The information on this page is not intended to be comprehensive in nature, but to act as an overview. You are advised to thoroughly read California Rules of Court, rules 8.702-8.709 and rules 8.780-8.793. The court clerks cannot assist you. You should direct any questions you have to an attorney of your own choosing. The Colusa Superior court is part of the 3rd District Court of Appeals . Civil Appeals Limited Civil A Limited Civil appeal (for disputes involving $25,000 or less, including unlawful detainers), must file your notice of appeal within 30 days. The time period begins after the trial court clerk mails or a party serves either a document called a "Notice of Entry" of the trial court judgment or a file-stamped copy of the judgment, or within 90 days after the entry of judgment, whichever is earlier. This deadline cannot be extended. For information on filing an appeal in a limited civil case, please review the Judicial Council form APP-101-INFO Information on Appeal Procedures for Limited Civil Appeals . If your notice of appeal is late, the appellate division will not be able to consider your appeal. Judicial Council form APP-102 Notice of Appeal/Cross-Appeal (Limited Civil Case) may be used to file your appeal. File your appeal at the Clerk’s Office, 532 Oak Street, Colusa, CA 95932. California Rules of Court, Rules 8.821 – 8.843 and 8.880 – 8.891 , set forth the governing rules on procedures for limited civil appeals. Unlimited Civil Unlimited Civil appeals (disputes involving more than $25,000, including Unlawful Detainers, Probate, Family Law and Adoptions) must be filed with 60 days. The time period begins after the superior court clerk mails the party filing the appeal a notice of entry of judgment or a file-stamped copy of the judgment, showing the date either was mailed; 60 days after the appellant serves or is served by a party with a notice of entry of judgment or a file-stamped copy of the judgment, accompanied by a proof of service; or 180 days after entry of judgment. If your notice of appeal is filed late, your appeal will be dismissed. Judicial Council form APP-002 Notice of Appeal/Cross-Appeal (Unlimited Civil Cases) may be used to file your appeal. Small Claims When you appeal a small claims judgment, you ask the superior court to change the small claims court judge's decision. You will have another court hearing and must present your case again. A small claims appeal is a "trial de novo" or "new trial." This means that the case is decided by a new judge from the beginning so you have to present your case all over again. View more information on the small claims appeal process . Please note : The filing of an appeal does NOT postpone the payment of your fine or any other condition of the sentence. If the fine is not paid by the date specified or any condition ordered by the court is not met, a warrant may be issued for your arrest or a civil collections process may be instituted against you. (Pen. Code, § 1467.) Criminal Appeals Nature of an Appeal A party may appeal an unfavorable decision made in the trial court to the appellate division of the Superior Court. The appeal must be directed towards errors of law only. An appeal is not a retrial, and you will not be permitted to introduce new evidence. Divisions Family Law Court Mediator Court Mediator In this section Family Law Court Mediator About The Colusa County Superior Court Mediator, provides assistance to parties, as an impartial third party in developing a parenting plan/agreement. The goal of mediation is to develop a parenting plan/agreement that protects the health, safety, welfare and the best interest of your child(ren). Parenting plans outline how parents will care, visit and be responsible for their child(ren) and are meant to provide your child(ren) with a safe and stable way to have close and continuing contact with both parents. Scheduling an Appointment An appointment is required; you must download and fill out the Child Custody Mediation Intake Form, available in English or Spanish . A mediation appointment will not be scheduled without submitting a Child Custody Mediation Intake Form. Please download the intake form from the link above, print the form, and fill out all sections. Once the completed intake form is submitted to our office by either party, an appointment will be scheduled and a Notice of Mediation will be mailed to both parties. Both parties must submit the intake form to our office prior to their mediation appointment. Parties will not be allowed to mediate without an intake form. When you separate or divorce, you need to decide who will have “custody” of your children and how they will be taken care of. You also need to decide on visitation, which means how each parent will spend time with the children. There are two kinds of "custody" orders: Legal custody, which means to who makes important decisions for your children (health care, education, and welfare), and Physical custody, which means who your children live with “Visitation” (also called “time-share”) is: The plan for how the parents will share time with the children. In California, either parent can have custody, or the parents can share custody. The judge makes the final decision about custody and visitation but usually will approve the arrangement both parents agree on. If the parents can't agree, the judge will make a decision at a court hearing. The judge will not make a decision about custody/visitation until after the parents have met with a mediator. What are the types of custody orders? Legal custody can be: Joint, where both parents share the right and responsibility to make important decisions about the heath, education and welfare of the children Sole, where only one parent has the responsibility to make the important decisions about the health, education and welfare of the children Some examples of the decisions or choices parents with legal custody make are: School or childcare Religious activities or institutions Psychiatric, psychological, or other mental health counseling or therapy needs Doctor, dentist, orthodontist, or other health professional (except in emergency situations) Sports, summer camp, vacation, or extracurricular activities Travel Where to live Physical custody can be: Joint, which means that the children live with both parents Sole or primary, which means the children live with one parent most of the time and usually visit the other parent Sometimes, a judge gives parents joint legal custody, but not joint physical custody. This means both parents share the responsibility in making important decisions in the children’s lives. But, the children live with one parent most of the time. The parent who does not have physical custody usually has visitation with the children. What are the types of visitation orders? Visitation : When the parent who does not have the children more than half of the time has visitation with the children. Generally, it helps the