In California, officially registering a domestic partnership comes with important benefits. Domestic partners can receive all the same benefits, legal rights and protections as married couples. This includes health care and insurance benefits. They also have the same responsibilities and obligations as married spouses. Registering a domestic partnership in California involves confirming you meet the eligibility requirements, then completing and filing the appropriate legal forms with your county’s civil court. California recently updated its domestic partnership laws. Effective January 1, 2020, anyone who is eligible to marry may register as domestic partners. Age and sexual orientation no longer matter when it comes to registering domestic partnerships in California. The new law resulted in new domestic partnership registration forms, which you must mail to the California Secretary of State or deliver in person to a specified location if you wish to register your domestic partnership. Prenuptial and Postnuptial Agreements in Napa A prenuptial agreement is a contract written and signed before marriage that specifies both parties’ property rights in the event of a divorce. It also lists any separate property they bring to the marriage and can define terms such as a waiver or limitation of spousal support. A postnuptial agreement is entered into after spouses are married. There are strict laws governing prenuptial and postnuptial agreements. Therefore, both parties should have attorneys to advise them throughout the prenuptial process and signing of the agreement to ensure its validity Dissolution of Marriage in Napa There is a difference between a dissolution of marriage and divorce in Napa, California. In a California dissolution of marriage, spouses divide their assets, debts, and other marital property without the court’s assistance. A dissolution of marriage is for a couple willing to work together and voluntarily trade information. Spouses must agree on the following matters without the necessity for court interference: Division of assets and debts; Spousal support; Child custody and visitation; Child support; and Attorney fees. Divorce in Napa Divorce cases are submitted to the courts immediately. However, spouses are expected to work out any issues they can before appearing before a judge. California is a no-fault divorce state, meaning no grounds need to be stated by either spouse to obtain a divorce. Instead, a divorce can be granted due to an irrevocable breakdown of the marriage. There are residency requirements to divorce in California. At least one of the spouses needs to be a state resident for at least six months before filing the divorce petition. These requirements vary based upon the type of union you and your partner are in, and the type of status action you seek. Residency requirements are statutory requirements which must be satisfied before a court may properly entertain a marital status action, and are in addition to the venue requirements imposed by the California Code of Civil Procedure. A Final Judgment of dissolution may not be entered unless one of the parties to the marriage has been a resident of the state of California for at least six months, and of the county in which the proceeding was filed for three months, prior to the filing of the Petition for Dissolution. Venue is proper in the superior court for the county where either Petitioner or Respondent has resided for three months prior to the filing of the Petition for Dissolution. While the court has the jurisdiction and ability to divide your community estate, enter orders for spousal and child support, order custody and timeshare for children of your marriage or partnership, and provide other relief incident to the proceeding and specific to your matter, it need not always do so. Indeed, you are entitled to settle all, or part, of your case. The matters to which you and the other party agree can be made into a formal document, executed by both you and your spouse or partner, and submitted to the court for its approval and adoption into either an Order or a Final Judgment. If you and your partner or spouse agree to a resolution of all matters pertaining to the dissolution, annulment, or legal separation action, you can enter into a Settlement Agreement. This document is a complete and final resolution of your matter. The Settlement Agreement must be freely and voluntarily entered into by both parties, and must be submitted to the court for approval. While the ultimate goal is to have the Settlement Agreement incorporated into a Final Judgment, be it for dissolution, annulment, or legal separation, the agreement itself is a contract and is enforceable as a contract until such time as the court does enter a Final Judgment. When the Final Judgment is entered, your Settlement Agreement becomes a Court Order, enforceable by contempt proceedings in the event of non-compliance. If you and your spouse or partner are able to agree on isolated issues in your matter, you can enter into a stipulation relative to those issues. It is possible to stipulate to a wide array of matters, from the valuation of one item of real or personal property to the use of an expert to an order regarding support and/or custody and timeshare. San Francisco Child And Spousal Support Matters Child and spousal support are financial payments from one person to another to help them support their shared children or a spouse with a lower income, respectively. Child and spousal support are determined differently. There is a specific formula in California to determine the appropriate amount of child support. This formula determines a presumptive amount of child support according to the following information: The number of children to be supported The amount of the parents’ combined total income The percentage of parenting time that the higher earning spouse has physical responsibility There is no set formula for determining spousal support. California courts must consider various factors to determine whether to award spousal support, what kind, and for how long. Some of the factors the courts consider include the earning capacity, health, and age of each spouse, the length of the marriage and the ability for a spouse to become self-supporting with additional education or training. There are times when the court can consider future income or potential income when making support orders. For example, a judge may “impute” income if a party has attempted to minimize their income to avoid or reduce financial support payments. This allows the court to attribute income to a party even when they are not earning that amount. Courts cannot generally force a person to leave their current line of work to make a more lucrative living, even if their earning capacity may be greater than their current income. They also do not usually penalize parties for accepting lower-earning positions for viable reasons, such as greater flexibility to parent their children, better benefits, or healthier work environments. However, courts can impute income in certain circumstances, such as when the person has the ability and opportunity to earn more and refuses to do so. Often, this may come down to discerning whether a person is involuntarily or voluntarily unemployed or underemployed. Involuntary unemployment occurs when a person legitimately loses a job they wanted to keep and is unable to find a substitute position. For example, they may have been laid off instead of fired for misconduct at work. In contrast, a person may be voluntarily unemployed if they quit work or deliberately lowered their income. In such cases, the court may ignore the change in income and continue to maintain the amount of support as originally ordered. In other cases, the court may impute a certain amount of income after determining the person’s earning capacity. A person’s earning capacity may be determined by reviewing factors such as their: Education Ability to work Opportunities to work, based on job opportunities in the local area Willingness to work Industry Position History of promotions Employment history Job skills Market conditions of the person’s industry and position If a party believes the other spouse is artificially deflating their income, they can take steps to try to argue this to the court to get the court to impute income to that spouse. For example, they can demand evidence showing the other party has made legitimate efforts to obtain employment. Expert witnesses can prepare a report and provide testimony about potential available jobs and their accompanying salaries. She discovered her passion for helping families navigate challenging transitions in their lives while still an undergraduate at the University of California, Santa Cruz, where she minored in Legal Studies and spent a semester in Washington D.C. interning with the National Partnership for Women & Families. After college, Jennie continued exploring ways in which the law intersects with family issues by working for the McCullum Youth Court, where first time youth offenders have the opportunity to avoid the juvenile correctional system by participating in a court-room trial run by their peers. These experiences motivated Jennie to pursue a legal career focused on family law issues. While in law school, she interned with the Family Division of the San Francisco Superior Court, learning the inner workings of the family court. CALL US. 415.834.1120 Melissa Schmitt Senior Counsel Melissa graduated from California Western School of Law, where she was a clinical student in the California Innocence Project. While in law school, she also clerked for Appellate Defenders, Inc., and the San Diego County Public Defender’s Office. In her third year, Melissa clerked at a San Diego family law firm. Upon graduation, Melissa chose family law as her specialty. She was certified by the State Bar of California as a Certified Family Law Specialist in 2016. She found, and finds, the breadth of legal issues arising in the context of family law, challenging and exciting and the clients compelling. In 2007, Melissa opened her own family law firm, which she operated for 15 years. In those 15 years, Melissa successfully represented hundreds of clients in simple to complex family law matters. She is experienced in high-conflict custody matters, complex financial matters, cases involving hidden and stolen assets, difficult domestic violence cases, complex financial matters, date of separation issues, and relocation cases both domestic and international. Melissa has represented clients in 19 writs and appeals, mostly in the realm of family law, but also criminal and Anti-SLAPP. Melissa is now pursuing her California State Bar Specialization in appellate law. Melissa is known for her compassion for clients, doggedness in dealing with opposing counsel (when appropriate), and her clear, thorough, and persuasive legal writing. Melissa has two published decisions in the Fourth District Court of Appeal Division One. When the first of those published decisions was featured in a 2009 issue of California Family Law Report, former Los Angeles County Family Law Supervising Judge Thomas Trent Lewis noted Melissa’s tenacity both in the trial court and on appeal. In 2024, she was selected as a Northern California Super Lawyer. When Melissa is not working, she enjoys hiking with her dog Beckett, kayaking, and reading, especially memoirs and biographies. Dominic has been licensed to practice law in California since 2018 and has practiced exclusively family law since then throughout the Bay Area..
