All retail gasoline dispensing facilities (GDFs) in Butte County are required to have a Permit to Operate for their Phase I and Phase II vapor recovery systems. All non-retail gasoline storage tanks 550-gallons or larger are also required to have a Permit to Operate. The Permit to Operate outlines operating, source testing, maintenance, and recordkeeping requirements. If you are a new facility and would like to apply for a permit, an Authority to Construct application form must be completed and returned to the District. Authority to Construct application forms can be found here . If you have any further questions about the application process or permit requirements, contact Dave Campbell at (530) 332-9400 ext. 102. Source testing Retail and non-retail GDFs require vapor recovery source testing on an annual basis. GDF performance testing shall be completed annually, no later than twelve (12) months after the previous annual performance test. The District shall be notified at least ten (10) days prior to the source test date(s) so that District personnel can witness the tests, and the results shall be provided to the District office within 30 days of completion. The permit holder is responsible for source test scheduling. If you have questions regarding source test requirements and scheduling, contact Dave Campbell at (530) 332-9400 ext. 102. Planning to make equipment changes? All major equipment modifications at existing GDFs must be completed under an Authority to Construct permit. Authority to Construct permits can be found here and must be completed and approved before modifications begin. Also, start-up testing is required within 30 days of the completed equipment installation. This grant program provides funding for replacing, repowering, or retrofitting eligible heavy-duty engines with cleaner-than-required technology. The Funding Agricultural Replacement Measures for Emission Reductions (FARMER) Program provides funding through local air districts for agricultural harvesting equipment, heavy-duty trucks, agricultural pump engines, tractors, UTVs, and other equipment used in agricultural operations. Air Quality Awareness Week is promoted by federal, state, local, and tribal agencies to share information with the public about efforts to protect and improve air quality. Each day this year has a different air quality theme. Monday, May 1 – Wildfires and Smoke Tuesday, May 2 – Asthma and Your Health Wednesday, May 3 – Air Quality and Transportation Thursday, May 4 – Air Quality and Climate Friday, May 5 – Participatory Science We’ll be adding local information and perspective below each day! What do prescribed fire , low cost sensors, and goats have in common? Community Participation! Communities and individuals all around Butte County have participated in ways to reduce wildfire risk and track air quality conditions. Low-cost air quality sensors have helped fill in the gaps with knowing how smoke is impacting communities in Butte County. Smoke could be coming from wildfires, prescribed burning – which is necessary to prevent catastrophic wildfires, open burning, or burning in a woodstove or fireplace. Some of these sensors were installed by BCAQMD but many more are owned and maintained by community members. The Airnow Fire and Smoke Map is a great place to see official air quality monitors working in tandem with community sensors to inform the public about smoke impacts. The largest source of particulate pollution in Butte County is wildfire smoke. Wildfire prevention is also work to prevent hazardous air quality conditions in Butte County. That’s why BCAQMD is supportive of the local Fire Safe Councils , Resource Conservation Districts , and other agencies and organizations that leverage community action to help reduce wildfire risk. Thursday, May 4: Air Quality and Climate The Butte County Air Quality Management District incentive programs have reduced tons of smog-forming pollutants and particulates over the years through woodstove replacements, and heavy-duty equipment replacement projects. Grants have also reduced the emissions of toxic air contaminants like diesel particulates. This is important in Butte County because the areas has had issues meeting state and federal air quality standards for ozone and fine particulates (PM2.5). Another benefit from all these projects is the reduction in greenhouse gas emissions! The FARMER Program by itself has resulted in a reduction of 1,142 Metric Tons of CO2 equivalent through the replacement of agricultural equipment. Wednesday, May 3: Air Quality and Transportation Most smog-forming pollutants and greenhouse gases are emitted through the transportation sector. Fortunately, there are many ways to reduce the emissions of your ride. Riding a bike or taking transit are a great start! If you’re purchasing a new low-emission vehicle – be sure to check for rebates with the California Vehicle Rebate Program (CVRP) to save some money. If you’re looking for something bigger, check the Hybrid and Zero-Emission Vehicle Incentive Program (HVIP) for trucks, vans, and buses. If you need a clean off-road vehicle – take a look at the Clean Off-Road Equipment Program (California CORE) . Air Quality Compliance Specialist II Dave Campbell shares another example of how air quality and transportation intersect: Air Quality Never Sleeps Most gasoline service stations are open 24-hours, 365 days a year. Vapor recovery equipment only works if the equipment is installed, maintained, and operates as designed. District inspectors perform numerous inspections to ensure all equipment is operating in compliance which helps reduce smog-forming VOCs and limits the public’s exposure to benzene, a toxic air contaminant. Tuesday, May 2: Asthma and Your Health Today is World Asthma Day! Visit today’s AQAW Page on Asthma to learn more about how air quality can impact asthma. Many of the sources of air pollution that BCAQMD regulates can exacerbate asthma at high enough concentrations. Patrick Lucey, BCAQMD Assistant Air Pollution Control Officer shares this information on how certain activities are regulated in Butte County to reduce emissions: Permitting and Enforcement helps keep Air Quality in the Green The Butte County Air Quality Management District enforces federal and state stationary source permitting requirements for almost 800 facility