Eisenberg Jason received a full-tuition scholarship to attend Southwestern Law School due to his excellent college grades and his unusually high LSAT score. While at Southwestern Law School, Jason was at the top of his class and was invited to work on the Mayor of Los Angeles’ Legal Team in City Hall. While working in City Hall, Jason learned the value of making sure that everyone in the community is cared for, regardless of race, gender, or socioeconomic status. Jason uses these valuable lessons in his law practice, as he treats all clients with the utmost respect and attention, regardless of whether their case is big or small. After passing the California Bar Exam on his first attempt, Jason began practicing law at the Law Offices of Gary C. Eisenberg. Our client struck his head on the concrete and suffered a fractured temporal bone. After hiring experts to inspect the property, we learned that the drop off to the adjacent property should have been protected by a barrier, such as a railing or cinder block wall. The defense tried to blame our client’s father for not keeping a close eye on him as he neared the ledge. At first, the defense stated their top offer on the case was $60,000. Knowing our client deserved much more, we filed a lawsuit against the art store and began litigating the case. In discovery, we were able to get the art store to admit that its driver was negligent, that its driver struck our client form behind, that the forklift did not have any lights or sirens on at the time of the incident, and most importantly, that our client was not comparatively at fault for the incident. He then fell asleep in the vehicle as he waited for assistance. While he was asleep, a truck driver swerved onto the shoulder of the highway and struck his vehicle, causing killing him. We recovered the full policy limits of $2,000,000 for the decedent's young son. The defense tried to argue that the decedent and the son were estranged, that they didn't have a close relationship, and that the decedent had health issues and wouldn't have lived for long anyway. We were able to prove that the father and son had a close relationship even though they didn't see each other often. Further, we fought through the defense arguments by putting a documentary together showing the impact the death had on the son, which persuaded the defense to pay the full policy limits of $2,000,000. $1,815,000 Truck Accident - SETTLEMENT - $1,815,000 Truck Accident Settlement Our client was struck by a semi-truck that was changing lanes on the freeway at approximately 5:00 AM in pitch black darkness. The defense tried to argue that our client was speeding and therefore was partially responsible for the crash. We were able to track down an eyewitness to the crash and secure vital testimony to prove that the semi-truck was at fault. Although the defense tried to dispute how injured our client was, we secured a very significant settlement for our wonderful client. $1,500,000 WRONGFUL DEATH - POLICY LIMIT RECOVERY - $1,500,000 Wrongful Death Settlement Our young client went over to a friend’s house to hang out. The friend’s parents were not home, however, the older step-brother was. The step-brother gave our client drugs and our client began to overdose. Rather than call an ambulance, the step-brother put our client in a cold shower and left him there for several hours. Ultimately, our young client died in this tragic event. We immediately made a claim against the homeowner’s insurance policy, however, it was denied. The homeowner’s insurance company argued that the step-brother’s actions were intentional and therefore not covered by the homeowner’s insurance policy. What is my case worth? If an attorney tells you what your case is worth before you’ve completed your medical treatment, you should run for the hills. Your case value is based on several factors, including the amount of property damage to your vehicle, how your slip and fall/trip and fall happened, your injuries and the diagnoses by your doctors, the amount of your medical bills, the type of medical treatment you received, and your pain and suffering. In order to properly get you full and fair value for your case, your attorney needs to know all of these variables before providing you with an accurate case value estimate. Do I have to pay my deductible if someone else hits my car? If the other side accepts liability, you can go through the opposing insurance company to get your car repaired and won’t have to pay your deductible. If the other side accepts liability, often times you can go through your own insurance company and they will waive the deductible and you won’t have to pay it. If the other side does not accept liability, you can go through your own insurance company, pay your deductible, and get your deductible reimbursed once we get the other side to accept liability. Do I still have a case if I have prior injuries? Under California law, you are protected if you have prior or pre-existing injuries. In fact, we will argue that you were more susceptible to injury than the ordinary person due to your prior or pre-existing injuries. California law says that if someone is more susceptible to injury, they must still be compensated just as a normally healthy person would be. Also, California law says that if you have a pre-existing condition that is made worse by an accident, you are entitled to compensation for the effect on that condition. So if you have pre-existing back pain and get into a car accident or have a slip and fall accident and your pain gets worse, you are entitled to compensation for that. Who will be handling my case? Even after filing a lawsuit, the likelihood of going to court is minimal. What happens if I get hit by someone with no insurance? Unfortunately, the number of drivers in California that are driving without insurance is on the rise. Hopefully you have uninsured motorist coverage (“UM coverage”). If you have UM coverage, you can make a claim against your own insurance company and your insurance company will act as the other driver’s insurance. This will allow you to make a claim and get compensated for your medical expenses, property damage, pain and suffering, etc. But don’t worry, making a claim against your own insurance company through your UM coverage will not raise your insurance rates. Should I call the police at the scene of an accident? Yes, you should. The police won’t always come to the scene of an accident unless injuries are reported. Having the police come out to the scene will help lock down who is at fault. The police will usually prepare a Traffic Collision Report and will take your statement, so it is critical that you provide an accurate statement and make sure that the police officers speak to all witnesses to the accident. How do insurance companies try to reduce the value of my case? Insurance companies are notorious for trying to reduce the value of your case by making the following arguments: you didn’t seek medical care soon enough after the accident or injury; you had large gaps between your medical appointments; you complained about certain body parts in the beginning of your medical treatment and then different body parts later on; you didn’t follow your doctor’s recommendations; you didn’t complete your medical treatment; and you had pre-existing injuries. Where is the best place to go right after an accident or injury? Depending on the severity of your injury, you should seek immediate medical attention at the nearest emergency room. If your injury is not as severe or you don’t want to go to an emergency room, you can go to an urgent care or to your primary care doctor. Either way, it is critical that you seek immediate medical attention on the day of the accident or injury, or the day after. What evidence should I gather at the scene of a slip and fall/trip and fall? To start preserving critical evidence right away, you should get the following: photos and video of what you fell on; the names, addresses, and phone numbers of any witnesses to your fall; photos of your injuries; make an incident report and get a copy of it; and get the names and job titles of any store employees that you spoke with or that witnessed your fall. What evidence should I gather at the scene of an accident? To start building your case from day one, you should get the following: insurance information for the other drivers involved in the accident; photos of your vehicle and the other vehicles involved in the accident; names, addresses and phone numbers of anyone that witnessed the accident; photos of the intersection or the roadway where the accident occurred; photos of the license plates of the vehicles involved in the accident; and photos of your injuries. Should I talk to the insurance companies after a car accident? Do not, under any circumstances, speak to the other driver’s insurance company. Let your attorneys take care of that. The other driver’s insurance company is not on your side. Anything you say to them can and will be used against you. Consult an experienced attorney that can handle the communications with the opposing insurance company.
