In the episode, Rushing explains how his firm secured a $ 17.78 million federal jury verdict in Virgin Scent Inc. v. BT Supplies West Inc. , a contract dispute the firm took on during the COVID-19 pandemic. The episode offers practical lessons for trial lawyers at every stage of their careers by challenging conventional wisdom about courtroom toughness and showing how candor and strategic humility can sometimes win the day. The Virgin Scent v. BT Supplies dispute began in early 2020. As the COVID-19 pandemic triggered a nationwide shortage of masks and hand sanitizer, Rushing McCarl’s clients moved quickly to meet the need. They pivoted their cosmetics company, ArtNaturals, into one of the largest manufacturers of hand sanitizer in the country. BT Supplies West ordered five million bottles of hand sanitizer at $2.40 each and ten million masks at $0.63 each. ArtNaturals delivered — but BT Supplies refused to pay. At trial, BT Supplies’ principal claimed the sanitizer was supposed to be made in the United States. Rushing McCarl structured the plaintiff’s case around two betrayals. The first was contractual — the broken promise at the heart of any contract claim. The second was societal: vital pandemic supplies sat in storage rather than being paid for and distributed by the buyer who ordered them. This layered framing gave jurors a clear way to understand what might otherwise have been a dry, abstract dispute. By casting the breach as a betrayal, lead counsel John Rushing elevated the case’s moral stakes and focused attention on broken promises and hoarded supplies. As Rushing explained, “You win big cases by telling a moral story. Jurors resolve moral discomfort with a verdict. Money is imperfect justice, but it’s what the law allows.” The task is to construct a narrative that creates moral discomfort resolvable only through a verdict for the client. That framing also shaped how Rushing presented ArtNaturals’ witnesses. Rather than allowing the defense to reduce the plaintiffs to faceless corporate actors, he put the company’s founders on the stand to tell their story themselves. “My strategy was humanization,” Rushing explained. “Tell the story in first person. Make it about securing a future, not profiteering.” The founders were young entrepreneurs who had risked everything — taking out a $9 million loan and leveraging hard-won relationships with distilleries to meet urgent market needs — only to be stiffed by the defendant. ​ The trial turned on a series of tactical decisions many trial lawyers would consider risky. During opening statements, opposing counsel objected when Rushing attempted to show a WhatsApp video sent to the defendant depicting the hand sanitizer being manufactured in China. The judge sustained the objection. Rather than move on or contest the ruling, Rushing turned to the jury and said, “Well, I made a mistake by showing you that. But you’re going to see a video, and you can decide what it means.” The moment defused the setback, made Rushing relatable, and turned the excluded video into the case’s “elephant in the room.” When the evidence later came in — including WhatsApp “read receipts” showing that the defendant had seen the video despite denying it on the stand — the jury was ready to connect the dots. As he put it, “Jurors forgive mistakes. Being named in a lawsuit — even a frivolous one — threatens a business with liability risk, legal costs, and distractions from core operations. Rushing McCarl LLP client Armada Trucking Group recently faced this reality when it was sued for $1.65 million in federal court by an Illinois bank with which it had never done business. The case involved complex issues relating to the law of conversion, contracts, and secured transactions under California’s adoption of the Uniform Commercial Code (UCC). In the end, Rushing McCarl secured a total victory, with the bank agreeing to a nonconfidential pretrial settlement of $0. Armada provides shipping services to FedEx Ground, Amazon, and other companies throughout Southern California. It prevailed after Rushing McCarl obtained key discovery admissions and developed a powerful case theory, allowing us to credibly threaten to bring sanctions against the plaintiff for continuing to prosecute a frivolous lawsuit. The dispute arose from a loan transaction that didn’t involve our client. An unaffiliated shipping company called Gribben & Associates borrowed $4.9 million from Plaintiff Byline Bank to buy a business operating FedEx delivery routes. Later, in a routine FedEx-approved sale, Gribben sold Armada the rights to eight routes. When Gribben defaulted on its loan, Byline launched an expansive lawsuit against numerous parties — including Armada, which wasn’t even aware of the loan — to recover the loan funds. Byline sued Armada for $1.65 million on the theory that Armada’s FedEx routes had been part of the collateral on Byline’s loan, so buying the right to service the routes constituted the tort of conversion . Rushing McCarl successfully pursued an early, decisive resolution of the case by identifying fatal flaws in Byline’s claims, advising the plaintiffs’ attorneys that we would seek sanctions if they continued prosecuting the suit, and beginning aggressive discovery to secure dispositive admissions. After reviewing Byline’s complaint and the Gribben-Armada sale contract, Rushing McCarl partner Ryan McCarl — who has published articles about property law and creditors’ remedies — knew that the route contracts could not be converted because they didn’t transfer vested payment rights. He led a research team that left no stones unturned and ultimately turned up a dispositive, analogous case that was decided in 1920 and involved a contract to run a newspaper route. Relying on the Supreme Court of California’s decision in Boehm v. Spreckels , 183 Cal. 239 (1920), we showed that FedEx route contracts are not property that can be converted. Instead, they are personal-services contracts to provide shipping services to FedEx if FedEx approves and offers the work. Only once FedEx offers future shipping opportunities and the carrier performs them could the carrier earn compensation. Boehm and other cases establish that such opportunities constitute a mere expectancy without vested property rights. They therefore cannot serve as the basis for a conversion claim, since only personal property can be converted. Nor was that the only reason Byline’s conversion claim failed. Even if the FedEx route contracts were property, Byline lacked an enforceable security interest for three reasons. First, the security agreement and UCC-1 financing statement failed to adequately identify the routes; Byline’s boilerplate listing of generic asset categories did not sufficiently notify third parties — such as our client — of any claim. The issue has sweeping implications for California civil litigation. Rushing McCarl represents Mario Delis, who sued his former business partner, Jeffrey Thorn, for breach of contract, breach of fiduciary duty, and civil theft arising from their cannabis-business partnership. The California Constitution and California Supreme Court precedent establish that trial by jury is an “inviolate right” in actions at law. This right applies when a plaintiff brings only legal claims (not equitable ones) to trial. When Thorn sought to bifurcate legal and equitable issues before trial, Delis — invoking Raedeke v. Gibraltar Savings & Loan Ass’n , 10 Cal. 3d 665 (1974) — dismissed all equitable claims to preserve his constitutional right to a jury determination of all facts. Raedeke held that when a plaintiff brings only legal claims to trial, they are “entitled to a jury trial as a matter of right.” In response to Delis’ dismissal of equitable claims, the trial court denied Thorn’s pretrial bifurcation request. After a 34-day unified jury trial, the jury awarded Delis $9.9 million (after the civil-theft damages are automatically trebled ). But the trial court refused to enter judgment as required by Cal. Civ. Proc. Code § 664 . Instead, the court reversed course and retroactively bifurcated four of Thorn’s defenses. Unless the Supreme Court intervenes, the parties will soon face a post-verdict bench trial covering the same evidence that the jury already heard. Allowing defendants to bifurcate equitable defenses such as estoppel, unclean hands, or waiver in legal actions would curtail plaintiffs’ jury-trial rights. It would also allow losing defendants to relitigate facts, evidence, and theories already presented to the jury — eroding the finality of verdicts, duplicating proceedings, and increasing litigation costs. The petition further contends that the trial court’s post-verdict bifurcation conflicts with Supreme Court precedent holding that new-trial motions are the exclusive means of challenging jury verdicts. Allowing post-verdict bifurcation invites gamesmanship and waste.