parents and children to have detailed visitation plans to prevent conflicts and confusion Supervised Visitation: When the children's safety and well-being require that visits with the other parent be supervised by you, another adult, or a professional agency. Supervised visitation is sometimes also used in cases where a child and a parent need time to become more familiar with each other, like if a parent hasn’t seen the child in a long time and they need to slowly get to know each other again No Visitation: This option is used in situations when visiting with the parent, even with supervision, could be physically or emotionally harmful to the children. What are a “time-share plan” and a “parenting plan”? A time-share plan is another term used for visitation plan. A parenting plan can be a visitation plan, but usually also includes a custody plan that explains who has legal and physical custody. What does the law consider when deciding custody and visitation? The law says that judges must give custody according to what is in the best interest of the child. Judges look at the children’s health, safety and wellbeing to decide whether to give custody to one or both parents. Courts also consider any history of abuse by one or both of the parents. Courts do not automatically give custody to the mother or the father, no matter what the age or sex of your children. Courts cannot deny your right to custody or visitation just because you were never married to the other parent, or because you or the other parent has a physical disability, or a different lifestyle, religious belief or sexual orientation. In a few cases, if giving custody to either parent would harm the children, courts give custody to someone other than the parents because it is in the best interest of the children. Usually, this is called “guardianship,” where someone who is not the parent asks for custody of the children because the parents cannot care for the children. For more information, see Colusa's Self-Help page. What is “the best interest of the child”? It is what judges must consider to make their decisions about custody and visitation. To decide what is best for a child, the court will consider: The age of the child, The health of the child, The emotional ties between the parents and the child, The child's ties to school, home and their community, The ability of the parents to care for the child, Any history of family violence and/or substance abuse. If we have joint legal custody, do we have to agree on every decision? No, with joint legal custody both parents have the right to make decisions and either parent can make certain decisions on their own. It is important that parents cooperate in making decisions that require both parents' attention and to communicate any decisions that they make independently that might affect the other parent. Divisions Juvenile Juvenile The Juvenile Court is responsible for handling matters regarding minors. Overview The judges in Juvenile Court hears delinquency cases involving minors charged with violations of the law and dependency cases involving minors who have been neglected or abused. Juvenile Appeals A notice of appeal must be filed within 60 days after the rendition of the judgment or the making of the order being appealed. Except as provided in California Rules of Court, Rule 8.66, no court may extend the time to file a notice of appeal. Juvenile Traffic The traffic division processes juvenile cases involving only infractions. You may pay a traffic infraction by telephone, online, or in person unless the citation indicates it is a mandatory appearance. If a mandatory appearance is required, a parent or legal guardian must accompany minors. One of the following could occur: The arresting officer may release your child back to your custody. Your child may be referred to a community agency providing shelter, care, diversion or counseling. Your child could be detained in Juvenile Hall. If your child is detained, the Probation Officer must take immediate steps to notify you. Your child may be released to your custody with conditions and given a date to appear in court. If your child is not returned home, the law requires that a petition be filed, usually within 48 hours from the time the child is taken into custody. There will be a court hearing called a Detention/Arraignment hearing. You will be notified of this hearing date and time. Does my child need an attorney? Your child has the right to an attorney. If you cannot afford to hire an attorney for your child, the court will appoint an attorney to represent him or her. Will I be required to pay my child's fees? Yes, unless you were the victim of your child's crime, you will receive a bill from the county for various fees, including your child's attorney's fees; probation department service fees and placement costs for keeping your child in state placement such as the California Department of Juvenile Justice, a probation camp, or an out of home placement. You will have a chance to show how much, if any, of these costs you are able to pay. The Juvenile Court does not make this determination. In this section Traffic Information If you can't afford to pay Financial Hardship As part of your request, you must show proof that you do not have the financial means to pay your fine. You may ask the court to consider your ability to pay at any point in the process, but you must enter a plea of guilty or no contest before the court can give you an answer. The easiest way to request a fine reduction is to use the court’s new online request tool (recommended). The MyCitations online tool allows you to enter a plea and make an ability to pay requests on eligible infractions without going to court. In addition to requesting a reduction, you can request a payment plan, more time to pay or ask to complete community service instead of paying fines and fees. If your case is currently in collections and you cannot afford to pay your debt, you may still use MyCitations. The other way to request a fine reduction is to use form TR-320/CR320 - Can't Afford to Pay Fine: Traffic and Other Infractions. Please contact the clerk’s office for more information about using the form. Please note that if you do not act by the date on your citation and reminder notice, the court may add an additional fee of up to $100. If you cannot afford the fine amount, you can request a reduction to the amount you owe at any time while the fines remain unpaid. If you are experiencing financial hardship and you use the online tool to request a reduction, you may also use the online tool to ask the court to set up a payment plan, ask for an extension of time to pay what you owe and/or ask to complete community service hours in place of the fine. Payment plans will be approved for no more than $25 per month if you are approved for an ability-to-pay request. Fines and fees owed from a misdemeanor or felony offense are not eligible to request a reduction.
