Per the U.S. State Department, in 2020, roughly nine million Americans lived abroad, while a 2022 Gallup poll revealed 15% of Americans would like to leave the United States permanently. At the same time, nations throughout the world continue to entice entrepreneurs and wealthy individuals to relocate, by offering golden visa programs that grant residency and citizenship status in exchange for investments in the host country. While the ease of modern connectivity and travel have lowered some burdens for expats, the Byzantine nature of immigration, estate, and tax laws makes the planning and execution of living abroad incredibly complicated. Additionally, with revenue-hungry governments aplenty, errors in wealth strategies can be expensive if assets are not properly structured and managed. Life abroad begins with obtaining a visa, residency or, in some cases, a path to citizenship. Electing which nation to live in and under what residential circumstances will drive most of the financial planning decisions that follow. Therefore, hiring an immigration attorney that specializes in your destination country of choice is a crucial first step. For those seeking status through economic channels, ensure that the attorney is well-versed in the rules of the golden visa programs, as the capital investment required can run over a million dollars and possibly be restricted for years. Engaging an estate attorney deeply familiar with the foreign country and its laws should be the next step, as the structure of the assets will not only determine heirship, but estate taxes can be considerably onerous outside of the U.S. Note that in some popular expat nations, standard trusts created in the U.S. are viewed poorly and forced into burdensome reporting, such as in France, while some countries, like Spain, do not recognize the legal status of a trust. Regardless of which nation an expat resides, there are likely to be complicated and ever-changing tax rules in the host country and the U.S. Retaining a CPA in both nations is highly recommended given the very specific nature of local taxes and expats should prepare themselves for heftier reporting requirements to the IRS. Taken together, the immigration, legal, and tax strategies will inform the investment strategy of your Wealth Manager. With the golden visa programs in particular, sizable amounts of capital will need to be raised for investment and likely be concentrated in a business, real estate property, or equity markets of the host country. Diversification and managing risk around those concentrations are crucial. Furthermore, given the likelihood of tax complications, it is prudent to adopt an investment approach that either minimizes the realization of gains or allows for strategically timed trading that meets the liquidity needs of the expat while still complementing the overall estate and tax strategy. After all the advanced planning is in place, the practical concerns of day-to-day life take over. Under most circumstances, it is more beneficial to maintain brokerage accounts in the U.S. than abroad. In a host of scenarios, bringing a portfolio into a foreign country can increase a tax burden, ensnare it in estate laws unintentionally and, under certain country circumstances, prevent the assets from ultimately leaving the foreign nation. Plan to utilize a local bank for daily living expenses while being mindful of the FDIC-equivalent protections of cash deposits. In the likely event that liquidity needs will be met with transfers from a U.S. financial institution, money movement will be made more quickly and smoothly across borders if the foreign bank has a U.S. correspondent bank, allowing for same-day wire transfers in U.S. dollars. Be prepared as well for heightened scrutiny of your cross-border money movements both by governments and the regulated financial institutions tasked with preventing money laundering. Supporting documentation requirements, probing questions, and delays in transfer may accompany certain international transfers. Lastly, insurance should not be overlooked in the planning and transitioning to an expat lifestyle. Life insurance, in particular, should be obtained while still in the U.S. as obtaining it once living abroad is considerably harder. The thrill of living an expat lifestyle has never been more attainable given the modern world. Living abroad can offer career opportunities, a more affordable retirement, or proximity to family. To ensure your adventure isn’t costly to your portfolio or estate, be sure to engage a team of legal and tax specialists, work to position your portfolio for foreign circumstances, and plan for the management of liquidity and daily living expenses. While both may be accompanied by nail biting and stomach-churning ups and downs, investors want more wins than losses in their portfolios at the end of the tournament. In our view, a diversified portfolio is a key strategy for investors seeking to ease market-related madness. At its core, diversification involves spreading investments across a variety of assets, sectors, and geographic regions with the goal of minimizing the impact of any single investment’s poor performance on the overall portfolio. By balancing various investments, a diversified portfolio aims to achieve more stable returns while mitigating potential losses from individual asset downturn. One of the primary benefits of a diversified portfolio is risk reduction. In financial markets, risks are inherent, but not all assets are affected by the same factors. For instance, while the stock market may experience a downturn due to economic recessions or geopolitical tensions, other asset classes—such as bonds, commodities, or real estate—might remain stable or even thrive. By holding a combination of different types of investments, investors can reduce their exposure to any single source of risk. In essence, the gains from some investments could potentially offset the losses from others, leading to a more stable overall portfolio performance. Another significant advantage of diversification is the potential for improved risk-adjusted returns. A diversified portfolio is designed to balance the risk-reward ratio. The idea is not just to reduce risk, but to do so while maintaining a reasonable level of return. This is measured using metrics such as the Sharpe ratio, which compares the return of an investment to its risk. Diversified portfolios tend to perform well over long periods because they are structured, in varying degrees, to weather both bull and bear markets. While it might not generate the highest returns in the short term, over the long run, a diversified portfolio has the potential to generate consistent, sustainable growth. This is especially true when investors maintain a long-term investment horizon and avoid making knee-jerk reactions to