You’re in the right place if you are thinking about reaching out for help, want to understand your options, or just want to know more about working with us. Here is a brief overview of what you can expect when you begin your journey with Stouffer Law. LEARN ABOUT THE CLIENT JOURNEY Our Team Christine Stouffer Christine Stouffer Christine Stouffer Christine is a certified specialist in Immigration and Nationality Law with the California State Bar. She has been practicing exclusively immigration law since 2006. She previously worked as Interim Staff Attorney for Lawyers’ Committee for Civil Rights (LCCR) in San Francisco with their Pro Bono Asylum Program, and as Staff Attorney for Arab American Legal Services (AALS), part of the San Francisco Immigrant and Legal Education Network (SFILEN). A variety of experiences in her past led Christine to immigration law. She has traveled extensively and lived in Morocco, France and Belgium. Her mother and her husband are both immigrants to the United States. Based on her personal experiences, she has a deep appreciation for the challenges faced by individuals and families living in a new country. What is already challenging is only made more difficult when, as in many cases, life in a new country brings separation from loved ones. It means a lot to her to work in a field that allows her to help clients navigate the complicated immigration laws so they can focus on moving forward with their lives and reuniting with their families. Christine feels truly honored to get to know people from all over the world, learn their unique histories, and explain the law to her clients so that they can make the most informed decisions about their immigration matter. Once the appropriate path is identified, she enjoys working as a team with clients to present the strongest case possible to the United States Citizenship and Immigration Service or the Immigration Court. Christine is fluent in French, and conversant in Arabic and Spanish. Eva Loney Eva Loney Eva Loney Eva is a Senior Immigration Attorney with experience in a broad range of humanitarian and family-based forms of immigration relief. Prior to joining Stouffer Law, Eva was a Supervising Attorney at Centro Legal de la Raza, where she represented youth and families in petitions for immigration relief before the Immigration Court and United States Citizenship and Immigration Service. Eva built foundational immigration law experience as a student legal advocate in the UC Davis School of Law Immigration Clinic, as well as in private and non-profit settings. As Editor in Chief of the UC Davis Law Review, Eva was proud to direct the editorial process of a volume of articles written by the nation’s leading scholars in immigration law. Eva’s belief in freedom of movement and the right of families to remain together drives her work as an immigration attorney and advocate. She strives to make difficult processes more transparent for clients through compassionate, attentive, and collaborative representation. Eva is a California native who has studied and lived in Chile and Argentina. Eva is fluent in Spanish. Monica Oca Howell Monica Oca Howell Monica Oca Howell Monica Oca Howell is a Senior Immigration Attorney who has specialized in humanitarian and family-based immigration law for over eleven years. Prior to joining Stouffer Law, Monica served as the Supervising Attorney for the Attorney of the Day (“AOD”) Program, housed within the Justice & Diversity Center of the Bar Association of San Francisco. As the program’s Supervising Attorney, Monica trained and onboarded volunteer attorneys who provided counsel and limited scope representation to pro se respondents in removal proceedings before the San Francisco Immigration Court. Monica also participated in nationwide efforts to protect the interests of the immigrant community, including advocating against the Dedicated Docket and promoting legislation that would increase access to counsel. Monica is the proud daughter of immigrants from the Philippines. Her mother left her home country in the late 1960s to work as a schoolteacher in Iowa, and was later able to petition her entire family to come to the United States. Monica is inspired every day by the challenges that her mom overcame to live and thrive in the U.S. She is deeply passionate about the practice of immigration law and is dedicated to providing quality legal representation to her clients. Monica is a California native and is fluent in Spanish. Erica Monzon Erica Monzon Erica Monzon Administrative Assistant Erica is the proud daughter of immigrants and a native of San Francisco with more than 20 years of administrative experience in companies throughout the Bay Area. Prior to her time at Stouffer Law, Erica was the lead administrative assistant for a major labor company in Northern California, where she worked closely with the executive team to establish a management-to-employee workflow and communication system that employed dozens of workers in underserved communities. After almost two decades of balancing a family of 3 children and work, she pivoted to a career that will allow her to grow as a professional with a new challenge — following her passion for helping others. In joining Stouffer Law Erica is excited to help the legal team better navigate clients through a critical transition in their lives — much like she did for her parents 25 years ago. She enjoys meeting people from different countries who, just like her parents, immigrated to the United States and sought a better life for themselves and their loved ones. [email protected] Hablamos Español ~ Contacte a nuestra oficina hoy En Es EN | ES --> Client reviews Blog Home Services About Our Team FAQs Contact FAQs Do you offer a free initial consultation? While we do not offer free in-depth consultations, an attorney or intake specialist is glad to speak with you for a few minutes to do a screening, answer questions you may have about us and make sure that we can meaningfully address your questions in a more in-depth consultation. We do not want to waste your time or money, so we will let you know if it seems your particular issue is outside the scope of our expertise. When we do meet you for an initial