We offer a 5 year program with a foundation in educational incentives and work opportunities, supported by temporary financial assistance, leading to self sufficiency. Our doors first opened in 2001 with 1 small office in Thermal, CA and have since grown to 7 regional offices spanning L.A. and Riverside counties. Special focus is put on traditional values and cultural awareness as we serve the Native community with a determination to support, educate and guide our clients along the path to self sufficiency. TANF Services The TMDCI Tribal TANF Program will provide the following types of services to eligible needy families and their children: A. Temporary Cash Assistance The TMTTP will provide up to 60 monthly financial assistance grants to eligible, non-exempt families to meet their basic needs for items such as: shelter, utilities, clothing and other incidental needs and basic necessities. Assistance may be provided through the issuance of monthly checks, vendor payments, vouchers or electronic benefit transfers. B. Needy Child Assistance for Non-Needy Caretakers The TMTTP will provide assistance to needy Indian children who are in the temporary care of custodial Non-Needy Caretakers. Assistance will include monthly cash grant based on the number of needy children in the Non-Needy caretaker’s household. C. Emergency/Crisis Assistance – Non-Recurring Short Term Benefits As Per 45CFR 286.10 TMTTP temporary cash assistance recipients in crisis will be eligible to receive Emergency/Crisis Assistance as delineated in the Program Policy Manual to assist them in resolving the temporary crisis. This type of assistance may be used for emergency shelter expenses, housing, and utilities when they lose their place of residence or receive a notice to quit, eviction or utility cut-off (Telephone service will also be included if recipient lives more than ¼ mile from nearest access). Food, clothing and incidental expenses may also be provided in emergency/crisis situations and when need is verified. Recipients receiving emergency assistance for housing or utilities will be required to participate in a household budgeting class and vendor pay the housing and/or utility expenses for a minimum of twelve months following receipt of benefits. D. Employment and Training Related Support Services TMTTP will reimburse all TANF temporary cash assistance recipients or non-custodial parents of needy TANF children for all allowable pre-approved out-of-pocket expenses related to their participation in a pre-approved and agreed to Personal Responsibility Plan. Allowable expenses will include but are not limited to child care, transportation and transportation related expenses, education and training costs, school/work/interview clothing, job placement expenses, professional fees and union dues; other expenses outlined in the support services guidelines established by the program and in compliance with federal rules and regulations regarding allowable expenses. Select Form Complaint Form DOWNLOAD FORM HERE 114 COMPLAINT PROCESS It is necessary that all staff members realize the importance of their roles in the success of our client households. The manner in which TANF staff members conduct themselves in the delivery of assistance to stressed or traumatized persons may be just as significant as the type of provided program service itself. It is important that client matters are treated confidentially, respectfully, fairly, and timely. In the event a client, applicant, or community member cannot resolve a matter with the assistance of FDS Manager, FPS Manager, or Regional Director involving the delivery of service or behavior of a staff member the client may provide a written complaint to the Executive Office. Clients that are also TANF staff members may not use company equipment (email) or time to submit or follow up on personal complaints. Note: a client or applicant complaint is not a substitution for an appeal to services or service changes. 114-1 COMPLAINT PROCESS The goal of a complaint resolution is the improvement of customer service. · If a client or other non-staff person wishes to lodge a written complaint the individual will be provided with a Complaint Form and asked politely to complete and return it. Staff not directly involved in the complaint or resolution may offer assistance with form if necessary. · If the TMTT Complaint Form is not available, the client or applicant may submit a written document including: date, office, case worker, name, contact information, brief description of the problem, and a suggested resolution. · Upon submittal of the Complaint Form the receiving staff person will date stamp the form, provide a copy to submitter, place original in an envelope marked “Complaint, Confidential” and forward it immediately to the Executive Office. Mailed forms must also be directed in a similar manner to the Executive Office, but will not provide the submitter a date stamped copy. · The Executive Assistant will indicate date received and forward the complaint to the Executive Director who will assign a designee/director to investigate the matter. The designee will proceed