short-term market movements. Lastly, diversification offers greater flexibility for adjusting to changing market conditions. As economic landscapes evolve, so do the opportunities and risks associated with different asset classes and even sectors within those asset classes. A diversified portfolio allows investors to shift their holdings to rebalance according to market trends, interest rates, or other factors, and ensure that their investments remain aligned with their financial goals and risk tolerance. Whether picking brackets or investments, it’s important to have a balance of strategy and the ability to handle the inevitable highs and lows. [email protected] Charitable planning is often an important element of many estate plans, and retirement accounts can be a valuable tool for those looking to leave a charitable legacy. Naming a charity as the beneficiary of an IRA—or another retirement account, such as a 401(k)—is often viewed as a straightforward and tax-efficient strategy. However, administrative friction at the custodian level can create complications that are easy to overlook. On the surface, the process is simple: complete a beneficiary designation form and name the charity as the sole or joint beneficiary. In practice, however, things can become more complex when the time comes to distribute the assets. When the IRA owner passes away and the assets are ready for distribution, many custodians, such as Schwab and Fidelity, require the beneficiaries to open inherited IRA accounts to receive the assets. This is a non-issue when the beneficiary is a real person, but this rule can apply even when the beneficiary is an organization. Given their tax-exempt status, charities often prefer to receive a cash distribution rather than an inherited IRA account. The account opening process can be operationally burdensome on a charity due to the detailed documentation requirement, which could include providing the names, addresses, Social Security numbers and other personal information of each board member signing the application. For some larger charitable organizations, this task may become too onerous, ultimately delaying the gift, or worse, the charity may choose to decline the gift entirely. One way to reduce this complexity is by naming a previously established donor-advised fund (DAF) as the sole beneficiary of the IRA, rather than naming the charity directly. Large DAF sponsors like Fidelity Charitable and Schwab Charitable are set up to efficiently receive retirement assets and handle the administrative details when a donor passes away. Once the DAF receives the assets, it can make grants and distribute cash to charitable organizations that have been previously named as beneficiaries. This approach may be particularly useful if the donor intends to support multiple charities, especially those that are smaller and less administratively equipped. Alternatively, you might consider naming a successor advisor for your DAF and giving them guidance about the areas of focus that are important to you. This approach provides flexibility as your charitable intentions evolve over time, or if the designated charities change, merge, or dissolve. If you are committed to designating a charity directly as the beneficiary of an IRA, it is prudent to coordinate with the organization in advance to ensure they can accept the distribution without issue. Some questions to ask include: Have you received IRA beneficiary distributions before? Are you able to manage inherited IRA account requirements? Do you have a preferred process or custodian for receiving these assets? While naming a charity as a retirement account beneficiary remains a highly tax-efficient estate planning strategy, it is not always operationally smooth. If the custodian’s process proves to be administratively difficult, utilizing a donor-advised fund can help ensure the donor’s intent is carried out, rather than creating friction that could delay, or even derail their charitable legacy. [email protected] With families, lending money can feel easy and natural. When it comes to supporting something as important as a new home purchase or simply helping bridge the gap during a cash-strapped month, many families approach such arrangements informally. But what begins as a casual arrangement can quickly transform into a tax concern or a point of friction—not only with mom and dad, but with Uncle Sam. If you want the IRS to classify a transfer as a loan, it must be treated in a structured and disciplined way from the start. A common mistake is not clearly differentiating between a loan and a gift. The IRS does not consider intent, and just because you may call something a loan does not mean it is one. Without proper documentation detailing the terms of the loan, including a genuine expectation of payment, the IRS can reclassify the transfer as a gift. This can trigger gift tax consequences and can consume potentially large amounts of your lifetime tax exemption. Written agreements, repayment schedules, and a detailed payment history are generally what the IRS will look for to determine whether a loan is legitimate. To establish a valid intra-family loan, certain elements are essential. The loan terms should be documented with a written promissory note that includes a defined loan amount, a fixed repayment schedule, a stated interest rate, and signatures from both parties. These steps may seem formal for a family arrangement, but they show that both sides entered into the agreement with clear expectations. A critical feature that differentiates a loan from a gift is the interest rate. The IRS mandates that loans include the minimum Applicable Federal Rate (AFR), which is updated monthly. If you charge a low or zero interest rate, the IRS will likely compare the interest that was charged to what should’ve been charged and treat the difference as a gift. This is referred to as imputed interest. Using the correct AFR rate helps ensure compliance and avoids unexpected tax consequences. And when April 15 th rolls around, there are potential tax considerations for both the lender and the borrower. The lender generally must report interest income, as they would with any loan. The borrower may or may not be able to deduct the interest, depending on how the funds are used. If the lender later forgives the loan, the forgiven amount may be treated as a gift. Importantly, documentation alone is not enough. Both parties’ behavior should be consistent with the agreement. Payments must be made on schedule, interest and principal accounted for separately, and any change in terms must be recorded in writing. Skipping payments or making informal adjustments can undermine the loan’s credibility and increase the risk of reclassification. Beyond tax rules, it’s important to consider how family loans can affect relationships.