consultation the attorney will take time to carefully review your circumstances and answer whatever questions you may have. The attorney will also explain the appropriate immigration laws and give you an honest and thorough assessment of your options. Our goal is for you to leave the initial consultation empowered. How much does the initial consultation cost? Our initial consultation fee is $400. Why do I need an initial consultation? Why can’t you answer my questions over the phone before I come to the office? Immigration law is complicated. The laws have changed over the years and continue to change frequently. During the first Trump administration there were over 1000 major changes made within 4 years, amounting to nearly one major change every day. During the initial consultation we will get to know your unique circumstances in the context of the immigration laws so that we can provide a tailored assessment. We will also spend time explaining the applicable laws and rules so you can make the most informed decision for yourself and your loved ones. Of course, it is our hope to help you identify the most efficient and cost-effective immigration options, but sometimes it may be the case that we do not see any viable options for you under the current state of the laws. If this happens, we hope you will find value in knowing you may have avoided filing something for which you are not eligible, wasting time and money and potentially causing even more complications. I just have one or two simple questions. Can’t I just ask you my question on the phone before we meet? Immigration law in the United States is not at all simple. Immigration law is complicated to begin with, and to complicate matters even more, the laws have changed over the years and continue to change constantly. Although immigration law is under the auspices of federal law, there are still differences in how laws are interpreted throughout the United States. We often hear clients compare their circumstances to a friend or loved one. While it is natural to want to do so, it can be dangerous to make assumptions this way. Someone may seem to be in a similar situation on the surface, but there can be many variables and differences. It is always best to consult with a reputable and experienced immigration attorney to avoid costly mistakes and pitfalls. Do you provide phone, Zoom, or Skype consultations? Yes. This is our preferred way to meet since COVID-19 hit in March of 2020. We do still offer in-person consultations. How much will a case cost? Can you give me a quote for a particular case over the phone? We bill hourly for most of our legal services. This way you are only billed for time actually spent (as opposed to having us guess how much time a process will take and potentially overcharge you if we spend less time). We are also careful not to undercharge and risk losing the high quality of services we provide. Whenever possible, we can accept a down payment and then work out a plan for payments in installments according to when we will be performing the work on your case. The aim is to always have enough funds at the ready in your client IOLTA trust account (which is almost like a savings account dedicated for your case) to immediately get to work when there are new steps, when unexpected deadlines arise, and for any other twist and turn in the case. You will probably find there are attorneys charging less and attorneys charging more than we do. What we can say is this: We provide personalized service based on years of experience practicing exclusively immigration law. We are there for you every step of the way in your case. We do not quote a range of legal fees until we have the chance to first meet with you. During our initial consultation we will get to know your unique circumstances in the context of the applicable immigration laws so that we can do our best to provide an assessment, and a range of estimated fees, tailored to your case. There are so many variables that need to be considered. While we truly understand why a potential client wants to know even a general estimate, we do not feel that it is responsible to create any expectations before first having an understanding of all the unique circumstances of the case. At the end of your consultation, the attorney will give you an honest, straightforward assessment of your options and the likely costs for each option. This is still our best estimate, because we truly cannot anticipate what changes may happen in your circumstances or with immigration laws and policies. At the close of a consultation it will be up to you to decide how to move forward. We understand choosing an attorney is a big decision and encourage you to decide which attorney feels right to you. Do I really need an immigration lawyer? This answer depends on many factors. Whether or not you ultimately decide to hire us or another qualified immigration attorney for a particular case, we do strongly recommend at least having an in-depth consultation. A consultation can be invaluable. Once you have all the information you need, you can decide whether you need an attorney. Immigration law is very nuanced, complicated, and ever changing. It may seem straightforward to fill out and file a form, but there is much more that needs be taken into consideration to avoid delay, pitfalls, or denials. For example, every time a new form is filed with immigration, any past immigration history, filings, entries, and exits will be scrutinized by the adjudicator. For that reason, it is wise to have an attorney specializing in immigration law screen for any potential complications and then manage the process. It is not our intention to sound scary, but we often encounter clients who have filed something incorrectly or filed something that should not have been filed. An ounce of caution in the beginning of the process can literally save years and thousands of dollars. So, the moral of the story is that you should least have a consultation and probably hire an attorney. Other attorneys offer free consultations, why don’t you offer a free consultation? We block out time to review your documents, get to know your unique history and explain the immigration law and options