The Housing Commission does not guarantee that the public’s Zoom access will be free from interruption or technical difficulties. Should Zoom not be available, the Chairperson may, at his/her discretion, continue the meeting in person if no Housing Commissioner is participating in the meeting through teleconference.  If a Housing Commissioner is participating in the meeting through teleconference, and Zoom access is interrupted, then the Housing Commission shall take no further action in open session until Zoom access is restored.  In-person attendees who wish to speak on a matter are invited to  request a speaker slip from the Housing Commission Secretary, fill it out, and return it to the Secretary as soon as possible. Not reporting someone that has moved out of the unit Renting out the assisted unit, or a bedroom in the assisted unit, to someone else Falsifying documents or signatures. Do you know an HCVP Landlord who is… Soliciting and/or receiving extra rent on the side Renting to relatives without approval from HACA Accepting payment from HACA for a vacant unit, or a unit in which the program participant no longer lives Living in the same unit as the family. If you do, you know someone who is committing housing fraud Housing fraud is any action or failure to act that allows a Section 8 Housing Choice Voucher Program (HCVP) participant, or HCVP landlord to receive benefits for which the person doesn’t qualify. A person who knowingly withholds information, fails to report a change in the family’s circumstances, or otherwise engages in activity prohibited by program regulations, is a benefit thief–stealing benefits from families in need who legitimately qualify for them. The vast majority of families receiving housing assistance from HACA, and HCVP landlords, are honest and follow program rules. Regardless, HACA is committed to the integrity and effectiveness of its housing programs and operations. This includes preventing, detecting and prosecuting waste, fraud and abuse when it does happen – including by using tips, whether self-identified or anonymous. You Can Help by Reporting Fraud Help keep the money where it belongs–assisting families in need who meet program qualifications. Report incidences of fraud promptly while the facts are still fresh in your mind. HACA’s Fraud Hot-Line at (510) 727-8533 and HACA’s Report Fraud Form , are each confidential ways to report fraud. Provide as much information as you can. Describe what happened in detail. Around what dates did you notice the suspect activity? Why does it appear to you to be fraud? Are there documents that support your claim (such as a side contract between the owner and tenant, a phone bill proving residence at another location, etc.)? Also, it’s very helpful if you have the names and contact information of people willing to talk to an investigator. Reports that are too vague or that can’t be supported by documentation and/or corroborating witnesses may result in having to close the investigation without any action being taken. You don’t have to give us your name. Even if you do, it will be kept confidential. Please submit only ONE form per incident. Fraud Form All Reports Are Kept Confidential The information that you provide to HACA is strictly confidential. HACA’s fraud investigations are conducted by its Program Integrity Officer (PIO). HACA’s PIO is an Alameda County District Attorney’s Office Investigator charged with obtaining facts and evidence about possible fraud and violation of applicable laws and regulations. When information is brought forward about possible fraud, the PIO conducts an independent investigation–without revealing the name of any person that has brought information to HACA’s attention. In conducting the investigation, the PIO may review documents and conduct interviews. The PIO may review police records, use computer databases of information, and work with other law enforcement agencies. If the PIO finds that a case cannot be proven without using information that would reveal the identity of the informant, the PIO will contact you for permission to release your identity. If you don’t give permission, your name will not be used but the case may not be able to go forward. Because of confidentiality requirements, HACA is not able to make any statements regarding the status of any investigation or results. Investigations, and the process of terminating housing assistance and prosecuting the offender can be lengthy. Don’t assume that no action is being taken simply because you continue to see the family living in the same unit. About Reporting Crime Other Local Resources Community Solving Disputes with the Assisted Family Next-Door The loud music next door is keeping you up all night… The tenant next-door parks a car across the sidewalk so your child has to walk in the street… The people across the street park their old car on the front lawn… These are some typical problems that annoy neighbors, create a nuisance and make it difficult to enjoy your neighborhood. Before you do something rash, or resign yourself to living with problems like these, consider this step-by-step approach to solving problems with your neighbor, including when you believe the family is receiving Section 8 Housing Choice Voucher