Traffic infractions are enforced by the issuance of traffic tickets ("citations") by law enforcement agencies. It is important to read the information on the front and back of the citation. Information to note on the citation is the: Citation number Date and time of the citation Violations for which you were cited Place and time that you promised to appear Courtesy Notice The Court mails a courtesy notice to the address shown on the citation approximately 2 weeks prior to the due date on the bottom of your citation. The courtesy notice contains the following information: Bail amount Due date to pay or appear Information regarding traffic school eligibility Any proof of correction requirements needed to clear the citation Information on how to contest a citation For certain bail options (multiple violations and traffic school and/or proof of correction eligibility/bail), you may be required to contact the Court. Your courtesy notice will indicate "You must contact the Court for this bail amount." Court employees cannot quote bail or provide information to you regarding your citation until the Court receives the citation from the citing agency which may take up to two or three weeks. If you do not receive a courtesy notice within one week prior to the appearance date on the bottom of your citation, it is your responsibility to contact the Court for bail or appearance information. Please call or visit the Marina Traffic Division during normal business hours. If you are required to appear in Court, you will receive a mandatory appearance notice with a date and time to appear in Court. Financial Hardship If you cannot pay the full amount owing due to financial hardship and your case is not in Collections (past due and referred to Monterey County Revenue Division) Click here to request a fine reduction If your case is in Collections, you must contact Monterey County Revenue Division at (831) 755-5042 to begin the process to submit a petition. Failure to Appear or Respond to Citation If you fail to appear or pay your bail by the due date: Your case will be referred to a collection agency OR a warrant for your arrest may be issued. If your fine is delinquent and has been assigned to Monterey County Revenue (the Court's collection agency) all questions must be directed to Monterey County Revenue at (831) 755-5042. Parking Citations The Court does not process parking violations. Please contact the number indicated on the parking citation for processing details. City of Salinas Red Light Camera Ticket If you received a Notice to Appear for a red-light camera violation the following information is provided to assist you: To view the violation images and/or video online, go to www.ViolationInfo.com and follow the instruction on the back of the Notice to Appear. If you are the person in the red light camera photograph and you wish to pay the bail you have the options listed below under "Payment Options" . If you are the person in the red light camera photograph and you wish to contest your citation, you have the options listed below under "Trial by Declaration" or "Court Trial" . If you are not the person in the red-light camera photograph or if the vehicle is a company vehicle, do not pay the citation if you plan to have it taken out of your name . If you are the owner and someone else was driving, you must follow the instructions on the back of the Notice to Appear and submit the Affidavit of Non-Liability by the due date to: Violation Processing Center PO Box 22091 Tempe, AZ 85285-2091 For assistance with red light camera tickets call 1-866-790-4111 Payment Options You may pay your citation using the following options: By mail: You may send a check or money order in United States funds made payable to the Monterey County Superior Court. To ensure proper credit, write the name of the person who received the citation, if different from the name imprinted on the check, the case number or citation number on the front of the check. Please do not send cash . The mailing and street address for the Marina Court Division, which is the location accepting traffic payments, is on the Court location page Pay online / By credit card: Credit card payments can be made for most traffic and minor offense violations through the web. The Court accepts Visa, Mastercard and American Express through the automated system. A small nonrefundable convenience fee will be charged by EDS*Pay in addition to your bail or fine, and will appear as a separate item on your credit card statement. The fine can be paid in full or monthly payment arrangements can be made on line for your convenience. Please visit the Traffic Online Services page for more information and to make payments. Welfare and Institutions Code Section 256 Code Section 256 specifies the offenses that may be heard in the Juvenile Traffic and Minor Offense Court, which include: Non-felony Vehicle Code violations Violations of state or local law relating to traffic Fish and Game Code violations Violations of state and local law relating to evasion of fares on a public transportation system Daytime loitering Curfew violations Drunkenness in public Business and Professions Code violations related to possession or consumption of alcohol by a minor Graffiti Possession of less than one ounce of marijuana Petty theft (charged as an infraction) Penal Code Section 415 - Disturbing the peace (charged as an infraction) Mandatory Appearance Policy Because the law prohibits forfeiture of bail in lieu of an appearance by a minor, the Juvenile Court requires a personal appearance by the minor . Normally at least one parent is required to attend the hearing. The Juvenile Court is accustomed to reinforcing the parent-child relationship. Parental presence ensures that parents are aware of the