Interpreter Services Request for Criminal Jury Instructions (CALCRIM) Request for Criminal Jury Instructions (CALJIC) Criminal Cases Criminal cases range from relatively minor offenses such as traffic infractions to serious ones like robbery and murder. The state makes the charge against someone accused of committing a crime because a crime is considered an act against society. The prosecuting attorney presents the charge against the accused person (defendant) on behalf of the state (plaintiff), and must prove to the judge or jury that the defendant is guilty beyond a reasonable doubt. A Felony is a criminal offense punishable by imprisonment in a state prison or by death. A Misdemeanor is a lesser offense than a felony and generally is punishable by fine or imprisonment in a city or county jail rather than in a state penitentiary. An Infraction is resolved by paying a fine. A criminal case begins when a prosecutor files formal charges, a person is arrested, or a grand jury issues an indictment. If a defendant, the person accused of a crime, is in custody, he or she has the right to an arraignment within 48 hours of being arrested. At this hearing the judge will officially tell defendants about their constitutional rights and explain the charges against them. Also, bail (property temporarily given to ensure that a person released from custody will return at an appointed time) may be raised or lowered. The defendant will be asked to plead to the charges against them: guilty, not guilty, or, in some cases, nolo contendere (the person does not contest the charges, which legally is the same as a guilty plea). Misdemeanors Defendants who plead guilty to a misdemeanor may be sentenced during the arraignment, unless the judge wishes to postpone sentencing in order to study a probation report. During the arraignment, if a defendant pleads not guilty to a misdemeanor, the judge will set the date for a trial. The trial will be held within 30 days if the defendant is in custody or within 45 days if the defendant is not in custody-unless the defendant waives the right to a speedy trial. Felonies If a defendant pleads guilty to a felony at the arraignment, he or she must be represented by an attorney (unless the defendant, in a noncapital case, waives the right to one). After a guilty plea, the judge has the option to keep the case in that court for sentencing or probation or to transfer the case to a superior court. If a defendant pleads not guilty to a felony, a preliminary hearing is held. At this hearing the district attorney must show evidence that the defendant committed a felony and should be brought to trial. If the judge decides there is enough evidence, the defendant will be arraigned a second time in superior court, where the defendant again will be formally charged, rights will be explained, and a plea will be made. Sentences State and local laws define crimes and specify punishment. The maximum sentence for an infraction is a fine; for a misdemeanor it is up to one year in a county jail; and for a felony it is time in a state prison or, for some murders, death. Some counties offer "diversion" programs that allow a judge to order a defendant to get medical treatment or counseling or to do community service work. The diversion program may take the place of a fine or jail sentence in certain types of misdemeanor and felony cases. Should you believe your term of probation will be affected by the changes discussed below, you should seek legal advice from the attorney who handled your case or another attorney. As of January 1, 2021, Assembly Bill No. 1950 amended Penal Code sections 1203a and 1203.1 to change the maximum, or longest, term of probation that can be imposed for most criminal offenses. Under the new changes: Generally, the maximum term of probation for a misdemeanor offense is no more than one year. (Pen. Code, § 1203a, subd. (a).) Generally, the maximum term of probation for a felony offense is no more than two years. (Pen. Code, § 1203.1, subd. (a).) Visit our Jury Portal In this section Juror Information Civil Grand Jury Report & Response Jury Service Information The Jury Office of the Superior Court of California, County of Fresno, will provide the Courts with qualified jurors from the community, maintain courteous relations and provide excellent service to all jurors while upholding established rules of the Court. JURY SCAM ALERT The Juror Services Division does not call jurors to obtain personal information, including social security numbers and/or financial information. Juror phone numbers are not contained within our database unless provided by jurors who have served and even then are only called if the date and/or time that the juror was instructed to report has been changed. Jurors who have missed their date of service are notified by mail. Social security numbers are not contained within our database and we do not request this information from the juror. If you receive such a call do not give the caller any personal information and if possible record the caller's phone number and report the contact to both our juror office and local law enforcement. If you have any questions regarding this notice please contact the Juror Services Division at (559) 457-1600. One-trial or one-day system Fresno Superior Court has a one-trial or one-day system. If assigned to a courtroom you must return to that court until either dismissed from duty or completion of the trial. Jury Selection On the day you report for jury duty, you will either be involved in jury selection or dismissed from jury duty. If selected as a trial juror, you will be expected to serve for the duration of the trial, which will generally last longer than one day. Trial duration There can be a wide variance, but the average jury trial is approximately 5 days, depending upon the type and complexity of the case before the jury. Once the trial has concluded, this will fulfill your obligation for jury service for one year. Obligation Every qualified United States citizen has an obligation to serve as a juror when summoned. Trial by jury is a right guaranteed by the United States and California Constitutions. Civil Code of Procedure section 209 compels the attendance of any prospective juror if not excused. Instructions may vary daily, so it is important that the jurors read/listen to the full message and