It means that your application has been singled out because you haven't given enough evidence to prove a real marriage, your application contains some inconsistencies, or something about you and your spouse looks suspicious. When am I required to file form I-751? The Form I-751 is known as the "Petition to Remove Conditions of Residence." Applying for the removal of the conditions of your residence is a crucial step in becoming a permanent resident of the U.S. Conditional residence only lasts two years. When you are nearing this two-year period on your green card, the Form I-751 is filed with the U.S. Citizenship and Immigration Services (USCIS) to request that the conditions on your residence be removed so that you will be classified as a permanent resident. Joint Application to remove conditions The USCIS requires certain documentation to support your application from you and your spouse spanning the course of the last two years. Most documents are quite straightforward but careful consideration should be given as to which documents will support your application best. What if I'm separated or divorced? Requesting a Waiver of the Joint Filing Requirement. You should NOT file a Joint Application if you are no longer living with your spouse, are separated or in the process of divorce. You may face charges of fraud or misrepresentation if you do so and be placed in Immigration Court Removal Proceedings. You can seek a waiver of the joint filing requirement if you are unable to file your Form I-751 jointly with your U.S citizen spouse or parent. This would be due to death, divorce, abuse or other applicable circumstances. The following documents (whichever is applicable) will have to be submitted together with your waiver request: A copy of the death certificate A copy of the divorce certificate Proof of abuse or cruelty such as police reports, medical reports, social worker reports, photographs of injuries etc. Documentation of the reason you are filing your application separately from your parent's application Evidence proving that you will undergo "extreme hardship" if you are removed from the U.S if that is your reason for your application of the waiver. I-751 Fees USCIS is on the lookout for fraudulent marriages and will be very strict in assessing your application. When am I required to file form I-751? The Form I-751 is known as the "Petition to Remove Conditions of Residence." Applying for the removal of the conditions of your residence is a crucial step in becoming a permanent resident of the U.S. Conditional residence only lasts two years. When you are nearing this two-year period on your green card, the Form I-751 is filed with the U.S. Citizenship and Immigration Services (USCIS) to request that the conditions on your residence be removed so that you will be classified as a permanent resident. Joint Application to remove conditions The USCIS requires certain documentation to support your application from you and your spouse spanning the course of the last two years. Most documents are quite straightforward but careful consideration should be given as to which documents will support your application best. What if I'm separated or divorced? Requesting a Waiver of the Joint Filing Requirement. You should NOT file a Joint Application if you are no longer living with your spouse, are separated or in the process of divorce. You may face charges of fraud or misrepresentation if you do so and be placed in Immigration Court Removal Proceedings. You can seek a waiver of the joint filing requirement if you are unable to file your Form I-751 jointly with your U.S citizen spouse or parent. This would be due to death, divorce, abuse or other applicable circumstances. The following documents (whichever is applicable) will have to be submitted together with your waiver request: A copy of the death certificate A copy of the divorce certificate Proof of abuse or cruelty such as police reports, medical reports, social worker reports, photographs of injuries etc. Documentation of the reason you are filing your application separately from your parent's application Evidence proving that you will undergo "extreme hardship" if you are removed from the U.S if that is your reason for your application of the waiver. I-751 Fees USCIS is on the lookout for fraudulent marriages and will be very strict in assessing your application. Besides applying for the correct and appropriate visa, you will then eventually need to get your biometrics taken, complete an interview with a United States Citizenship and Immigration Services (USCIS) officer, and pass a test. Many foreign nationals that are going through the process of naturalization (or obtaining U.S. citizenship) find the U.S. citizenship test difficult. Not all pass the first time. If you have taken the U.S. citizenship test and have failed, or are worried about failing, this blog article will cover your major concerns like, “If I failed the U.S. citizenship test, how can I take the test again?” or “What if I failed the U.S. citizenship test?”. If you have failed the U.S. citizenship test, try not to be too upset. There are options to ensure you can move forward on the path to full U.S. citizenship.   I Failed the US Citizenship Test. How Can I Take the Test Again? After you have filed out the appropriate forms to become a naturalized U.S. citizen, the USCIS will invite you in for an interview and ask you to take an English and Civics test. During the naturalization interview, the officer will ask you questions about your application and about your personal history. You will be exempt from taking the English language test if you are aged 50 or older and have lived as a permanent resident in the United States for 20 years; or aged 55 or older and have lived as a permanent resident in the U.S. for 15 years. From there, the USCIS agent will ask you 20 questions from the list of 128 civics test questions. You must answer correctly at least 12 of the 20 in order to pass the civics test. You are given two chances to pass the English language and civics tests. The USCIS officer will give you a notice of the results (form N-652) at the end of your interview. Depending on which part or parts you failed, you will be retested only on the parts of the test you have failed. Your second test will take place within a maximum of 90 days from the date of your first interview. If you have failed, we would highly recommend studying as much as possible to prepare yourself for the second test. If you have failed the English language portions, try to find a native English-speaking friend or family member to study with and practice your English as much as possible. Occasionally, the USCIS officer may not be able to make a decision because you have failed to provide supporting documents in your first application (such as bank statements or rental agreements). If this is the case, the officer will give you a written request for the specific documentation and will give you guidance on how to respond with the appropriate information. If anything is unclear, make sure to have the officer explain it to you again. US Citizenship Test Failed Second Time If your second interview and test do not go well and you are denied naturalization, you have two remaining options. According to USCIS policy, you can appeal the decision by asking for a hearing. You must file form N-336 within 30 days to make this request. This should give you one final opportunity to pass the English exam. The other option is to submit a new N-400 to USCIS as soon as you feel you are ready. There is no waiting period to refile if the only reason you failed was because you could not pass one of the tests. Many foreign nationals wonder: what is a green card and how is it different from a permanent resident card? The truth is that a green card is simply another name for a permanent resident card. This comes from the fact that this type of card used to be issued on green colored paper, and it became a shorthand way of referring to a permanent resident card. A permanent resident card allows a foreign national to live and work anywhere within the United States. If you obtain a permanent resident card, you will be required to file U.S. income tax returns, obey all federal and state laws, register for the selective service (if you are male and between the ages of 18 and 25), and notify the United States Citizenship and Immigration Services (USCIS) of any changes of address. This is the case even if you are married to a US citizen or Lawful Permanent Resident. In order to overcome this inadmissibility and apply for lawful permanent status or a "green card" you must file a provisional extreme hardship waiver. The provisional waiver allows immediate family members of U.S. citizens or Lawful Permanent Residents who entered the U.S. without inspection (visa), or are otherwise ineligible to adjust their status in the U.S. due to unlawful presence, to apply for "form I-601A provisional waivers" in the United States. Once their waivers are approved by the USCIS, they will be eligible to attend their appointments for immigrant visas (green cards) in their countries of origin. The provisional waiver allows families to avoid separation of spouses and sons and daughters of U.S. citizen's from their families for months or even years while their waivers are pending. These family members will obtain their waivers before departing the U.S., will be interviewed abroad, and will then return to their families in the U.S. within just a few days or weeks.
