California, whether that image is on your phone or computer, a print photograph or some other medium. “Sexting” with a minor can also result in a child pornography charge. If you are convicted of a sex crime, you may face a prison sentence of more than a decade and fines adding up to tens of thousands of dollars. Conviction for a sex crime also requires mandatory registration as a sex offender. Registered sex offenders have to report to law enforcement regularly and may be required to inform neighbors of their status. Do I need to return to California, and what are some unusual problems I may face being from another state? Do I have to be over .08 percent (the "legal limit") to be charged with DUI? What are some of the circumstances that may lead to me being charged with a felony? Why am I charged with two violations that sound like DUI charges on my paperwork when I only drove once? 1. I just was arrested for DUI (Driving under the Influence). Can I wait until I go to court to take care of it? No. If you do not apply for a Department of Motor Vehicles (DMV) hearing and a stay of your driver’s license suspension within 10 days after your arrest (even though the hearing itself might be in the future), your California driving privileges will be suspended. The length of the suspension depends on a number of factors, including whether or not you have been convicted of DUI before. This happens even while the criminal case is still pending, even if that case is later reduced to a lesser charge. Back to top 2. Should I apply for a DMV hearing and a stay, or should I have an attorney do so? It is best to have an attorney make the application, just to ensure that it is done correctly. This also sets the hearing on an appropriate date for the attorney's calendar. If that cannot be done, the next best thing would be for you to make that application. Regardless, the application must be made within 10 calendar days. Sometimes, if good cause exists, it is possible to get a DMV hearing, even if application is made after the 10-day window. However, you should never rely on that exception. Back to top 3. What if I am from out of state and do not have a California license? Do I still need to worry about setting a DMV hearing and getting a stay? Yes. You should still apply for a DMV hearing and a stay. It is your privilege to drive in California that is being suspended. If you do not wish that privilege to be suspended, you need to apply for a hearing. In addition, the state that issued you your driver's license may take action against your privilege in that state, depending upon the nature of your suspension in California. This is a technical area for which you should seek the advice of an experienced attorney. Back to top 4. Can these DMV hearings be won? Yes, but not for the reasons you may think. The DMV will not listen to reasons why you need to drive. Its decision will be based only on the evidence presented and the facts. These hearings are highly technical and won on technical issues. Lawyers expert in these  administrative consequences  do have success! But rarely are untrained people representing themselves successful in these hearings. Success depends on a current and thorough understanding of the laws and cases that are relevant. Back to top 5. What will happen to me in the criminal courts if I am convicted of DUI? You could be facing a number of penalties, including: probation a fine a driver's license restriction a minimum "weekender work" jail sentence( for a first offense) increased jail exposure longer school the requirement of placing an interlock on your ignition switch (for multiple offenders) state prison a driver's license revocation (for a serious felony) These penalties are all separate and apart from the DMV action discussed above. Charged crimes in this area can be quite serious with significant state prison exposure. Attorneys not experienced in this field can unwittingly increase the degree of that exposure. Skilled advocate pursues favorable outcomes to impaired driving charges If a California driver’s blood alcohol concentration (BAC) tests at 0.08 percent or higher, he or she will be charged with a DUI. When the driver is younger than the legal drinking age, a BAC of just 0.01 percent can result in that charge. A police officer can make a drugged driving arrest if the driver’s ability to operate a vehicle is impaired to an “appreciable degree.” The penalties imposed for a DUI depend on the level of impairment and the motorist’s record of past DUI incidents, as explained on my DUI FAQ page. Typically, if you are convicted of a DUI in California that does not involve injury or death, you will face the following consequences: First offense — Your license can be suspended for up to six months, and a judge has the option of sentencing you to up to six months in jail. You may also have to pay a fine of up to $1,000. I can seek to have your license restricted rather than suspended, which would allow you to maintain important driving privileges while requiring the use of an ignition interlock device. Second offense — Your license can be suspended for as long as two years, and you may have to spend between four days and one year in jail. You may also be fined up to $1,000. A judge will likely require you to install an ignition interlock device on your vehicle for a certain period of time before you can have your full license reinstated. Third offense — A third offense carries a license suspension of up to three years, along with 120 days to one year of jail time and a fine of up to $1,800. You will have to complete ignition interlock device requirements in order to regain your license. A judge may also order you to participate in a formal program about the dangers of drug and alcohol use. This can be a condition of your probation, which may extend for a period of several years. I defend clients charged with: Possession — Following the passage of Proposition 47 in 2014, simple possession (for personal use only) of a controlled substance is usually charged as a misdemeanor in California.  With the passage of Proposition 64 in 2016, cannabis became legal to use, grow and sell for recreational use by adults in the state, but it gave local governments the power to ban sales in their jurisdictions. Possession with intent to sell — When law enforcement catches a person with a sizeable amount of drugs, this felony charge may apply. The distinction between an amount of drugs considered to be for “personal use” and an amount considered to be for sale or distribution depends on the type of drug. Drug DUI — A first-time charge for driving under the influence of a drug is often a misdemeanor that comes with a license suspension and probation. A second offense may be charged as a felony and may involve jail time. Trafficking — A California court can sentence a person to several years in jail for selling or moving large amounts of a controlled substance. Harsher sentences are available for moving substances farther distances. Possession of drug paraphernalia — It is illegal to own any device used to inject or smoke a controlled substance, with certain exceptions made for hypodermic needles. The defense that’s right for your case may involve a challenge to law enforcement’s actions during a search and seizure, or it may be based on proving that the drugs were for personal use rather than criminal use.
