Divisions Civil Division Frequently Asked Questions – Civil Law Frequently Asked Questions – Civil & Family Law In this section Civil Division Alternative Dispute Resolution (ADR) Information Frequently Asked Questions – Civil Law Landlord / Tenant (Unlawful Detainer / Eviction) Name Change Restraining Orders FAQs The court cannot provide legal advice or answer legal questions. Legal questions should be addressed to an attorney or the legal aid office. You may reach the local Self-help Legal Aid Office at (209) 754-1443. What forms are required to file a complaint? The Complaint, Summons, and Civil Case Cover Sheet are required at the time of initial filing. How must the defendant be served with my complaint? The summons and complaint may be served by a Sheriff, Marshal, registered process server, or anyone over the age of 18 who is not a party to the action. The party performing the service must complete and sign a proof of service form. The original proof of service must be filed with the court before a judgment can be obtained against the defendant. How do I respond to a complaint? If you have been served with a summons and complaint and want to respond, forms are available at the clerk's office. A five-day summons requires an immediate response. Be sure to the let the clerk know which type of summons and complaint has been served on you. Failure to file a response may lead to a judgment being entered against you. When are motions heard? FAMILY LAW – Tuesdays at 1:30p.m. in Courtroom 2, unless the regular judge has been disqualified. Please call the court for the date and time if disqualification. LIMITED/UNLIMITED CIVIL – Friday at 9:00a.m. in Courtroom 2, unless the regular judge has been disqualified. Please call the court for the date and time if disqualification. When are Ex-Parte motions heard? Courtroom 1: Monday through Friday at 11:30a.m. Courtroom 3: Contact Court for available dates. May I appear by telephone? You may appear by telephone for case management conferences, trial setting conferences, and some civil and probate motions. For settlement conferences, small claims, family law motions, and trials, you must appear in person. What is the difference between a minute order and transcript? How may I order a transcript? A minute order is the clerk’s brief record of what took place in court. A transcript is the court reporter’s word-for-word record. You may contact the court reporter directly by mail or phone at (209) 754-9810. Costs and payment arrangements are made directly with the court reporter. In which newspapers may I place a publication in Calaveras County? You may use the Calaveras Enterprise (located in San Andreas) or the Daily News (located in Valley Springs). Online Services Jury Service Jury Selection Jury Selection In this section Jury Service Failure to Appear Jury Selection Qualification & Terms Reporting Request for Deferral What to Expect About Jury Selection Once you have checked in, you will be directed to a courtroom. The clerk will call the role to determine who is present. Twelve to eighteen names on a random list of jurors will be called. These people will take seats in the jury box. The remaining prospective jurors will remain seated in the courtroom. The judge will explain what the case is about and introduce the lawyers and parties to you. All prospective jurors will be required to agree to truthfully answer all questions asked. Next, the judge and/or the attorneys will question each prospective juror seated in the jury box to find out if they would be an appropriate juror in the particular case. This is called voir dire. If a juror is excused during this process, the clerk will call the next name on the random list to take the place of the excused juror. Voir dire questioning may take more than one day. Carefully follow the directions of the judge and courtroom staff regarding date and time to return. If you are going to be late, immediately contact the clerk of the courtroom to which you have been assigned and explain your situation. Remember, the trial cannot proceed until everyone is present. Occasionally, issues arise in trial preparation or events occur during a trial which could not be anticipated. When this happens, the judge and the parties may need to address the matter outside of your presence. You should not speculate about what is going on. Rest assured that the judge respects your time and will make every effort not to waste it. Challenges During the selection process, an attorney may excuse you for a specific reason. This is called a challenge for cause. An attorney may also excuse you for no reason. This is called a peremptory challenge. If this happens, do not take it personally. The lawyer is merely exercising a right given by law. After the required number of jurors have been chosen, the jury panel is sworn to try the case. Online Services Jury Service Qualification & Terms Juror Qualification & Terms of Service In this section Jury Service Failure to Appear Jury Selection Qualification & Terms Reporting Request for Deferral What to Expect Juror Qualifications All persons are eligible and qualified to be prospective trial jurors, except the following: Persons who are not citizens of the United States Persons who are less than 18 years of age Persons who are not domiciles of the State of California as determined under the Elections Code Persons who are not residents of Calaveras County Persons who have been convicted of malfeasance in office or a felony, and whose civil rights have not been restored Persons who are not possessed of sufficient knowledge of the English language Persons who are serving as grand or trial jurors in any court of this state Persons who are the subject of conservatorship If you received a summons for jury service but are not qualified due to one of the above reasons, you must complete the disqualification statement on the jury summons and return it to the clerk prior to your service date. Term of Service Pursuant of Rule 2.1002 of the California Rules of Court a person has fulfilled his or her jury service requirement when the person: Served on a trial until dismissed; Was assigned to one or more trial departments for jury selection and served through the completion of jury selection or until excused by the jury commissioner; Attended court but was not assigned to a trial department for selection of a jury before the end of that day; Served one day on call; or Served no more than five court days on telephone standby. Upon completing your service obligation, you should not be called for jury service for one year. Trials vary in length, but generally last anywhere from one day to two weeks. You will be told how long the trial is expected to last during the jury selection process. Approximately 80% of our prospective jurors complete their service in one day. Divisions Probate Division Step-Parent Adoptions Step-Parent Adoptions In this section Probate Division Conservatorships Emancipation Of A Minor Freedom From Parental Custody And Control Guardianships & Guardianship Investigations Investigation Fees Marriage Permission For Minors Step-Parent Adoptions What is a Step-Parent Adoption? A legal process in which one legal parent has custody of a minor and the stepmother or stepfather is seeking to become the legal parent of the child. How does the process begin? Refer to the California Courts Self-Help Center, Guide to adoptions in California . An adoption request is filed with the Family Law Clerk's office. Forms can be found at t he California Courts Self-Help Center . See the fee schedule for fees to file the petition. There are additional fees for investigation service . If the fees present a hardship, you may be eligible for a fee waiver. The Request to Waive Court Fees ( FW-001 ) is the basic fee waiver form. For additional fees a ( FW-002 ) is required. To learn more about this form and applying for a fee waiver, read the Information Sheet on Waiver of Superior Court Fees and Costs . What happens next? Once an adoption request has been filed, Family Court Services will be notified and begin the investigation process. The petitioner will be given forms to complete and a list of documents the petitioner will need to obtain. Once you have gathered the required documents, you will need to schedule an appointment with the court investigator. The investigator will interview the petitioner, the spouse and the minor(s). The investigator will check law enforcement records, child abuse registry records and will verify the petitioner's employment. Petitioner must obtain references from three individuals not related to the him or her. The investigator's report, recommending for or against the adoption, will be sent to the court. What about the other (absent) parent? It is necessary to either gain the consent of the absent parent or terminate their parental rights before the adoption can be granted. It is the responsibility of the petitioner to attempt to locate the other parent and obtain their consent. If their whereabouts are unknown or they are unwilling to sign the consent, the petitioner will need to meet the legal requirements to proceed with the adoption. See Freedom from Parental Custody and Control When will the adoption take place? If all the legal requirements have been met, the petitioner will need to submit a memorandum for a hearing. The Family Law Clerk's Office will then set a hearing date for adoption. The State of California will send you a birth certificate with the child's adopted name six to twelve months after the adoption hearing.