follow the instructions given, which may be to check back the next morning or afternoon for further instructions. Any jurors not needed during their service week will be excused. Reporting jurors are encouraged to bring their own bottled water, as coffee and tea will not be provided in the Jury Assembly Rooms and Jury Deliberation Rooms. Protecting the health and well-being of our jurors, staff and public is our highest priority. The Court will continue to take precautionary measures to keep our court visitors and employees safe. Divisions Small Claims Advisory Clinic Advisory Clinic In this section Small Claims Advisory Clinic Small Claims Advisory Clinic Small Claims is a court where people can exercise their rights to resolve disputes. Attorneys are not permitted to represent any side except in Small Claims appeals. United States citizenship is not required to file or defend a Small Claims case, but the parties must be at least 18 years old. Each claim cannot be more than $7,500. General Information ADA Policy ADA Policy Requests for Accommodations by Persons With Disabilities It is the intent of this Court to assure that qualified individuals with disabilities have equal and full access to the judicial system including court proceedings, services, programs, and activities. Nothing in this document shall be construed to impose limitations or to invalidate the remedies, rights, and procedures accorded to any qualified individuals with disabilities under state or federal law. Definitions The following definitions shall apply under this section: "Qualified individuals with disabilities" means persons covered by the Americans with Disabilities Act of 1990 (42 U.S.C. § 12101 et seq.); Civil Code section 51 et seq.; and other related state and federal laws; and includes individuals who have a physical or mental impairment that substantially limits one or more of the major life activities; have a record of such an impairment; or are regarded as having such an impairment. "Applicant" means any lawyer, party, witness, juror, or any other individual with an interest in attending any proceeding before any court of this state. "Accommodation(s)" may include, but are not limited to, making reasonable modifications in policies, practices, and procedures; furnishing, at no charge, to the qualified individuals with disabilities, auxiliary aids and services, which are not limited to equipment, devices, materials in alternative formats, and qualified interpreters or readers; and making each service, program, or activity, when viewed in its entirety, readily accessible to and usable by qualified individuals with disabilities requesting accommodations. While not requiring that each existing facility be accessible, this standard, known as "program accessibility," must be provided by methods including alteration of existing facilities, acquisition or construction of additional facilities, relocation of a service or program to an accessible facility, or provision of services at alternate sites. The "section" means this section regarding requests for accommodations in state courts by qualified individuals with disabilities. "Confidentiality" applies to the identity of the applicant in all oral or written communications, including all files and documents submitted by an applicant as part of the application process. B. Process The following is the process for requesting accommodations in court proceedings: Applications requesting accommodation(s) pursuant to this rule may be presented ex parte (i.e., done on behalf of one party only and without notice to an opposing party) in writing, on form MC-410 , which can be obtained by contacting the courtroom clerk, ADA Facilities Coordinator or the ADA site coordinator, or orally as the court may allow. Applications should be made at the designated Office of the Clerk, or to the courtroom clerk or judicial assistant where the proceeding will take place, or to the judicial officer who will preside over the proceeding. All applications for accommodations shall include a description of the accommodation sought, along with a statement of the impairment that necessitates such accommodation. The court, in its discretion, may require the applicant to provide additional information about the qualifying impairment. Applications should be made as far in advance of the requested implementation date as possible, and in any event should be made no less than five court days prior to the requested implementation date. The court may, in its discretion, waive this requirement. Upon request, the court shall place under seal the identity of the applicant as designated on the application form and all other identifying information provided to the court pursuant to the application. C. Permitted Communication: An applicant may make ex parte communications with the court. Such communications shall deal only with the accommodation(s) the applicant's disability requires and shall not deal in any manner with the subject matter or merits of the proceedings before the court. D. Grant of Accommodation: The court shall grant an accommodation as follows: In determining whether to grant an accommodation and what accommodation to grant, the court shall consider, but is not limited by, the provisions of the Americans with Disabilities Act of 1990 and related state and federal laws. The applicant will be informed in writing of findings of fact and orders, as may be appropriate, that the request for accommodations is granted or denied, in whole or in part, and the nature of the accommodation(s) to be provided, if any. E. Denial of Accommodation: An application may be denied only if the court finds that: The applicant has failed to satisfy the requirements of this rule; or The requested accommodation(s) would create an undue financial or administrative burden on the court; or The requested accommodation(s) would fundamentally alter the nature of the service, program, or activity. F. Review Procedure: An applicant or any participant in the proceeding in which an accommodation has been denied or granted may seek review of a determination made by nonjudicial court personnel within 10 days of the date of the notice of denial or grant by submitting a request for review to the judicial officer who will preside over the proceeding or to the presiding judge if the matter has not been assigned.