with finding a resolution at the lowest staff or managerial level possible. This will include communicating with the complainant, interviewing staff, reviewing the client’s file, identifying findings, and presenting a written summary to Executive Director within ten workdays. If a resolution is not possible at an office level the matter will be taken up by the Regional Director or Deputy Director of Programs, Deputy Director of Operations, and finally to the Executive Director. The Executive Director will issue a final outcome within 10 workdays from receipt of report. The designee will then provide the client a written response to the complaint. It should not take more than two business day for the Executive Office to receive a documented complaint from any satellite office. Appeal Form DOWNLOAD FORM HERE Important Information Right to Appeal Appeals address sanctions and adverse decisions affecting client case services. If a client believes their client rights to services have been violated, they may appeal. Torres Martinez Tribal TANF is not responsible for loss, damages, or events resulting from a case action or appeal resolution. When to Appeal You must appeal within 30 calendar days from the date of this notice or from the date of an adverse action to your case. A Notice may not always be provided if it’s due to fraud, loss of custody, and/ or if you are no longer residing within the service area. A written letter may be accepted if it includes all required information listed within the section of this notice. [email protected] . Torres Martinez Tribal TANF is not responsible for loss or delays in delivery of appeals or other documents. Appeal Process Upon receiving your appeal, an investigation will be made to determine a resolution. Upon determination, Executive Office will notify the client by mail within 10 business days of receiving the complete Appeal form. Failure to provide a timely resolution to a client will not default to a positive and/or approved appeal response. Clients will be notified should more time be required to reach a resolution. Clients may not further contest an unfavorable appeal response. Clients may choose to maintain receiving benefits during the appeal process, unless the case was suspended due to fraud. If no suspension, the client may receive full benefits until a final decision is determined. If the appeal is lost, the client will have to pay back the benefits received while the appeal was pending. A client may also ask the Tribal TANF Program to suspend benefits until a decision is reached. Funds may be retroactively restored if determined appropriate in the appeal decision and eligibility and compliance is established Required Information Name of person appealing, Rite Track number and address. The Federal Code of Regulation, Chapter 25 gives Gaming Commissions the jurisdiction to conduct background investigations while Federal Code of Regulations §556 and §558, Tribal-State Compacts, and National Indian Gaming Commission Regulations provide the guidelines and requirements for conducting those background investigations. Vendor License All business entities that are required to obtain a Gaming Resource Supplier or Vendor License will need to provide: Scope of Work to be performed/Contract; Articles of Incorporation/Articles of Organization; Financial Statements; Business Licenses; FALSE STATEMENTS Deliberate misstatements to investigators or omissions on the gaming application can result in your disqualification, regardless of the nature or reason for those misstatements/omissions. In brief, it is imperative that all applicants provide complete and accurate information to the Gaming Commission during the background process. CONTINUING DUTY All licensees are required to report all changes in the background information provided on their application (e.g. address change, financial issues, civil litigation, subject in an arrest, pending criminal charges, or convictions) within ten (10) business days. Applicants may contact the Gaming Agency between the hours of 8:00am and 4:00pm at (760) 395-1200 extension 7160 Monday through Friday. LICENSE DURATION Gaming Licenses are valid for two years. After two years, each licensee will go through a renewal background investigation to ensure adherence to the standards required to maintain a gaming license. FEES ALL NEW AND RENEWAL APPLICANTS WIL BE SUBJECT TO TMGA’S LICENSING FEE’S UNLESS OTHERWISE STATED IN WRITING, OR WAIVED BY THE TMGA. LICENSING FEES ARE AS FOLLOWS; NEW APPLICANTS; $1,000.00 (PMO), $500.00 (State Key), $350.00 and $200.00 (Non-Key) and ALL RENEWALS; $100.00. The Casino currently pays these fees for the applicant. Patron Disputes Gaming Dispute Process 1. You must notify the Casino Shift Manager or Department Manager if you feel the dispute is warranted. If the dispute involves and amount at least $500.00 the Red Earth Casino will notify the Torres Martinez Gaming Agency of the dispute. 2. If you are dissatisfied with the Casino Shift Manager or Department Manager’s response you must notify the Assistant General Manager or the General Manager’s office within three (3) business days of the occurrence in an attempt to resolve the gaming dispute. 