The complaint is investigated by the agency or investigators from the Department of Consumer Affairs. If the complaint does not allege a violation of law, the case may be closed without investigation. If the complaint alleges unprofessional conduct or a violation of law, the case will be forwarded to an investigator working on behalf of the agency for investigation. All complaints are confidential and the licensee may, or may not, be contacted during the investigation. Investigation Of Complaint The complaint is assigned to an investigator for the licensing agency. With respects to the California administrative law outline in Alameda County, many agencies utilize Department of Consumer Affairs investigators to review complaints. The investigator may interview witnesses, subpoena documents, and seize property in conducting his or her investigation. If the licensee is contacted, an investigator typically either requests a meeting or conducts an unannounced visit in which the licensee is asked to provide verbal or written responses regarding the complaint. It is important to realize that while a licensee is required to cooperate throughout an agency investigation, if the investigator does not have a search warrant, the licensee is not required to provide documentation or responses at this initial contact without understanding the nature of the complaint and an opportunity to prepare a response. If an investigator appears unannounced and asks the licensee to provide patient charts, business documents, or respond to questions, the licensee may decline to respond and instead advise the investigator that he or she will have an attorney contact the investigator. This allows the licensee to work with an attorney to prepare a complete and accurate record. Failure to make any response to an investigator may result in additional charges being alleged in regards to the California administrative law outline in Alameda County. Investigator Report And Recommendation Case Closed. The California administrative law outline in Alameda County requires a copy of the complaint and investigation will be retained in the agency’s file on the licensee. The agency may contact the licensee and inform him or her that the case has been closed. If the agency receives a further complaint, the case may be reopened. The agency may contact the licensee to encourage resolution of the complaint without further agency intervention. Failure to resolve the complaint within certain timelines may lead to further agency action. Forward the complaint to Department of Justice or agency legal staff and instruct its attorney to begin disciplinary action. Citation Filed Against Licensee Most agencies are authorized to issue citations and fines against licensees for minor or technical violations of law. If the agency elects to issue a citation against your license, you will be notified. A citation is a public document that lists all of the alleged, unproven, violations. The agency will post the citation on its website where it is accessible by patients, customers, and all institutions regulating your profession. Citations may be appealed by submitting a written appeal to the agency with evidence and argument as to why the citation is not accurate or deserved. To provide the best possible argument and evidence, and to ensure that you are not making any unintentional admissions, it is best to retain legal assistance in the preparation and filing of the appeal. After an appeal is filed, the agency may dismiss or uphold the citation. If the citation is upheld, you may resolve the matter by agreeing to the citation and paying the fine or, you may continue to appeal the citation and request a hearing before an administrative law judge. The citation and its resolution will remain on the agency’s website and is accessible to the public. Accusation Filed Against Licensee If the agency believes a licensee has committed a violation of the law that cannot be resolved at the citation level, it will forward its investigative report to an attorney with instructions to file an Accusation seeking discipline. In regards to the California administrative law outline in Alameda County, some agencies have their own attorneys, such as the Department of Social Services and the Department of Insurance. Others, such as all of the healthcare boards, utilize the legal services of the Department of Justice and are represented by a Deputy Attorney General. Once the Accusation is filed, you will have only 15 days to file a Notice of Defense, the form that advises the agency you are requesting a hearing on charges in the Accusation. If you fail to file the Notice of Defense within 15 days, the agency will revoke your license without providing you with an opportunity to defend against the charges. For this reason, it is critical that you retain legal representation immediately upon receiving an Accusation. The Accusation phase of the disciplinary process usually takes several months. During this period, your attorney will work closely with you in developing a defense to the charges against you and will attempt to negotiate a resolution of your case in an effort to avoid the emotional and financial expense of a contested administrative hearing. With respects to the administrative law outline in Alameda County, all agencies have the authority to settle a case before hearing and a majority of cases are resolved during the settlement process via a stipulated agreement. The conditions and terms of the stipulated agreement depend upon the strength of the evidence rebutting the charges. Attorneys representing licensing agencies are specialists in licensing law. Along with the Accusation, you will also receive a Request for Discovery. Both the agency and the licensee are required to submit discovery to the other party. Discovery includes all evidence that is relevant to the charges contained in the Accusation. Your attorney will