What Are the Advantages of Hiring a Former Prosecutor? Videos Contact Us Anthony J. Falangetti About Attorney Anthony J. Falangetti Firm Founder With 30 Years of Legal Experience Born and raised in San Pedro, California, Anthony Falangetti is a true Californian through and through. After graduating from San Pedro High in 1986, he set his sights on undergraduate school at the University of California Santa Barbara. In 1991, he graduated with a Bachelor of Arts degree in Philosophy, and Law and Society. In 1994, Anthony received his Juris Doctor from McGeorge School of Law, University of the Pacific, where he graduated with honors. During his time in school, he was a member of the Traynor Honors Society and won the Capitol City Trial Lawyers Association Award for First Honors in Trial Advocacy. After working as a clerk for the Orange County District Attorney’s Office and writing appellate briefs for the Attorney General’s Office for several years, Anthony dove deeper into the legal world and became a Deputy District Attorney. It would be several years before he would transition into a renowned Long Beach criminal defense lawyer. Time as a Deputy District Attorney For 13 years, Anthony worked for the Los Angeles County District Attorney’s Office as a Deputy District Attorney. During his time there, Anthony established a solid reputation in several southern California courthouses, including Torrance, Long Beach, Inglewood, Inglewood Juvenile, and the Criminal Courts Building in downtown Los Angeles (which has now been renamed the Clara Shortridge Foltz Justice Center). Working in the Hardcore Gang Unit During his time as a D.A., Anthony spent nearly a decade working in the infamous Hardcore Gang Unit, where he prosecuted over 40 murder cases — 24 of which were brought before a jury. In total, Anthony tried over 60 felony cases, most of which dealt with murder , burglary , robbery , assault with a deadly weapon , and narcotics possession and distribution. Tackling Slumlord Properties Between cases, Anthony focused his attention on cleaning up the buildings in his home state. Most notably, he worked with the City of Lakewood to clean up more than 90 slumlord properties. He then put together an extensive, three-part training program for landlords within the area, so that they were able to easily understand what laws and regulations they had to follow. From the Law Firm of Anthony Falangetti to West Coast Defense After nearly a decade and a half at the District Attorney’s Office, Anthony decided that it was time to start his own practice — the Law Firm of Anthony Falangetti. With a robust skillset inside and out of the courtroom, Anthony immediately began achieving outstanding results for his clients , with many of his cases being dismissed. After a few years, Anthony changed the name of his firm to West Coast Defense. While our name may have changed, the aggressive representation and fervent passion of our founder still remains. If so, it’s important to contact a criminal defense lawyer to help you. Attorney Anthony Falangetti is highly qualified to defend you in this type of case. As a former prosecutor, he has been highly successful on both sides of the courtroom. Besides the fact that he has over two decades of experience to bring to the table, he has served as a former prosecutor. Mr. Falangetti understands how the prosecution gathers evidence and presents their cases. You will want this high-quality level of legal assistance due to the possible severe penalties for a crystal meth drug conviction. Drug Crimes Involving Crystal Meth Crystal meth (or methamphetamine) is a controlled substance, meaning only medical professionals can prescribe it. It is illegal to possess it without a prescription, and only medical professionals are allowed to sell it within the parameters of California’s drug laws. Any violations of these laws will constitute illegal possession or illegal possession with intent to sell. A conviction of these charges can result in a prison sentence and fines. There are certain stipulations that a prosecuting attorney must prove in order to convict you of possession. As a defense attorney, Anthony Falangetti knows how to find the weaknesses in the prosecutor’s case. For example, he might be able to prove it belonged to someone else, or that you had a prescription. Whatever the facts are, you can trust that he will be zealous in pursuing every avenue available to have your charges reduced or dismissed. Videos Contact Us DMV Hearings Southern California DMV Hearing Attorneys Long Beach DMV Hearing Attorney Being charged with DUI and facing the prospect of sitting in a courtroom facing a judge in order to defend yourself may be very stressful, even embarrassing. This is not the only issue you need to address. It is necessary to take immediate action if you’ve been arrested to avoid losing your driving privileges for an extended period. The DMV Hearing Process When a driver is arrested on suspicion of driving under the influence (DUI) or driving while intoxicated (DWI), the Department of Motor Vehicles (DMV) machinery is automatically put into motion to suspend all driving privileges . If this is a first offense, the suspension may only be for a 4 month period; however, if this is a second or subsequent offense the suspension period becomes longer. There are additional requirements to be met, such as attending alcohol education classes, before driving privileges are restored. A DMV hearing must be requested within 10 days or the suspension will automatically be effective. An experienced DMV hearing attorney with an intimate understanding of