Art Maps and Walking Guides Developer's Public Art Requirements Art Center For Emeryville Rotten City Cultural District Community Promotions Grant Community Annual Events Earth Day Shoreline Cleanup Water Safety Day Bike to Wherever Day Search Home / Development / Planning Division / Development Impact Fees (Nexus Studies, Annual Fee Updates & Reports) Development Impact Fees (Nexus Studies, Annual Fee Updates & Reports) In 1989, the California State Legislature passed the Mitigation Fee Act which added Section 66000 et seq. to the California Government Code, authorizing cities to impose development impact fees to mitigate the impacts that development projects may have upon the City’s ability to provide public facilities and affordable housing. Pursuant to the Mitigation Fee Act, the City of Emeryville has adopted three development impact fees: Transportation Facility Impact Fee Park and Recreation Facility Impact Fee Affordable Housing Impact Fee Find the current amount of the Development Impact Fees . Nexus Studies For each impact fee, the Mitigation Fee Act requires that the City prepare a “nexus study”, which establishes the existence of a reasonable relationship between the need for the public facilities and the impacts of the types of development described in the study for which the impact fee is charged, and that there is a reasonable relationship between the fee’s use and the type of development for which the fee is charged. The City of Emeryville has prepared four nexus studies related to its three impact fees (two were prepared for the Affordable Housing Impact Fee, one for residential development and one for non-residential development): Transportation Facility Impact Fee Study (PDF, 4MB) Park and Recreation Facility Impact Fee Study (PDF, 349KB) Affordable Housing Residential Impact Fee (PDF, 2MB) Affordable Housing Non-Residential Impact Fee (PDF, 3MB) Ordinances and Resolutions Two ordinances were passed on July 15, 2014 establishing the development impact fees. Ordinance No. 14-008 added Article 19 of Chapter 5 of Title 9 to the Emeryville Municipal Code, entitled “Development Impact Fees”, establishing the authority for the City to impose fees on development projects related to public facilities, including transportation facilities and parks and recreation facilities. Ordinance No. 14-009 amended Article 4 of Chapter 5 of Title 9 of the Emeryville Municipal Code, “Affordable Housing Program” establishing the authority for the City to impose fees on new rental residential projects and new nonresidential projects to mitigate the projects’ impacts on the need for affordable housing in the city. Ordinance No. 14-008, Development Impact Fees (PDF, 9MB) Ordinance No. 14-009, Affordable Housing Program (PDF, 9MB) Three related resolutions were also passed on July 15, 2014, one for each development impact fee, which approved and adopted the related nexus study and established the amount of each fee and the projects for which the fee was to be used. They also stipulated that, for each year in which the fees are not otherwise adjusted, the fee amounts shall be adjusted once as of July 1st based on the percentage increase in the Engineering News-Record Construction Cost Index for San Francisco, California. Resolution No. 14-105 Transportation Facility Impact Fees (PDF, 6MB) Resolution No. 14-104 Park and Recreation Facility Impact Fees (PDF, 2MB) Resolution No. 14-103 Affordable Housing Impact Fees (PDF, 2MB) Annual Fee Updates As authorized by the resolutions establishing the development impact fees, the City Council has updated the impact fees each year. Process Overview Submit two copies of the Cabaret Permit Application Form (PDF, 2MB) and the Cabaret License Application Fee to: The Emeryville Cashier Counter 1333 Park Avenue, Emeryville Hours: Monday - Thursday, 9:00 am - 12:00 pm; 1:00 pm - 5:00 pm Fridays, by appointment Please note that the application fee must be paid before the application can be processed and is non-refundable. Payment by cash, check, or card. The Police Department shall submit a written report to the City Manager within 60 days of receipt of a completed application containing a recommendation as to whether the requested license should be granted; the City Manager will submit the recommendation to the City Council, who will vote on whether to issue the license within 30 days. It is important to note that cabaret permits must be renewed annually on a calendar year basis; if you are applying for a calendar permit in the last couple months of the year, it may be wiser to wait until the new year the submit your application given the gap between receipt of the application and the permit being granted. Required Documents The following documents are required as part of your Cabaret Permit Application Form. The applicant(s) must provide the following: A complete name and address Complete set of fingerprints Criminal records, if applicable; A statement describing any previous permits obtained by the applicant for the sale of alcohol or any entertainment. If the applicant has previously applied for a permit or license that has been denied, revoked, or suspended, please provide information about the type of permit, the time of denial, revocation, or suspension, the jurisdiction involved, and the reasons for such action; A full and complete financial statement. Payment for application fee. The location of the cabaret or dance