obtain discovery from the agency that includes the agency’s investigative and expert reports, witness statements, and any other available evidence the agency intends to present at the hearing to prove the charges. Your attorney will work closely with you to prepare your evidence that will be submitted in rebuttal of the charges. Your attorney may choose to file a Special Notice of Defense or other Motions in Limine if the Accusation fails to comply with the law or if other irregularities in the filing of charges or in obtaining evidence are identified. The Firm has actively and aggressively represented the owners and administrators of family child care homes, childcare centers, foster family homes, adult residential facilities, adult day programs, and residential facilities for the elderly. The Department of Social Services is one of the largest agencies in the State and, through its Community Care Licensing Division (CCLD) , is responsible for the licensing and regulation of over 85,000 facilities. This includes making facility information available to the public online. Interaction with the CDSS and CCLD can take a variety of forms, such as periodic or annual facility evaluations, complaint investigations, noncompliance conferences, and license disciplinary actions. It is important that licensees fully understand their rights and responsibilities in each of these situations. The experienced legal team at Gould, Hahn, & Reinhardt has a long history of working with CDSS and CCLD personnel and understands the importance of maintaining a productive relationship between licensees and agency staff during these critical interactions. The licensing and operation of Department-licensed facilities is governed by numerous statutes and regulations, including those found in the Health & Safety Code and the California Code of Regulations. It is the licensee’s responsibility to understand and comply with these rules, as well as be aware of the frequent legislative changes in the law. Gould, Hahn, & Reinhardt is familiar with the applicable regulations and statutes concerning Department-licensed facilities and can assist licensees in understanding the law and ensuring compliant operation. When the CDSS or CCLD believe a facility or their staff have failed to comply with the applicable regulations and statutes, Licensing may issue citations or notices of deficiency, civil penalty assessments, and in some cases disciplinary actions to revoke a license or certificate. Defending licensees and administrators against these allegations require a specific and specialized understanding of the law, as well as familiarity with the licensing personnel responsible for ensuring regulatory compliance. Citations And Notices Of Deficiency When a Community Care Licensing staff, typically a Licensing Program Analyst (LPA), believes a licensed facility has not complied with a law or regulation, he or she will issue a citation or notice of deficiency. When issuing a citation, the LPA is required by law to describe the deficiency, including the statute or regulation violated and the specific area of the facility or way in which the deficiency occurred. Citations may be the result of either an annual visit, an unannounced visit, or the investigation of a specific complaint. A facility’s record of citations is available to the public and may eventually form the basis for a disciplinary action to revoke the facility’s license. As such, it is very important that licensees fully understand the appeal process and their rights. Citations must be appealed within fifteen business days of the date the citation is issued. While licensees are entitled to two levels of appeal, CCLD may refuse to review an appeal that is not filed within the brief and strict time period. Using our specific knowledge of Title 22 of the California Code of Regulations as well as other applicable law, Gould, Hahn, & Reinhardt can prepare and file citation appeals on behalf of licensees to ensure that a complete and accurate record is created and their right to an appeal is preserved. This is why it’s important that you hire an expert social services lawyer! Assessment Of Civil Penalties Licensees may also be required to pay civil penalties when citations are issued. When conducting a licensing evaluation or complaint investigation, CCLD personnel are authorized to issue fines for serious or repeated deficiencies. In some cases, civil penalties can amount to an assessment of thousands of dollars, and failure to pay these fines may be grounds for the filing of an Accusation to revoke a facility’s license. The Filing Of An Accusation In some cases, the Department will file an Accusation seeking the revocation of a facility license or administrator certificate, as well as an exclusion action preventing an individual from being present in or employed by a Department-licensed facility. An Accusation contains all of the unproven allegations of wrongdoing upon which the Department will proceed. The Accusation is a public document and is available to your clients, family members, the public at large, and all State and Federal governmental agencies. When an Accusation is filed, the Department will notify the licensee by Certified Mail. The licensee then has a limited window in which to respond. A licensee has only fifteen days to file a Notice of Defense requesting a hearing on the allegations contained in the Accusation. If the licensee does not receive the Accusation and/or does not respond to the Accusation, the Department will issue a default Decision and Order revoking the facility’s license without a hearing. It is extremely important that licensees pay close attention to all mail or Certified Mail delivery notices. If you receive an Accusation from the Department, please contact our office immediately. This severe disciplinary action requires both an immediate response and competent and experienced legal