the hearing process can fight to protect your driver’s license from further suspension. In a DMV hearing, your driving privilege hangs on three issues: While driving was your blood alcohol level at 0.08% or higher? Were you lawfully arrested? Did the law enforcement officer have reason to believe you were DUI? In an administrative hearing, the reports of any tests and the arresting officer are taken as sufficient evidence for suspension. An experienced criminal defense attorney is needed to expose any flaws in test results and demonstrate any failures to meet standard procedure requirements. What Are the Advantages of Hiring a Former Prosecutor? Videos Contact Us Prostitution Southern California Prostitution Attorneys Defending Against Prostitution Charges in California Prostitution is a misdemeanor criminal offense under California state law, which is punishable by up to six months in jail and a fine of $1,000. In addition to this sentence, anyone who is convicted will end up with a criminal record that may come up in the future during interviews for employment or on a rental application. Understanding Prostitution Charges in California Even if the alleged perpetrator is not convicted, the simple fact of being arrested for this sex crime can have a devastating impact on one’s social and professional reputation. If you have been charged with prostitution, it is in your best interests to hire a Long Beach criminal defense lawyer as soon as possible to help you minimize the damage to your reputation and to help you avoid the serious consequences of a conviction. Prostitution is defined as engaging in sexual acts in exchange for money or remuneration. In California, this can be charged against the prostitute and customer (the “john”). In order to secure a conviction, it is not necessary for the prosecutor to prove any type of sexual activity actually took place or there was an exchange of payment. All that is required is proof that you either made or accepted an offer and did intend to carry through on the offer. Come to West Coast Defense, where we understand how important it is for you to handle this situation quickly and discretely and are ready to put our years of experience as prosecutors to work for you. Defenses Against Prostitution Charges Defending against a charge of prostitution can be difficult, given that the arrest is often made while the act is being performed and under circumstances that make it clear that it is prostitution rather than merely being an instance of consensual sex. In other situations, the defendant is the victim of a sting operation in which an undercover police officer poses either as a prostitute or as a john and entices the defendant into committing the necessary elements of the crime. Such cases are often surveilled, which provides additional evidence. It may be possible to prove that the police used entrapment, which consists of pressuring, harassing, or otherwise compelling the defendant to commit the crime when he or she would not otherwise have done so. In other cases, the strategy depends on demonstrating that there simply is not enough evidence to prove that an exchange of payment took place or that either party offered or accepted payment for sex. The key to beating the charges is to retain legal representation immediately so your attorney can begin investigating the case and building a defense. Arrested for shoplifting? Turn to our Long Beach shoplifting lawyer for defense. Contact us today! Penalties for Shoplifting in CA Under state law, shoplifting is a petty theft crime offense that occurs when the value of stolen goods is no greater than $950. It includes not only concealing an item in a bag or under clothes with the purpose of smuggling the item out of a store, but also altering or removing a price tag or magnetic anti-theft device. If you are convicted on the charges, you can be sentenced to pay a $1,000 fine and serve up to 6 months in jail, as well as being placed on probation for several years. In cases where the stolen goods were of low value, it may be possible to negotiate with the D.A. to have the misdemeanor reduced to an infraction. This type of reduction is based on the fact that shoplifting is a “wobbler,” an offense that can sometimes be addressed in this way. One of the most common defenses to a charge of shoplifting is to allege the defendant simply did not have the intention of stealing the item. If, for example, it was in a purse or other open bag, it might be possible to argue that you merely placed it there with the intention of paying at the cash register, but then forgot about the item. Fight Your Shoplifting Charges. Call 949-603-2446 for a Free Consultation. There are other approaches such as using evidence that demonstrates that you had reason to believe that you had a right to take the item or that it was already yours, or even that you have been falsely accused. Even if it is not possible to prove your innocence, a Long Beach shoplifting attorney may still be able to have the penalties reduced by negotiating a plea bargain. The key is to take action now. Understanding the Categories of Homicide in California Homicide is the unlawful taking of the life of another either through murder or manslaughter. The charge of manslaughter means there was no malice (active ill will or a wish to hurt others) involved in causing the death. Murder is defined as follows: Loss of life resulting from an intent to commit any felony Loss of life resulting from conduct with a “depraved heart” (showing a lack of concern for human life) Loss of life as the result of an intention to cause grievous