incident, understand the reasons for the disposition made in the case, and can cooperate in the imposition of appropriate sanctions. Examination and Selection Applicants must satisfy all selection requirements at the time of applying. All completed application materials will be reviewed after the application closing date to determine if each applicant meets the stated desirable qualifications for the position. Applicants should note that possession of the desirable qualifications is not necessarily a guarantee of further advancement in the employment process. Based upon the information provided in application materials, the most qualified applicants will be invited for further examination. The examination may consist of application screening, written exam or exercise, performance or practical exam, oral interview, or any combination thereof. Eligibility List Applicants who successfully pass the required examination(s) may be placed on an eligibility list. Placement on the list does not guarantee an offer of employment; the Court can consider your candidacy as long as the list is valid. Eligibility lists are normally valid for 1 (one) year, but may be extended or deactivated sooner to best meet the needs of the Court. Employment Eligibility Information In accordance with the Immigration Reform and Control Act, all persons are required to present to the Court at the time of appointment, original documents which show proof of 1) identity and 2) U.S. Citizenship or a legal right to work in the United States. Fingerprinting and Security Clearance Applicants who are offered a position are required to be fingerprinted and must pass a criminal background check. Information obtained will be evaluated for compatibility with Court employment. Oath of Office Every Court employee must take and sign the Oath of Office before he or she commences the duties of Court employment. Salary Policy Appointments are usually made at the first step of the salary range. Probationary Period Depending on the position, candidates must successfully complete a probationary period of nine or twelve months. Upon successful completion of the probationary period, newly hired employees achieve regular hire status. Please see the list below for more information on each of the Court programs. Alcohol Treatment Program All DUI and Wet/Reckless Vehicle Code convictions require attendance and completion of an Alcohol Program licensed by the State of California Department of Alcohol and Drugs as required by the Department of Motor Vehicles. Ignition Interlock Device An ignition interlock device (IID) is a device slightly larger than a cell phone that is wired to your vehicle's ignition. The device can be installed in a vehicle while you wait and after installation, it requires your breath sample before the engine will start. If the IID detects alcohol on your breath, the engine will not start. As you drive, you are periodically required to provide breath samples to ensure the continued absence of alcohol in your system. DUI convictions may require the installation of an ignition interlock device. A first-time DUI conviction, the Court has the discretion to order the installation of the interlock device, though the Court will give heightened consideration in cases involving a Blood Alcohol Content that is .15 or higher, where there is a refusal to take a chemical test, or where there is an accident or some other aggravating factor. On a subsequent DUI conviction, the Court is required to order the installation of an ignition interlock device; the court has the discretion to order the device for one year, two years, or three years. The California Department of Motor Vehicles (DMV) maintains a list of approved Interlock Device providers accessible from the DMV website at: Ignition Interlock Device List . Jail Sentence Alternative Programs Work Alternative Program If you have been sentenced to serve a jail sentence of 40 days or less, you may be eligible to serve your sentence in the WORK ALTERNATIVE PROGRAM (WAP), i.e. community service. WAP is an alternative to incarceration. For more information contact the Monterey County Sheriff's Office . Supervised Home Confinement If you have been sentenced to serve a jail sentence, you may be eligible to serve your sentence in the Supervised Home Confinement Program (SHC). SHC is a custodial supervision program for non-violent offenders managed by the Monterey County Probation Department; this program is an alternative to incarceration in the County Jail. Participants who apply to and are accepted into the program are monitored at their homes, schools, and jobs through a tamper-proof ankle device worn to track their location. Those who violate the rules of the program by leaving the preset transmitter coverage area are returned to jail to complete their sentences and could face additional penalties for violations of probation terms. Participants are charged a fee for this service; the fee is based upon the defendant's income and ability to pay. For more information contact Monterey County Probation Department . The Theft Offender Program The Judge may order a defendant to attend and complete a theft offender class as part of a Pretrial Diversion Program or as a condition of sentencing. The program is an 8 hour educational awareness and prevention class for persons charged with a minor theft offense. A registration fee will be required by the program and is to be paid directly to the program. The Assaultive Behavior Program The Judge may order a defendant to attend and complete an Assaultive Behavior class as part of a Pretrial diversion program or as a condition of sentencing. The program is an 8 hour educational awareness and prevention class for persons charged with a minor assault offense or who may