to you. Our aim is to give you valuable information and tools to make the most informed decision for yourself and your family at the end of that hour of consultation. We will not rush you in and out of our office. While there may be attorneys who offer a free thorough initial consultation, it is often the case that the meeting will be rushed and lack the personalized level of detail we believe is critical. Please also see the answers about consultations above. How does hourly billing work? Once the attorney assesses your case in the initial consultation they will provide you with an estimate of the total for the case and request payment in that amount. This is our best estimate, because we truly cannot anticipate what changes may happen in your circumstances or with immigration laws and policies. Often, we can also offer payment plans as a courtesy. Our objective is to have enough funds in you Lawful Permanent Resident Status/Green Cards - Stouffer Law Skip to content Want us to help? For certain types of waivers, the U.S. government can waive your inadmissibility if you can show that your absence from the U.S. would mean hardship to your U.S. citizen spouse or parents. Our attorneys have well over three decades of combined legal experience helping clients with such cases. We are ready to help you determine if you might be eligible for a waiver. There are different types of waivers, we determine which one best applies to you There are many different waivers available depending on your unique circumstances, including: Applying for a visa through a U.S. Consulate. If you are located outside of the U.S. and applying for a visa, you may need to apply for what is called an I-212(h) hardship waiver if you have a past criminal record. If you are inside the U.S., you may need to apply for what is called an I-601 hardship waiver (or an I-601A if you are currently in the U.S. but plan to leave to reapply for entry). Going through removal proceedings. If you are going through deportation or removal proceedings, you may need a I-212(c) waiver to avoid deportation after a criminal conviction. Applying for a non-immigrant visa. You may need a I-212(d)(3) waiver for a temporary visitor, work or student visa. These are just a few examples of waivers. It is extremely important to get an honest and thorough assessment based on your unique individual circumstances. We can discuss your situation and answer any questions you have during an initial consultation. When a waiver is available, we work closely with you. There is an art to this! PROFESSIONAL, THOROUGH, AND COMPASSIONATE In the 9 years that I have partnered with immigration attorneys as a translator and personal declaration writer, I have not had the pleasure of working with a firm as well-rounded as Christine Stouffer's. I'm consistently impressed by their dedication to client care. During the many video conference calls in which I serve as an interpreter for her Spanish-speaking clients, I have witnessed genuine care and compassion, as well as clear guidance regarding each step of the process. When it comes to the personal declaration work that I do, each draft is refined through the constant and thoughtful feedback from her team. Unprompted, I hear wonderful comments about Christine and everyone at the firm directly from the clients. At Stouffer Law, we are honored to have helped many individuals and families from all over the world win their human right to live safely in the United States through asylum. Our lead attorney, Christine Stouffer, has worked with the Lawyers’ Committee for Civil Rights Pro Bono Asylum Program as interim staff attorney, and with other humanitarian organizations, for over 10 years. She proudly continues to serve as a mentor attorney in the program and participate in panel discussions and trainings. We consider the many requirements for asylum To qualify for asylum, you must show that you have either been persecuted in the past or have a well-founded fear that you will be persecuted in the future based on at least one of the following grounds of persecution: Religion Nationality Race Political opinion Membership in a particular social group (a “social group” may include being a victim of domestic violence or being a member of a group based on gender or sexual orientation) You must apply for asylum within one year of arriving in the United States. There are some exceptions to the one-year deadline. An exception can be made, for example, if your family’s life circumstances, or the circumstances in your home country, have changed. If you are genuinely afraid to return to your home country, asylum may be available to you regardless of whether you have legal status in the United States or not. Please contact us if you have any questions about the process or whether you may be eligible for asylum. The consultation is confidential. Based on our long experience and up-to-date knowledge of the laws, the experienced attorney conducting your initial consultation will provide you with an honest and thorough assessment so that you can make the best decision about how to move forward. [email protected] Hablamos Español ~ Contacte a nuestra oficina hoy En Es EN | ES --> Client reviews Blog Home Services About Our Team FAQs Contact Humanitarian Paths: U Visas & T Visas, Visas for Victims of Crimes or Human Trafficking Services > Humanitarian Paths: U Visas & T Visas, Visas for Victims of Crimes or Human Trafficking T visa benefits If you or your family members are survivors of human trafficking, which could have been sex trafficking or labor trafficking, you may be eligible for a T visa. The trafficking must have happened at least in part inside the United States. A T visa provides nonimmigrant lawful status and authorizes you to work in the United States while your application is pending and for up to four years after approval. As an individual T-visa applicant, you may be able to include certain family members, such as your spouse and children, and in some cases parents and unmarried minor siblings, depending on your age and circumstances. When applying for a T visa, you can also request that the U.S. government forgive (“waive”) many past immigration violations and in some