injury Whether the charge is Murder in the First Degree (premeditated) or Murder in the Second Degree (not premeditated), conviction can result in life imprisonment and under “special circumstances” such as killing a judge or police officer, may result in the death penalty. Effective defense against any homicide charge involves taking an aggressive approach to prove the prosecution’s facts are in error and our client is innocent. Videos Contact Us Breath & Blood Tests Southern California Breath & Blood Test Attorneys DUI Defense Attorneys in Long Beach, CA If a police officer notices your car is swerving, smells like alcohol, or contains open alcohol bottles, he or she may suspect that you are driving under the influence (DUI). To determine this, an officer may ask you to take a breathalyzer or a blood test. A breathalyzer is a device that measures the amount of alcohol in your system based on a breath sample, while a blood test samples your blood to determine your blood alcohol content (BAC). Though breathalyzers are far more common, on-the-spot blood tests are performed as well. In every state, a .08% or above BAC level is grounds for a DUI and you will be arrested. Driving under the influence of alcohol has severe consequences in California. A first-time offense is punishable by up to six months in jail, a fine, points on your license, attendance at an alcohol treatment class, and/or a restricted license. Even if you failed your breathalyzer test, you can still challenge the results. Contact our knowledgeable Long Beach DUI defense lawyers today. For a free consultation on how to challenge DUI test results, call 949-603-2446 . The Fault in Breathalyzers and Blood Tests In most drunk driving cases, breathalyzers and blood tests are they key piece of evidence that will be used against you. But, despite what many people think, breathalyzers and blood tests are not foolproof. A breathalyzer can be broken, old, or calibrated incorrectly. It can also read a person’s psychological condition as a false positive for alcohol. Blood tests can be contaminated, preserved incorrectly, or mishandled. If any of these happen, you could be going to jail for a crime that you did not commit. Know and Protect Your Rights as a Driver With law enforcement cracking down on drunk and ‘buzzed’ driving, it’s more important than ever that you have the right legal representation at your side when facing a DUI charge. What Are the Advantages of Hiring a Former Prosecutor? Videos Contact Us Fourth of July DUI Southern California Fourth of July DUI Attorneys Getting a DUI on July 4th The 4th of July can be a wonderful time of celebration with family and friends. It is only natural that you have a drink or two at a barbecue or to accompany a fireworks show. You do not want to let that bit of fun turn into a DUI charge , much less a DUI conviction that can seriously affect your life. If you are confronted with such a situation, we can help clear your name. During holiday weekends, law enforcement are on heightened alert for drivers who are operating their vehicle under the influence. An officer can only pull you over with a justified reason, such as a traffic violation; but during the 4th of July, they may be overzealous in looking for intoxicated drivers. Their reasoning, or lack thereof, behind pulling you over may be unjust and in turn potentially negate your DUI charge. Sobriety Checkpoint Discrepancies Even if you are stopped for a valid reason or at a sobriety checkpoint in Newport Beach, the officer can only test your blood alcohol content (BAC) if he or she has reason to suspect that you are under the influence. This entails probable cause such as an open container of alcohol in the front seat, slurred speech, or an odor of alcohol. Once you are asked to take a field sobriety test , the results can be highly unreliable. Certain medical conditions and physical factors can affect the accuracy of these tests. If you have been stopped without justification at a DUI checkpoint in Redondo, Huntington Beach or along PCH, do not hesitate to get in touch with our office. Even chemical tests can yield dubious results. For example, you may have started driving with a legal BAC level under 0.08 percent, but it can take a while for your body to absorb alcohol. This means that after some time on the road, your BAC may actually spike, leading to inaccurate results to chemical tests. Instruments that have not been properly calibrated or cleaned, or a poorly administered test can all skew test results, causing you to wind up with an unjust DUI charge. Getting a 4th of July DUI in Torrance, Newport Beach, Redondo, or Long Beach could end up on your record permanently. Do not let that happen, but retain exemplary legal advocacy immediately. False Charges Can Still Have Serious Consequences If you land a mistaken DUI charge, the consequences can be extremely serious. You could be jailed, imprisoned, and face hefty fines. Even worse, a conviction would be a blemish on your record that any potential employer, landlord, or bank could see. Do not let your innocent actions lead to a loss of freedom and reputation. You cannot afford to have second-rate representation when the rest of your life is on the line. When you need hard-hitting defense, our Long Beach DUI defense lawyer at West Coast Defense can help. What Are the Advantages of Hiring a Former Prosecutor? Videos Contact Us Child Molestation Southern California Child Molestation Attorneys Defense for Child Molestation Charges in California There have been a steady stream of shocking news stories about child sex abuse scandals involving