3. If you do not agree with their response or findings, you must notify the Torres Martinez Gaming Agency in writing with all pertinent facts related to your dispute within fifteen (15) days of the original complaint. Torres Martinez is the largest private landowner of property in and around the Salton Sea. This is their aboriginal homeland and it must be protected for those future generations of people. In 2002 the Tribal Council decided to take a proactive approach to the transfer of water away from the Salton Sea caused by the Quantification Settlement Agreement between the State of California and 4 water agencies. This transfer of water will have huge impacts to the tribe due to volatilizing sediments in the Salton Sea bed as the sea recedes. There are 100 years of pesticides, selenium and other problematic factors in these sediments in the Sea. Because the Salton Sea is due to be reduced by 50% starting the year 2017, they decided to allow a shallow wetland pilot project to be built using grant funding. The first Bureau of Reclamation grant was written in 2003 for the engineering of the wetlands. Later in the year the first US EPA grant was written for the build of the project. Every year subsequently grants have been written through various agencies to sustain the wetland project. In 2009 the General Membership voted to allow the wetland project be allowed to be placed into the tribally Owned Non Profit. This will ensure the project and future build outs will be kept in perpetuity for future generations and visitors to enjoy. The pilot project is 85 acres in size. It consists of 7 water quality cells and 4 habitat ponds. We anticipate opening the visitors center by 2010 and opening the project to the public for visits and events. Currently, visits must be pre-arranged until we are fully open and operational. Should there be information received on the fingerprint results, which the applicant deems to be inaccurate, there is a process, which the applicant can follow to challenge the information on their Criminal History Record Information, which can be viewed here. You are required to provide the following identification documents: Valid Driver’s License or Identification Card; Social Security Card; Birth Certificate or Naturalization Certificate; U.S. Passport; Permanent resident card or employment authorization card, if applicable; DD214, if applicable; All information provided by the applicant will be verified during the background investigation. Work Permit/Non-Key Employee License Individuals who do not meet the criteria to be licensed as Key Employee/Gaming Employee or Primary Management Official will undergo a background check and be licensed as a Work Permit/Non-Key Employee. Vendor License All business entities that are required to obtain a Gaming Resource Supplier or Vendor License will need to provide: Scope of Work to be performed/Contract; Articles of Incorporation/Articles of Organization; Financial Statements; Business Licenses; FALSE STATEMENTS Deliberate misstatements to investigators or omissions on the gaming application can result in your disqualification, regardless of the nature or reason for those misstatements/omissions. In brief, it is imperative that all applicants provide complete and accurate information to the Gaming Commission during the background process. CONTINUING DUTY All licensees are required to report all changes in the background information provided on their application (e.g. address change, financial issues, civil litigation, subject in an arrest, pending criminal charges, or convictions) within ten (10) business days. Applicants may contact the Gaming Agency between the hours of 8:00am and 4:00pm at (760) 395-1200 extension 7160 Monday through Friday. LICENSE DURATION Gaming Licenses are valid for two years. After two years, each licensee will go through a renewal background investigation to ensure adherence to the standards required to maintain a gaming license. FEES ALL NEW AND RENEWAL APPLICANTS WIL BE SUBJECT TO TMGA’S LICENSING FEE’S UNLESS OTHERWISE STATED IN WRITING, OR WAIVED BY THE TMGA. LICENSING FEES ARE AS FOLLOWS; NEW APPLICANTS; $1,000.00 (PMO), $500.00 (State Key), $350.00 and $200.00 (Non-Key) and ALL RENEWALS; $100.00. The Casino currently pays these fees for the applicant. Patron Disputes Gaming Dispute Process 1. You must notify the Casino Shift Manager or Department Manager if you feel the dispute is warranted. If the dispute involves and amount at least $500.00 the Red Earth Casino will notify the Torres Martinez Gaming Agency of the dispute. 2. If you are dissatisfied with the Casino Shift Manager or Department Manager’s response you must notify the Assistant General Manager or the General Manager’s office within three (3) business days of the occurrence in an attempt to resolve the gaming dispute. 3. If you do not agree with their response or findings, you must notify the Torres Martinez Gaming Agency in writing with all pertinent facts related to your dispute within fifteen (15) days of the original complaint.