hall for which the license is required, including a building and floor plan of the premises; once the license is issued, the floor plan may not be modified without the prior written approval of the City. Business License, if applicable. The complete name and address of each owner or owners of the cabaret location. A detailed description of the proposed activities to be conducted, including whether an admission fee or cover charge will be charged or whether tickets will be issued.T The identity of all on-site managers. A description of security measures, including security personnel staffing, training and provision of security in and around off-street parking areas, and whether security personnel will be armed. A statement regarding whether alcohol will be served and whether the applicant has or will be applying for a license from the Department of Alcoholic Beverage Control. CREDIT AND REFUND POLICY Payment & Refund Policy This refund and withdrawal policy applies to all Community Services Department programming, including seniors, aquatics and swim lessons, fitness, youth and adult programs, camps, and all other recreation services—and does not apply to facility rentals or to the Emeryville Child Development Center (ECDC). Transaction fees paid at the time of purchase cannot be refunded, no matter the reason or length of time that has passed. Participant Withdrawal: 14 Days or More Before Start Date Withdrawals requested 14 or more days before the program start date qualify for the participant’s choice of: • Full credit to the household Rec account, or • Refund minus a $10 administrative fee Participant Withdrawal: Fewer Than 14 Days Before Start Date Withdrawals requested fewer than 14 days before the start date receive no credit or refund , except under documented hardship (illness, family emergency). Hardship requests must be submitted in writing to
[email protected] and must include class name, dates, participant name, and reason for request. Program Cancellation by the City If a class, camp, or program is canceled by the City due to insufficient enrollment, instructor cancellation, or facility issues, participants automatically receive a 100% credit or refund to their household account. Missed Classes Credits or refunds are not issued for absences, including vacations, scheduling conflicts, or no‑shows. Credits Credits are issued to the participant’s household Rec account and may be used by any household member for future programs, classes, camps, or rentals. Credits are non‑transferable outside the household. Check Refunds Payments received via cash or check will receive a refund check mailed within 4–6 weeks. Refund checks are issued to the Head of Household and will be made out from the account originally used for payment. Summer Camp Deposits All Summer Camp deposits are non‑refundable. Senior Trips Some Senior Trip refunds must be requested at least 30 days prior to the trip date. Requirements are listed in the Senior Center newsletter, The LINK . Pickleball Only Pickleball classes or lessons may be canceled up to 3 days in advance for a full refund. How do I enroll in programs, classes, and camps? Little Free Libraries are small outdoor book boxes where anyone can take a book or leave a book . They create opportunities for neighbors to connect, support literacy, and make reading accessible to everyone. On March 3, 2026, City Council approved a Little Free Library Program to install libraries in the public right of way. Find out how you can get involved below. What are Little Free Libraries? Little Free Libraries are free book exchanges popularized by the nonprofit organization Little Free Library. They typically take the form of a small wooden box of books mounted on a post in front of a home or business where passersby can easily access the books. How It Works If you plan to install a Little Free Library in the public right-of-way (such as along a sidewalk), you will need to submit a program application to the Public Works Department before installing it. The program is designed to be simple: No application fee Short application process Sponsors maintain their own library Encourages neighborhood book sharing Libraries installed on private property do not need approval but are encouraged to follow the program guidelines. In general, the Public Right of Way refers to an area where streets and sidewalks are located and are controlled by a public entity (i.e. City of Emeryville). This typically includes city parks and facilities, streets, sidewalks, and utilities. Program Guidelines and Requirements To keep sidewalks safe and accessible, libraries must meet a few basic standards: Location Maintain at least 4 feet of clear sidewalk space Stay clear of hydrants, poles, signs, and other infrastructure Cannot be placed in crosswalks, curb ramps, bus stops, or loading zones Size Maximum box size: 18" × 18" × 24" Height between 2 and 6 feet Installation Must be securely mounted on a post or stand Cannot be attached to trees or other City infrastructure Must be reachable from the sidewalk without stepping into the street Maintenance The library sponsor keeps the structure clean and safe Graffiti must be removed within 72 hours of notice Libraries are for free book sharing only (no commercial advertising) You can find more information in the Program Guidelines at this link Program Guidelines Do I need Permission to Install a Little Free Library?