priests, Boy Scout troop leaders, sports coaches, and others. It is also becoming increasingly common for the victims to come forward with allegations that may result in criminal and civil action against the alleged accuser. As a result, there is even greater public outrage at reports of this serious sex crime, and if you have personally been accused, it is utterly vital that you take defensive action now to protect your reputation, clear your name, and avoid the harsh consequences you could face if convicted of the charges. Elements of Child Molestation as a Crime Child molestation charges are normally filed as Lewd Acts with a Child. To prove your guilt, the prosecutor will have to establish that you touched or fondled the alleged victim with the purpose of achieving sexual arousal or gratification. It is not necessary to prove you actually touched the child’s sexual organs; the contact may have been through clothing. All that is necessary is that the contact was intentional and that it was sexual in nature. If you are convicted of child molestation, you can receive felony criminal penalties including several years in state prison. The severity of the sentence depends on factors including the age of the child, whether you are accused of using force, whether the child was injured, whether the molestation occurred in a single isolated incident, or if it was a series of repeated episodes, and whether you have previously been convicted. Contact West Coast Defense Upon release from prison, you would be required to register for life as a sex offender , meaning that local law enforcement agencies would have the right to actively notify the community of your presence and the nature of your conviction. In addition, your information and home address would be included on the California Megan’s Law website. There is far too much at stake in this situation for you to take any risks with the outcome of the case. Videos Contact Us Understanding Your Legal Rights Understanding Your Legal Rights The Right to Remain Silent There are countless cases in which individuals severely damaged their own defense case by making statements to police. When the law specifically provides you with the “right to remain silent” it is critical that you do so. Even discussing your case with a friend, family member or any other person can result in severe damage to the upcoming defense of your case. In many cases, these phone conversations are recorded and you may find yourself in even more legal difficulty if you do so. It is critical that you protect your rights and remain silent. A Long Beach criminal defense lawyer from our legal team will fight for your rights from the moment you are arrested. Do not make any statements to law enforcement Do not discuss your case with anyone Do not trust that you are being told the truth Do not answer any questions without an attorney present Hire a qualified criminal defense lawyer You Have the Right to Have Legal Representation Who you select to protect you is an important choice. It has been proven thoroughly that the defense attorney that supports you has much to do with the outcome of the trial. Not all attorneys have the talent in the courtroom that can lead to a favorable outcome. West Coast Defense has outstanding courtroom experience and abilities and can present your case to the jury in a compelling and aggressive manner. Don’t Assume Law Enforcement Plays by the Rules There are often cases in which the rights of the accused have been severely violated when overzealous law enforcement does not follow the correct and legal procedure, often failing to adhere to the constitution in search and seizure. When such violations of your rights are discovered, you can be certain that the legal team will fully address the matter in court. In other cases, the client suffered from excessive force and was treated outrageously by law enforcement. These cases must be fully exposed in court and law enforcement attacked for their violations of your rights. No matter how serious you may consider your case, we can provide you with the powerful defense that is needed when facing the criminal justice system in the courts of Los Angeles County, Orange County and throughout Southern California. Request Your Free Consultation Today! When arrested and charged with a serious crime, it is crucial that you know your rights. Even if you are only under investigation for a serious crime, protecting yourself is an urgent matter; when under investigation you can expect that you will be arrested within a short period of time. Answering questions by law enforcement is dangerous. What Are the Advantages of Hiring a Former Prosecutor? Videos Contact Us Should I Discuss My Case with the Police? Should I Discuss My Case with the Police? If you’re arrested for a crime in the state of CA, it is critical that you do not do an interview with the police department or investigator. This is a general rule that anyone in the criminal practice follows, but it is critical that clients are aware of this as well. If you are arrested for a crime, you should not give a statement to the police or the prosecuting attorney. This does not mean that you should not cooperate with the police. We say this because in the United States of America, one of our sacred rights is the right to not incriminate ourselves. The right to stay silent. Failing to do this often leads to prosecution. What Can Happen If I Get Interviewed by the Police? Often, when law enforcement want to interview you, they request you to explain your side of the story. The reason behind doing this is that they do not have the