processes that create air pollution to protect the health of the public. Examples of facility processes that require air district permitting are gas stations, gasoline storage terminals, printing presses, asphalt/concrete batch plants, cabinet shops, dry cleaning operations, large boilers/water heaters, large generators, incinerators, paint booths, rice/nut processing and wood product manufacturing. Permitting requirements vary depending upon the process at the facility. Some examples of permit requirements are: Retail gas stations are required to pass performance testing annually to ensure the vapor recovery systems are in working order. District staff attend these performance tests to make sure they are conducted correctly. Large-scale printing presses have daily throughput limits to ensure the amount of Volatile Organic Compounds (VOC’s) released do not exceed state regulations. Asphalt/Concrete batch plants are required to install Particulate Matter (PM) emissions controls and may also have throughput limits. Large natural gas/propane boilers and water heaters need to be the Low-NOx type to ensure Nitrogen Oxide (NOx) releases are minimal. Dry cleaning operations must keep their chemicals in sealed containers and make sure their equipment is free from leaks that can release the chemicals into the air. Paint booths must have filters installed at all times to capture PM while painting is occurring, and all paint/solvents must be kept in sealed containers to limit the release of VOC’s. The District recently received delegation approval from the EPA to take responsibility for overseeing compliance with the Demolition/Renovation Asbestos NESHAP. The District began processing notifications and surveys on January 1, 2024. Breathing airborne asbestos fibers can cause serious health effects, including asbestosis, mesothelioma, and risk of lung cancer. Asbestos is found in many building materials, including drywall, insulation, tiles, popcorn ceiling treatment and more. Asbestos fibers may be released into the air by the disturbance of asbestos-containing material during product use, demolition work, building or home maintenance, repair, and remodeling. In general, exposure may occur only when the asbestos-containing material is disturbed or damaged in some way to release particles and fibers into the air. Before hiring a contractor to perform any demolition or renovation work, you can check to make sure they are registered with Cal/OSHA; the State of California requires registration for contractors and employers that remove asbestos having an asbestos fiber content of more than 0.1% and 100 square feet or more of surface area of asbestos-containing material – see https://www.dir.ca.gov/databases/doshacru/acrulist.asp for more information. I am demolishing or renovating a single residential building or structure. If you are demolishing or renovating a single residential building or structure that has not been used for commercial purposes, you may complete the District Asbestos Exemption Form and submit it to our office. The District will complete and stamp the form and return it to you so it can be provided to the building department with jurisdiction over the proposed project. Regardless of the exemption status, the District recommends that you take measures to protect yourself and others from exposure to asbestos (Information from the US EPA). If you are demolishing or renovating a commercial, institutional, or industrial building or structure, or a residential building with five (5) or more units, the Commercial requirements apply. See the next section on our website for information on how to proceed. I am renovating / demolishing a commercial / institutional building or structure. District Regulations The Butte County Air Quality Management District (District) has historically been one of several air districts in the state of California that has been “non-delegated” to enforce the Asbestos National Emission Standard for Hazardous Air Pollutants (NESHAP). Non-delegated air districts are being transitioned to implement and enforce the applicable Asbestos NESHAP Air Toxic Control Measure requirements as the California Air Resources Board is no longer is providing oversight for the program. The Butte County Air Quality Management District recently adopted regulations governing asbestos testing, surveying and removal. Rule 516 sets the fee schedule for our asbestos program and Rule 270 sets the regulations on testing, surveying and removal of potential asbestos-containing materials. If you are demolishing or renovating a commercial, institutional, or industrial building or structure, or a residential building with five (5) or more units, the requirements below apply. Renovations where the total amount of material disturbed is less than 160 square feet, less than 260 linear feet (for pipes), or less than 35 cubic feet are exempt. Step 1: Is the Project Exempt? Projects that disturb less friable asbestos or Regulated Asbestos Containing Material (RACM) materials than listed below are not subject to Rule 270 and the project is exempt from District Asbestos Demolition and Renovation requirements. · 260 linear feet on pipes; or · 160 square feet on other facility components; or, · The total volume of Regulated Asbestos Containing Material (RACM) is at least 35 cubic feet. Complete and submit the District Asbestos Exemption Form. The District will stamp this completed form, so it can be provided to the building department with jurisdiction over the proposed project. Asbestos Demolition and Renovation - Exemption Form Step 2: Asbestos Survey If a project is not exempt , before any work begins, the building owner or operator must have a thorough asbestos survey performed on the project site. This survey must be completed by a Certified Asbestos Consultant (CAC) or Certified Site Surveillance Technician (CSST) licensed by the Division of Occupational Safety and Health (Cal/OSHA) and who has taken an EPA-approved Building Inspector course. See a list of local testing and abatement companies. Find a licensed CAC/CSST. Advisory on asbestos survey requirements. If there is asbestos present (more than 0.1% and 100 square feet or more), contractors and employers that remove asbestos must be registered with Cal/OSHA, through the Asbestos Contractors’ Registration Unit (ACRU) .