show signs of aggressiveness or assaultive behavior. The class is designed to provide insight and encourage participants to make decisions and changes to avoid a repeat offense. A registration fee will be required by the program and is to be paid directly to the program. Deferred Entry of Judgment Drug Program – Misdemeanors (PC §1000.1) One common form of diversion is called Deferred Entry of Judgment or DEJ. It is usually offered to a first-time drug offender who is charged with under the influence or simple possession of drugs for personal use. The Deferred Entry of Judgment program is implemented through collaboration between the Superior Court, Monterey County Probation Department, Monterey County Behavioral Health services, the District Attorney's Office, the Public Defender's Office and treatment providers. For Deferred Entry, the eligible defendant enters a guilty plea to the underlying charge(s). The Judge places the defendant on a deferred entry of judgment (diversion) program for a maximum of 18 months. Defendant(s) are referred to the court approved program, which includes mandatory counseling sessions at Valley Health Associates. Upon successful completion of a deferred entry of judgment program, the arrest upon which the judgment was deferred shall be deemed to have never occurred. The defendant may indicate in response to any question concerning his or her prior criminal record that he or she was not arrested or granted deferred entry of judgment for the offense, except as specified in Penal Code section 1001 subdivision (b). A record pertaining to an arrest resulting in successful completion of a deferred entry of judgment program shall not, without the defendant's consent, be used in any way that could result in the denial of any employment, benefit, license, or certificate. Access to electronic records save the public time and effort and promotes efficiency with court operations. The Court complies with California Rule of Court (CRC) 2.500 - Public Access to Electronic Court Records by providing: Remote electronic access to indexes, court calendars and registers of action, CRC 2.507(b); and Courthouse electronic access to court records. Requesting Court Records In Person The Clerk will conduct up to 3 record searches in person. If you have more than 3 searches, you may be required to give the Clerk up to 72 hours to process your request. Provide the following information to the Clerk's Office: Case number; Full name(s), date of birth, driver's license number; Location and date of violation; Any additional information available that will assist the clerk with identifying the case. Pay the appropriate fees to the Clerk of the Court. The Clerk's Office accepts cash, checks, and money orders. All checks must be printed with the account holder's name and address. The Clerk's Office accepts debit and credit cards for a small fee. By Mail The request must be made in writing with the submission of a Request for a Record Search and/or Copies form. Please include the following information, if available: Case number; Full name(s), date of birth, driver's license number; Location and date of violation; Any additional information available that will assist the clerk with identifying the case. Pay the appropriate fees to the Clerk of the Court. The Clerk's Office accepts checks or money orders only for mailed requests. Do Not Send Cash . Please refer to the current local Fee Schedule under the Record Related Fees section for fee details. Make the check payable to the Superior Court and mail to: Superior Court of California, County of Monterey Attention: Records- Traffic 3180 Del Monte Blvd., Marina, CA 93901 Image All checks must be printed with the account holder's name and address. If you are unable to determine the amount due, submit a check payable to the Superior Court with an amount stating "Not to exceed $200.00 Dollars"; this is an estimated amount for the fees due. This payment will allow the Clerk to process your request and to apply the monies to the cost of the research and any other records-related fees. The Clerk will write-in the actual amount due on the check, not exceeding the authorized amount of $200.00. See an example of a "not to exceed" check below. Include a self-addressed, stamped envelope large enough to accommodate your request. Postage will be added to your check if postage is insufficient. Request for A Copy Or Certified Copy Of A Court Document A request for a copy of a document may be made in person at the Clerk's Office or submitted in writing by mail. If your request for a copy of a court record is a result of a governmental agency requesting a court disposition from you, please submit a copy of the notice from the governmental agency with your request for copies or bring the notice with you. If the case number is unknown, you may conduct your own record search. Refer to the Case Look-Up section to obtain a case number for traffic cases filed after November 1992. Certification Fee Requests for Court's certification stamp, and court seal, declaring the document a true copy of the original, please see refer to the current local Fee Schedule , for both certification and copy fees. Processing Time Please allow a minimum of 10 days for processing your request. Request for Audio Recording of Court Proceedings For cases recorded with an electronic recording device, an audio compact disc (CD) of the hearing will be available through the Clerk's Office. A transcript will not be prepared by the Court. The audio recording will be copied to a (CD). Audio recordings are available for traffic and misdemeanor hearings. To request a CD, you may either appear in person or call the Clerk's Office at the Court location where you appeared. See the local Fee Schedule for current fees.
