Definition Asylum is immigration protection and rights given to you, a foreigner, who comes to the U.S.  You may be allowed to stay in the U.S. if you can prove that you were persecuted in your home country or will suffer persecution if you return to your home country. You can also include your spouse and unmarried children under 21. Through asylum you may possibly become a permanent resident and citizen after several years if you have a strong asylum case. ​ II. Basic requirements for asylum 1. Grounds for asylum To be eligible for asylum you have to prove that you suffered persecution or you will suffer persecution because of any of the following grounds: Nationality Membership in a particular social group Political opinion Race Religion * Note that you can apply for more than one ground of asylum. For example, you can show that you were persecuted because of your nationality and particular social group. 2. Timing and place of submission File your asylum application within one year of your arrival to the United States (but note there are timing exceptions). Or when you ask for asylum at the port-of-entry (border crossing, airport) you have to apply within one year of your arrival through this entry point. 3. No bar to asylum You may not be eligible for asylum if you committed certain crimes in the past, had a previous asylum application denied, and can be removed to a safe third country (depending on agreements between the U.S. and other countries). ​ III. Benefits of asylum 1. Green card After about a year of getting asylum status, you, your spouse and children under 21 will be eligible to apply for a green card (permanent residence). 2. Employment authorization Although you cannot apply for employment authorization at the same time you apply for asylum, you can apply for it later if: 150 days have passed since your filing of your asylum application; and No decision has been made on your case yet. * Note that if you are given asylum status, you can work even if you do not have an Employment Authorization Document. 3. Social Security Card If you are given asylum status, then you can immediately apply for a Social Security card. 4. Family You can petition certain family members if you entered the U.S. as a refugee within the past two years or were given asylum within the past two years. 5. Travel Documents If you want to travel outside the U.S. while applying for or after getting asylum status, you have to get permission to travel. WHAT IS vawa? VAWA, which stands Violence Against Women was enacted to improve community-based responses to domestic violence, sexual assault and other forms of abuse against married spouses. ​ II. ELIGIBILITY REQUIREMENTS If you are an abused spouse of a U.S. citizen or resident, you may be eligible for certain benefits such as the ability to “self-petition”. The abused spouse can apply for VAWA by herself without relying on her husband during the legal process. In addition, while the VAWA petition is pending, the abused spouse will be eligible for work authorization, may not have to leave the country and be protected from deportation. Below, is the simplified process of filing VAWA. ​ ​ III. Process Overview of VAWA File Form I-360 (Petition for Amerasian, Widow(er), or Special Immigrant) at the Vermont Service Center (VSC) with supporting documents proving requirements are met. USCIS will review your application and send a “Notice of Prima Facie Eligibility” which you can use to obtain government aid, such as Medicare, Title IV Federal Student Financial Aid, and Section 8 Moderate Rehabilitation Single Room Occupancy (“SRO”) If application is approved, USCIS will send an “Approval Notice” and a “Notice of Deferred Action” (if requested). Deferred action refers to applicant coming illegally, but USCIS will likely not deport you due to pending VAWA petition. Attorney Santamaria leads the law firm team and together with the team, they’ve assisted clients obtain various non-immigrant and immigrant visas (e.g., investor visas, work visas, marriage visas), humanitarian relief at USCIS and from Immigration Court (e.g., asylum, cancellation of removal), and many other types of immigration relief.   He and the firm have been recognized by several consulates in the Bay Area and community organizations for their work in advocating for immigrants. He supervises the staff in writing appellate briefs, pre-hearing statements, motions, and other legal documents for Immigration Court and USCIS. He is licensed to practice law in California and is a member of the American Immigration Lawyers Association.  ​ Attorney Santamaria has significant experience in teaching the law. He currently teaches LL.​M.​ Legal Research and Writing at UC Berkeley Law School. He is also a professor in the Immigration Law Clinic (“Clinic”) at San Francisco Law School. At the Clinic, he teaches removal defense and directs the externship program in which law students participate in cross training sessions with PhD psychology students to assist immigration clients with their various cases. He was also an SJD (PhD equivalent) Dissertation Committee Member at Golden Gate University Law School in which he guided his students in legal research and writing and conducted, or participated in their first and final oral defenses.  ​ Attorney Santamaria obtained his communication skills from his background in teaching English to immigrants. He teaches English as a Second Language (“ESL”) at City College of San Francisco where he was voted as a member of the Academic Senate in 2017 where he served for about a year. His mother immigrated here through a work visa. He knows the immigrant story quite intimately through his family and growing up in an immigrant community — Daly City, California. He saw his parents struggle and save everything they could to achieve the American Dream. Seeing the sacrifices his parents made, inspired him to honor them through his own hard work. Children, obey your parents in the Lord, for this is right. Honor your father and mother which is the first commandment with a promise, so that it may be well with you, and that you may live long on the earth. Ephesians 6: 1-3 Growing up in an immigrant community inspired Marc to connect with his roots in the Philippines. After graduating from UC Berkeley with his Bachelor’s in Legal Studies, Marc studied at the University of the Philippines, Diliman and wrote a published article on Filipino immigrants to the U.S. While writing this article, he interviewed a U.S. embassy official. On the way to the interview he saw long lines of people waiting to talk with immigration officials. Some came from the south and had to take boat and plane rides to talk with the immigration officials—and stay there overnight. It was not fair for him to easily get into the embassy and interview an embassy official, while others had to wait overnight. At that point he knew the U.S. immigration system had to be fixed. THE MEANING OF OUR LOGO Our logo is meant to be more than just a fish. It’s a Christian symbol for Jesus and His call for Christians to be “fishers of men. The rule made it more difficult for immigrants to obtain legal status because being a public charge is a ground of inadmissibility. In determining whether an immigrant is inadmissible, a USCIS officer has to decide whether an immigrant is likely to become dependent on certain government benefits in the future, which would make them a “public charge.” The Trump-era public charge rule was implemented in 2019 and had been in effect in the majority of states in the U.S. But the Biden administration decided to no longer pursue this course of action in the Supreme Court because they argue that it’s not in the public interest nor an efficient use of limited government resources. This means that the guidance passed in 1999 on public charge will apply, which makes it safer for immigrants to obtain Medicaid, COVID relief, housing, food and other services.