counsel. Settlement Negotiation Process The Accusation phase of the disciplinary process usually takes several months. During this period, Gould, Hahn, & Reinhardt will have an opportunity to negotiate a resolution of your case in an effort to avoid the emotional and financial expense of a contested administrative hearing. The Department has the authority to settle your case before hearing and many cases are resolved during the settlement process. Your Social Services Lawyer at Gould, Hahn, & Reinhardt will work closely with you to present the facts of your case that justify your right to a fair settlement. After evaluating your evidence, your attorney will negotiate directly with the Department’s attorney in an effort to reach a settlement agreement resolving the case. If the Department offers terms and conditions of settlement that are satisfactory, the case will be settled without the need for an administrative hearing. If the Department fails to offer acceptable settlement terms, the case will proceed to the hearing. Representation At An Administrative Hearing Determining whether to proceed to an administrative hearing is a significant decision that you must carefully consider in consultation with your experienced licensing attorney. The hearing is held before an administrative law judge (ALJ) alone. There is no jury.  The ALJ does not, however, have the final authority in administrative law. The Board of Pharmacy has a length investigative file with very severe statements from staff that client was seen removing bottles of meds with no apparent pharmacy purpose. Pharmacy came to recognize substantial inventory discrepancy and tried to blame loss on client. Pharmacy created cover video of client allegedly removing inventory. Three-day hearing resulted in successfully attacking accuracy of video surveillance and the Board’s investigation and ultimately complete acquittal for client, withdrawal of accusation. Insurance The Departments of Insurance filed an Order of Summary Revocation in which the client’s license was revoked without a hearing based upon an allegation that the client’s FINRA membership status constituted cause to discipline his California insurance license. Filed a Petition for Reconsideration client’s behalf and successfully argued that the Department of Insurance misinterpreted the FINRA action and misapplied the Insurance Code. The Department of Insurance responded by issuing an Order Granting Reconsideration in which the Summary Revocation was vacated and client’s license was reinstated. ARF Operator Client license and operator of eight adult residential facilites for the developmentally disabled. Facing a 20-page Accusation seeking the revocation of all facility licenses, the revocation of client’s Administration Certificate, and an exclusion from all licensed facilites. Originally set for a ten (10) day Administration Hearing, the case eventually went to eleven (11) days of Hearing. Client retained all licenses, subject only to probationary restrictions for operating. Client continues to operate today. Reinhardt Managing Partner Prior to forming the Firm, Mr. Reinhardt spent several years working for the Law Office of Gould & Hahn. Beginning in 2011, he worked directly with Mr. Hahn as a legal assistant, gaining a wealth of experience about the unique challenges that licensed professionals and businesses face, while at the same time developing his knowledge of the specialized area of administrative law. After being admitted to the California State Bar and he was promoted to the role of Associate Attorney and continued his work with the Law Office. In 2020, Mr. Hahn and Mr. Reinhardt formed Gould, Hahn, & Reinhardt, and Mr. Reinhardt assumed his current role as a Partner with the Firm. Mr. Reinhardt assists clients through all stages of the license disciplinary process and has experience advising a wide variety of licensees. In addition to his work with professional licensees such as registered nurses, contractors, and real estate brokers, he is very familiar with licensed community care facilities including child care centers, adult residential facilities (ARF), and residential care facilities for the elderly (RCFE). Mr. Reinhardt is able to use his familiarity with Title 22 of the California Code of Regulations and Community Care Licensing to assist facility operators in resolving issues quickly and effectively. Before moving to the Bay Area, Mr. Reinhardt obtained a Bachelor’s Degree in Political Science from Miami University in Oxford, Ohio. Mr. Reinhardt completed his Juris Doctorate at Golden Gate University in May 2016, where he was an Associate Editor of the GGU Law Review. Prior to joining the team as an Associate Attorney, Ms. Pietrantoni worked directly with Mr. Hahn and Mr. Reinhardt as a legal assistant for several years, gaining invaluable experience and knowledge in the specialized area of administrative law. During this time, she was able to assist the attorneys in the successful resolution of numerous disciplinary actions and become familiar with how different Boards and regulatory agencies operate. Ms. Pietrantoni assists clients through all stages of the license disciplinary process and has experience working with a wide variety of licensees such as nurses, real estate brokers, dentists, physicians, engineers, geologists, psychologists, and licensed marriage and family therapists. In addition to her work with professional licensees, Ms. Pietrantoni also has experience walking clients through all stages of disciplinary proceedings involving licensed community care facilities such as residential care facilities for the elderly and child care centers. As an associate attorney, she works closely with Mr. Reinhardt and Mr. Hahn to achieve the best possible outcome for her clients. Prior to joining Gould, Hahn, & Reinhardt as a legal assistant and, more recently, an Associate Attorney, Ms. Pietrantoni worked as an