Program (HCVP) assistance from the Housing Authority of the County of Alameda (HACA) 1 . Talk to the Family Try to resolve any differences by talking calmly with the family in person. The family might not even know they’re causing a problem. Most people don’t intend to cause a problem and they may be the last to know that they have. If you can help solve the problem, offer your assistance. If the yard hasn’t been picked up because the neighbor is elderly or has been hurt, offer to help do it. If you’re uncomfortable talking to your neighbor, ask a (calm) friend to accompany you. A cooperative, friendly approach can resolve most neighborhood problems and may gain you new perspectives and a new friend. Research Your Case If talking to your neighbor doesn’t solve the problem, do some research into the issue. The problem could simply reflect cultural differences of which you may not be aware. While this may not make the matter go away, you’ll be more sensitive to the cause of the situation, and more understanding of your neighbor. Usually, a little information can make us more tolerant. Speak with the Landlord Speak with the family’s landlord. If the family lives in HACA’s former Public Housing, PACH, HACA’s instrumentality, is the landlord. If you believe the family is receiving Section 8 Housing Choice Voucher Program (HCVP) assistance 1 , the lease is between the tenant and landlord. Only the Section 8 HCVP landlord, not HACA, has the right and responsibility to enforce the lease. The tenant may be violating one or more lease provisions. The landlord should either be able to enforce the lease or evict the tenant. Even if the lease isn’t being violated, the landlord may be able to exert helpful influence with the tenant. Section 8 HCVP – After Speaking with the Landlord, Speak with HACA As indicated above, only the landlord, not HACA, has the right and responsibility to enforce the lease when the family is receiving Section 8 Housing Choice Voucher Program (HCVP) assistance 1 . Regardless, when a neighbor reports a dispute with a renter thought to be a HCVP family, HACA collects as much information as possible from the neighbor and investigates. If the investigation reveals that the tenant is a HCVP participant who is violating the lease, HACA works with the landlord to insure that the landlord either enforces the lease or, if necessary, terminates the tenancy. By law, only the landlord can enforce the lease. HACA has no authority to do so. Apart from any lease violation, HACA also investigates if the participating HCVP family is violating one of its HCVP Family Obligations . If so, HACA will terminate its relationship with the tenant by terminating the HCVP participant’s Housing Choice Voucher Program Voucher. When the Voucher terminates, so does the lease and HACA’s relationship with the owner also ends. HACA takes all appropriate steps to protect the privacy of all parties to an investigation, including that of any person who brings a potential lease violation, or other issue, to HACA’s attention. Federal and State laws prohibit HACA from divulging the findings and any consequences of an investigation. Speak with the City or County Sometimes whatever is annoying us, is against the law. Typically, one duty of the local jurisdiction is to assist people with neighborhood problems that involve violations of local Codes and Ordinances. In the various cities of Alameda County, and in the unincorporated areas of the County such as Ashland, Castro Valley, Cherryland, the Livermore Valley, San Lorenzo, and Sunol, the local Codes and Ordinances are designed to protect the peace and safety of the community. Problems such as junk cars, parking on the lawn, accumulating trash and debris are usually violations of local Codes or Ordinances. Knowledge of the law, as it pertains to your neighbor dispute, can help you deal with an uncooperative neighbor. Make Your Request To Your Neighbor in Writing If the problem persists, make your request to your neighbor in writing. If you learned through your research that the matter is a violation of a local Code or Ordinance, mention that in your letter. The letter should carefully state the situation and possible actions to correct the problem. If it is a recurring problem, you may wish to keep a log of the occurrences. Contact Your Neighborhood Association Your neighborhood or home owner’s association is interested in preserving the peace and quality of your neighborhood. It’s likely that they will share your concern about your neighbor. Talk with the directors of the association and attempt to enlist their help in mediating the problem. Often, an offending neighbor will correct a problem once they realize it bothers the whole neighborhood, not just one neighbor. If your neighborhood does not have an association, you may want to work with your neighbors to form one. Try Outside Mediation If your neighborhood does not have an association, or if the problem persists, a neutral third party may be able to help. You may consider contacting East Bay Community Mediation , to seek a solution to the dispute with your neighbor. The EHV Program wastargeted to serve individuals and families in one or more of the following categories: homelessness; at risk of experiencing homelessness; fleeing, or attempting to flee, domestic violence, dating violence, sexual assault, stalking, or human trafficking; or recently homeless or having high risk of housing instability. Alameda County Coordinated Entry referred families to Emergency Housing Vouchers based on the prioritization determined by Alameda County’s Continuum of Care.  