evidence at that point to charge you with a crime. They are looking to get that evidence through their questions. Exercising Your Rights As an American citizen, it is your constitutional right that you do not have to answer the police to gather evidence against you. Your lawyers also do not have to help the police to gather evidence against you. It is the police and the prosecutor’s job to prove their case beyond reasonable doubt. Furthermore, the right to remaining silent is precious to us because, far too often, innocent statements made by the accused, can still be used against them. Statements that may be completely innocent, might be used to corroborate a case against them when joined up with other evidence and testimony. It is not your obligation to speak to the police. It is your obligation to be cooperative and polite, but you have the constitutional right to remain silent. Exercise that right and protect your liberty. Contact Us For Your Free Consultation Here at West Coast Defense, our advice to you is to protect your liberty and remain silent. You also need to make sure that you retain qualified legal counsel that specializes in criminal defense. Contact us at 949-603-2446 to schedule a no-cost legal consultation. What Are the Advantages of Hiring a Former Prosecutor? Videos Contact Us Truck Accidents Southern California Truck Accident Attorneys Truck accidents can be some of the most devastating and complex cases in personal injury law, often resulting in catastrophic injuries or fatalities due to the sheer size and weight of commercial trucks. If you or a loved one has been injured in a truck accident, you need experienced legal representation to protect your rights and secure the compensation you deserve. At West Coast Defense, our dedicated team of truck accident attorneys understands the challenges these cases present and is committed to fighting for justice on your behalf. Why Truck Accident Cases are More Truck accident cases are far more complex than standard car accident claims because they often involve multiple parties, extensive regulations, and unique evidence. Commercial trucks are subject to strict federal and state trucking laws, including rules set by the Federal Motor Carrier Safety Administration (FMCSA), which govern driver hours, vehicle maintenance, and cargo weight limits. Violations of these regulations can contribute to accidents and require a thorough investigation to uncover. Additionally, liability in truck accidents can extend beyond the truck driver. Trucking companies, vehicle manufacturers, cargo loaders, and maintenance providers may also share responsibility, making it essential to identify all liable parties to maximize compensation. Evidence like black box data, driver logs, maintenance records, and cargo manifests must be preserved and analyzed quickly, as trucking companies and insurers often attempt to limit their liability. An experienced truck accident attorney understands these complexities and knows how to navigate the legal process to hold all responsible parties accountable. At West Coast Defense, we have the skills, resources, and determination to investigate your case thoroughly, handle aggressive insurance companies, and pursue the full compensation you deserve. Truck accidents are not ordinary cases—they require extraordinary legal advocacy. Let us stand by your side and fight for the justice and financial recovery you need to rebuild your life. Specific California regulations can add further layers of complexity to truck accident cases, particularly due to the state’s stringent safety standards and its role as a hub for commercial trucking. These regulations often overlap with federal laws, requiring experienced attorneys to navigate both sets of rules when handling truck accident claims. Common Causes of Truck Accidents Truck accidents often stem from a combination of human error, mechanical issues, and regulatory violations. One of the most frequent causes is driver negligence, which includes distracted driving, speeding, impaired driving, and fatigue. Fatigue is particularly common in the trucking industry, where drivers may exceed federal hours-of-service limits due to pressure to meet delivery deadlines. When drivers operate while exhausted, their reaction times and decision-making abilities are severely compromised, putting everyone on the road at risk. Other causes include mechanical failures such as brake malfunctions, tire blowouts, or engine issues, often resulting from improper maintenance. California’s strict vehicle maintenance and inspection laws require trucking companies to ensure their fleets are safe for operation, but shortcuts are sometimes taken to save time or money. Improperly loaded cargo is another significant factor, as uneven or overweight loads can cause trucks to tip, jackknife, or lose control. Additionally, hazardous road conditions, such as debris, construction zones, or poor weather, further increase the likelihood of an accident, especially when trucks are poorly maintained or operated recklessly. Who Can Be Held Liable in a Truck Accident? Determining liability in truck accidents is complex because multiple parties can contribute to the crash. The most obvious liable party is often the truck driver, whose negligence—such as distracted driving, fatigue, or impairment—may have directly caused the accident. However, the driver may not be the only party responsible. Trucking companies are frequently held liable, especially if they failed to enforce safety protocols, pressured drivers to meet unrealistic schedules, or neglected proper vehicle maintenance.