immigration attorney in San Francisco representing clients in removal proceedings, asylum interviews, and bond hearings for detained immigrants. Ms. Pietrantoni, who is fluent in Spanish, was born and raised in Puerto Rico, where she completed her undergraduate studies and went on to obtain her Juris Doctorate at the University of Puerto Rico School of Law in May 2016. During law school she studied abroad in Belgium at the University of Antwerp, where she earned a certificate in International and European Legal Studies. She also spent time as a legal intern at the Chicago Lawyers Committee for Civil Rights Under Law, where she worked on a broad range of civil right issues, including voting rights, housing discrimination, and employment discrimination. Is it important that I retain an attorney that lives in my area? To avoid having your professional license revoked, you need administrative law consultants that know the laws of your area. All California licensing agencies have offices located in Sacramento. Some agencies also have local offices as well. In many cases, Gould, Hahn, & Reinhardt has been able to assist individuals in reinstating their licenses. Depending on how long it has been since your license was revoked, the Firm’s business law attorneys will discuss what steps are available to you. If you have already had your professional license revoked, you may still have an opportunity to appeal. Nearly all licensing agencies have rules governing the reinstatement of a revoked license. Knowing what these rules are and the criteria the agency uses to determine whether to reinstate a license is critical to any successful reinstatement petition. If I have two licenses from different agencies and one is revoked, should I worry about my other license? This situation arises when a person holds the same type of license in more than one state or two different licenses in the same state. Depending on the types of licenses you have, you may be required to report the revocation immediately or when you renew your license. Some agencies require you to notify them within a certain time frame if any discipline is taken against any license that you hold or if you have had your professional license revoked. Failure to notify the agency constitutes a further basis for discipline. Other agencies require you to disclose disciplinary actions in your renewal application. In either case, a license revocation may trigger an investigation by the renewing agency and will likely result in the filing of disciplinary charges against your other license. For these reasons, it is very important to speak with one of Gould, Hahn, & Reinhardt’s experienced attorneys immediately if you have more than one license and have been the subject of disciplinary action. Will my licensing agency file a disciplinary action against me if I am convicted of a crime that is unrelated to my professional license? It depends upon the licensing agency and the conviction. Licensing agencies have the authority to file a disciplinary action when they believe a conviction constitutes “unprofessional conduct”. Each agency interprets laws defining unprofessional conduct differently, and many consider the conviction of a crime to be unprofessional conduct, even if the conviction is unrelated to your profession. Many different types of convictions can result in disciplinary action against your license. If you have been convicted of a crime or have been arrested and your criminal case is still pending, you should contact Gould, Hahn, & Reinhardt immediately to discuss how the criminal action may affect your license. This is best to do right away to avoid having your professional license revoked with administrative law consultants. Do I have to tell my licensing agency that I have been convicted of a crime? If you have been convicted of a crime, you will likely need to report it to your licensing agency within a certain period of time or disclose the conviction when you renew your license. When renewing your license, most licensing agencies have a renewal form that asks whether you have had a criminal conviction since your last renewal. If you have been convicted of a crime, you will need to answer “yes” to this question and provide the agency with an explanation. It is very important to retain counsel when preparing this explanation. Some agencies have a further requirement that you notify the agency within a certain timeframe after your conviction. Failure to disclose a conviction during renewal or failure to report within the required timeframe can constitute grounds for further disciplinary action including having your professional license revoked. The criminal court also has the authority to contact your licensing agency regarding your conviction and in some cases, the Deputy District Attorney will contact the licensing agency when criminal charges are filed and before the criminal case has been resolved. I have been talking to the agency’s attorney and am afraid that getting my own attorney will make it harder for me to resolve the case. Is this true? No. In the many years we have been representing licensees, we have found that licensees obtain a better result if they are represented by experienced administrative attorneys. Licensing boards, bureaus, and departments are represented by attorneys who specialize in the statutes and regulations of the licensing agency. These attorneys are instructed to file disciplinary actions against licensees seeking the revocation of their license. These attorneys represent the best interests of the agency and cannot advise you. It is important that you retain your own administrative law consultants whose sole loyalty and responsibility is to you and who is as familiar with administrative law as the agency’s attorney. Too many times licensees give up their license or accept unnecessarily harsh probationary conditions because they are not aware of their rights.