HACA did not take direct applications. No new referrals for the program are being made and effective September 30, 2023, turnover EHVs cannot be reissued to new families; therefore, HACA’s EHV program is closed to new families. About Reporting Crime Other Local Resources HOTMA HOTMA Housing Opportunity Through Modernization Act of 2016 (HOTMA) The Housing Opportunity Through Modernization Act of 2016 (HOTMA) was signed into law July 29, 2016.  Its goal is to modernize and streamline various aspects of housing policies by amending sections of the United States Housing Act of 1937. HUD published the HOTMA final rule on February 14, 2023, and has authorized public housing authorities (PHA) to implement several aspects of HOTMA. PIH Notice 2023-27 PIH Notice 2024-19 PIH Notice 2024-38 Authorized HOTMA Changes affecting Recertifications HUD has authorized PHA’s to implement several HOTMA changes that will affect how the PHA handles annual recertifications.  Here is a summary of the most impactful changes: HACA has implemented the following HOTMA policies effective January 1, 2024: Stopped providing the Earned Income Disallowance (EID) to new families Any income currently being excluded through EID will end no later than 12/31/2025. Started using the new HUD authorization Form 9886-A as part of the annual recertification packet. Beginning with annual recertifications effective July 1, 2025, and later, HACA must apply the following HOTMA changes: New definition of the following terms: family, dependent, minor, and foster child and foster adult. New definitions of “earned income” and “unearned income”. New definitions of “day laborer” and “independent contractor” New definition of “health and medical care expenses” New income/asset exclusions including, but not limited to: Non-recurring income sources Home Care Payments for a family member(s) with one or more Disabilities Income received by IHSS to care for a family member living in the subsidized unit is now excluded. Our share of the tenant’s rent is mailed the last business day of each month. Often, our share is the lion’s share. Flexibility and stability Hiccups in the economy usually hit low-income families – your tenants – first and hardest. Usually, a layoff or reduction in hours puts your rent at risk. Setting the rent We’ll work with you to identify the maximum rent for you unit (see How Much Rent Can I Charge? ) based on HACA’s payment standard and comparable rents. The rent you charge your Section 8 HCVP tenant will be the same you charge everyone else, as long as its comparable to similar units in your area and within HACA’s payment standards. Got a vacancy? We’ll help you lease up HACA assists over 7,000 Section 8 Housing Choice Voucher Program (HCVP) families. Each month, many of these families plan to move or are already actively looking. HACA’s free online “For Rent” Directory will help you maximize exposure of your listings and minimize vacancy loss. It’s the only rental listings directory targeted to Section 8 HCVP participants in HACA’s jurisdiction. (We also expand the exposure for your vacancies by making printed copies of the listings available.) Annual inspections help you reduce expenses and maintain the value of your property We inspect your unit when you first lease it to a Section 8 HCVP tenant and every 24 months thereafter. We aren’t looking for code compliance, but, rather, for possible health or safety hazards like, a smoke alarm with a dead battery, or an outlet without a switch plate – what the U.S. Department of Housing and Urban Development (HUD) calls Housing Quality Standards. (Sometimes, of course, health or safety hazards are code violations. Also, we do require that additions or significant remodels have been done under permit.) (You can see HUD’s inspection form HERE ; and the check-off list we use to pass (or, when necessary, fail) a unit.) If everything checks out, the unit passes. If not, we’ll come back to reinspect. Our biennial inspection can help you preserve your investment by identifying problems before they become costlier to correct or lead to disputes with the tenant. Our discovery of energy wasters like loose seals in the refrigerator can lower your monthly expense when corrected. Rent Increases After the initial lease term, you can get a rent increase provided that the new rent is comparable to similar units in your area and within HACA’s payment standards. You can use our free online “For Rent” Directory , Craigslist, or other sources to check “comps”. Getting Started To participate in the Section 8 HCVP, just list your available unit in HACA’s free online “For Rent” Directory . Once you and a HCVP family tentatively agree to sign a lease, fill out the Request for Tenancy Approval form (RTA) that the family will present to you and return it to HACA (the RTA form provided here is an example only and only HACA’s form will be honored).