circumstances even criminal issues that resulted from the trafficking. A T visa also offers a path to U.S. citizenship. T-visa holders can generally apply for lawful permanent residence after three years in T-visa status, or in many cases earlier, if the trafficking investigation is complete. We make sure you fulfill all the essential requirements for a T visa A central part of the T-visa process is showing that you are a victim of a severe form of trafficking, that you are physically present in the U.S. because of the trafficking, and that you would suffer extreme hardship if you were forced to return to your home country. In most cases, adult applicants must also show they have been helpful to law enforcement in the investigation or prosecution of the trafficking, although children are exempt and certain exceptions apply. Unlike the U visa, the T visa does not require a law-enforcement certification form, but documentation of the trafficking and your cooperation (when required) is still very important. We guide you through presenting the strongest evidence to meet these requirements. U visa benefits If you or your family members were a victim of certain serious crimes that occurred in the United States, you may be eligible for a U visa. A U visa gives you nonimmigrant lawful status and authorizes you to work in the United States while your application is pending a final decision and for up to four years after approval. You as an individual applicant of a U visa can include certain family members in your application, such as a spouse and children. If you apply for a U visa, at the same time you can often apply for the U.S. government to forgive (“waive”) past immigration violations and even criminal convictions. Generally, a U visa offers a path to U.S. citizenship. A U visa holder can normally apply to become a lawful permanent resident after holding U visa status for three years. We make sure you fulfill all the essential requirements for a U visa One crucial component of the U visa process is demonstrating that you, the applicant, were and still are helpful to the investigation and prosecution of the crime. A designated official at the appropriate law enforcement agency, such as a police department or district attorney’s office, must sign a form stating that you were helpful to the investigation or prosecution. It is extremely rewarding for our staff at Stouffer Law to help clients and families turn a traumatic event into something positive: stabilizing their legal status in the United States. In our office, we celebrate every time a client’s T or U visa has been approved. It brings us a lot of joy sharing the good news with our clients and knowing that a transformation has taken place beyond the legal status. Ready to Take the First Step? Ready to Take the First Step? So, for everyone who is looking for a firm with experience and a humane approach to each immigration case, I tell you that you will be in excellent hands. Obtaining a fiancé visa is a multi-stage process. If not filed properly, your application can be subject to delays at each stage. But sometimes this path is not the best option for you and your loved one, which is why during the in-depth initial consultation our experienced immigration lawyers can help you decide whether this is the best path for you in the first place. If the fiancé visa is indeed the best path, we will manage the process for you each step of the way to avoid unnecessary delay or denial of your application. Eligibility requirements If you are a U.S. citizen, you may sponsor your fiancé to enter the United States on a K-1 fiancé visa. One important requirement that individuals representing themselves often do not get right is documenting that you have met your fiancé in person within the last two years. There are exceptions to this requirement, but they are specific and limited. Once your fiancé enters the United States, you are required to get married within 90 days. After the marriage takes place, you must file an application inside the United States for your fiancé or fiancée to become a lawful permanent resident/green-card holder. Please contact us if you have any questions about the process. The initial consultation is confidential. Based on our in-depth experience and up-to-date knowledge of the laws, we will provide you with an honest and thorough assessment so that you can make the best decision about how to move forward. Facing removal from the United States has serious consequences. Losing your case can result in family separation, being forced to leave your home of many years, and being sent into life-threatening circumstances. We understand this. We will advocate tirelessly for you. We will work with you to present the strongest case possible throughout the removal proceedings. You can trust that we have the knowledge and skills to fight for you. Our lead attorney, Christine Stouffer, is a Certified Specialist in Immigration with the State Bar of California and has worked on many deportation cases. She additionally served for several years as the Executive Office for Immigration Review (EOIR) co-liaison to the San Francisco Immigration Court for the American Immigration Lawyers Association (AILA) Northern California Chapter. This experience has allowed her and the team to develop unique insights into how removal proceedings work. Rest assured our experienced attorneys will assess and present all possible defense options tailored to your unique circumstances. When you are in removal proceedings you either receive a full hearing or an expedited hearing, depending on your legal status. You have multiple possible options for a defense against removal. These include, but are not limited to the following: You qualify for asylum. You cannot be removed based on the charges. The government did not properly serve you with your notice to appear. You qualify for permanent residency based on hardship to family members. These are just a few examples of defenses. They are by no means guaranteed and each option has many requirements. We will do everything we can, matching our knowledge and expertise with your unique set of facts to present the most effective case on your behalf. Ready to Take the First Step?
